About this file

This is a Byrd Anti-Lobbying Certification form required by the City of Charlotte, North Carolina for their Forestry Mulching Services contract opportunity. The certification serves as a mandatory prerequisite for contract award and requires the undersigned company to attest that no federal appropriated funds have been or will be used to influence officers or employees of any agency, Members of Congress, or congressional staff in connection with this federal contract, grant, loan, or cooperative agreement. The form applies to the extension, continuation, renewal, amendment, or modification of any federal contract, grant, loan, or cooperative agreement related to forestry mulching services across City-owned or managed properties.

The certification mandates that if any non-federal funds are used for lobbying contacts related to this contract, the contractor must complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying," in accordance with government-wide guidance. The contractor must also include the certification language in all subaward documents at all tiers, including subcontracts and subgrants, ensuring all subrecipients certify and disclose accordingly. The submission of this certification is a material representation of fact and a prerequisite to entering into the transaction under 31 U.S.C. § 1352. Failure to file the required certification subjects any person to civil penalties ranging from $10,000 to $100,000 for each failure, and the provisions of 31 U.S.C. § 3801 et seq. apply to the certification and any required disclosures.
