About this file
This is a Certification Regarding Lobbying form required for federal contracts, grants, loans, and cooperative agreements, specifically applicable to the Florida state and local Disaster Debris Management RFP. The certification must be submitted with any bid or offer exceeding $100,000 or any bid that may be paid under a FEMA Public Assistance Grant. The form addresses the management of disaster debris resulting from catastrophic events such as tornadoes and hurricanes, with contractors required to demonstrate capacity for rapid mobilization and response to wide-scale debris volumes in accordance with Federal Emergency Management Agency (FEMA), Florida Department of Environmental Protection (FDEP), Florida Department of Emergency Management (FDEM), and local county ordinance requirements. The contract scope includes disaster recovery services during preparation, response, recovery, and mitigation phases of emergency situations, as well as beach cleaning due to Red Tide or other marine-related events.
The contractor certifies that no federal appropriated funds have been or will be paid to influence any officer or employee of a federal agency, Member of Congress, or congressional employee in connection with the federal contract award. Should any non-federal funds be used for lobbying purposes, the contractor must complete and submit Standard Form-LLL, Disclosure Form to Report Lobbying. The contractor is required to include this certification language in all subaward documents at all tiers and ensure all subrecipients certify and disclose accordingly. Failure to file the required certification subjects the contractor to civil penalties of not less than $10,000 and not more than $100,000 for each failure. The certification is a material representation of fact and a prerequisite for entering into this federally-funded transaction under 31 U.S.C. § 1352, with provisions of 31 U.S.C. § 3801 et seq. applying to the certification and disclosure requirements.
