About this file
This document is a Terms and Conditions agreement for Cloud Services established by the City of Arlington, Texas Office of Procurement. The agreement applies to all cloud service providers delivering software-, platform-, or infrastructure-as-a-service solutions to the City and establishes baseline security, operational, and compliance requirements for the contract term. Key operational requirements include twenty-four-hour, seven-day-per-week service availability with reasonable maintenance downtime, forty-eight-hour advance written notice for any service updates, and mandatory GovRAMP Core Certification or TX-RAMP Level 2 Certification for all cloud products and services, with new services required to hold certification at the contract effective date and renewal services required to obtain certification within 180 calendar days. The City reserves the right to import or export all City data and applications at any time without contractor interference, and contractors must transfer all City data within sixty calendar days of contract termination or expiration in an unencrypted format designated by the City.
All cloud services must be provisioned exclusively from United States-based data centers, with City data storage at rest located solely within the United States and subject to physical security controls limiting access to authorized personnel only. Contractors bear full responsibility for security and must report any information security or privacy incidents to the City's Office of Cybersecurity within seventy-two hours of identification. The agreement prohibits early termination fees, restricts rate and fee increases to written amendments signed by both parties, and prohibits overage and excess usage fees without prior written City consent. Contractors must comply with all applicable data privacy and security laws including FBI Criminal Justice Information Services compliance, HIPAA, and PCI security standards, provide comprehensive access to security logs and reporting tools, and ensure employees and subcontractors comply with all confidentiality, availability, integrity, and security provisions applicable to City data.
