About this file
This document is an Addendum (#5) to a Request for Proposals (RFP) issued by the Port Authority of New York and New Jersey for Expert Professional Project Support Services to be procured on a "Task Order" basis for a four-year term (RFP# 6000002545). The RFP seeks proposals from prime firms to provide project control services, with a specific requirement that firms submit a minimum of two project-specific Building Information Modeling (BIM) models completed within the past five years across various project types including design-bid build, design-build/fast track, and construction trades for building, heavy/civil, or infrastructure projects. The proposal submission deadline is set for 2:00 P.M. on December 18, 2024.
The addendum includes clarifications on proposer requirements, with the Port Authority allowing firms to submit proposals for multiple categories by checking appropriate boxes on the Proposal Template. The document provides detailed answers to six questions from potential bidders, covering topics such as submission requirements, acceptable personnel titles, definition of "actual hourly rate" (current rate paid to employee without markup), and potential conflicts of interest. The Port Authority explicitly states it will not accept contract exceptions or redlines to the sample agreement to maintain a fair and equitable process for all awardees, and reserves the right to determine conflicts of interest at the task order level.

SUBJECT: REQUEST FOR PROPOSALS FOR THE PERFORMANCE OF EXPERT
PROFESSIONAL PROJECT SUPPORT SERVICES AS REQUESTED ON
A “TASK ORDER” BASIS FOR A FOUR-YEAR TERM (RFP# 6000002545)
– ADDENDUM #5
Dear Sir or Madam:
The Port Authority of New York and New Jersey (the Authority) hereby amends the subject Request for Proposals (RFP) as follows:
• Under Section IV. Proposer Requirements, Item B(a) please delete in its entirety and replace with the below:
B. Project Control Services
a) Prime firm must submit with their Proposal a minimum of two project specific BIM models, completed within the past five years, for any, all, or combination of, the below types of projects.
• Design-bid build
• Design-build / fast track
• Any construction trade for building, or heavy/civil, or infrastructure construction BIM models may be submitted in native format, pdf format, images/graphics from the BIM model, a dashboard, or drawings. No other alternatives will be considered. If requested by the Authority, a native 3D BIM model must be available to share.
The following are questions from RFP recipients. The questions and the corresponding Authority answers are provided for your information and use, as appropriate.
Question #1: If we are pursuing multiple categories, do we need to make multiple submissions, or should we check the appropriate boxes under “4. Proposer Requirements” on page 3 of the Proposal Template?
Answer #1: Be sure to check all the appropriate boxes you intend to propose on under “4. Proposer Requirements” on page 3 of the Proposal Template. You can submit one proposal for any and all categories, but be sure to indicate which individuals/projects pertain to what category.
Question #2: For the proposer requirement under Project Control Services, part B, states that a prime firm can alternatively demonstrates through owner/principal having the direct continuous experience in the project types listed. Therefore, are the project specific models or drawings still required or would the resume fulfill this?
Answer #2: The person or entities owning and controlling the Prime firm would have to meet the same requirements including completing two types of the projects and submitting the project specific models or drawings. “Prime firm may alternatively fulfill the firm experience prerequisite in Item B,a) above, if it can demonstrate that the person or entities owning and controlling the firm have had a cumulative total of at least the same number and type of direct continuous
- 2 -experience as identified above or has owned and controlled other entities which, meet the same requirements, prior to the submission of this Proposal as is required of the prime firm.”
Question #3: Is Port Authority open to accepting proposed titles and rates that correspond to the titles in Attachment G (Principal or Partner, Professional Personnel, and Technical Personnel), but are not the actual titles themselves? For example, we have a number of roles that are associated with Technical Personnel with different rates (e.g., Data Scientist, Data Architect, etc.). We would like to include all relevant roles/rates.
Answer #3: Yes, you may include the current title used by the Prime Firm for technical personnel.
Question #4: Can Port Authority define 'actual hourly rate'?
Answer #4: Current hourly rate paid to employee without markup.
Question #5: Will Port Authority accept contract exceptions/redlines to the sample agreement provided with the RFP as part of our response?
Answer #5: The Port Authority is not accepting exceptions under this Task Order Program. In order to maintain a fair and equitable process for all awardees we decline to accept exceptions.
Question #6: Would qualifying for the professional services category prohibit our firm from competing on any RFPs/RFIs issued by the agency?
Answer #6: At this time we do not anticipate any conflicts of interest. However, at a task order level the Authority always reserves the right to deem something a conflict.
The date for receipt of proposals for the subject RFP remains 2:00 P.M. on December 18, 2024.
