UDOT seeks to procure Pavement Marking Waterborne Traffic Paint in white, yellow, and black colors that meet UDOT standard specification 02765. The paint will be supplied in polyethylene tote containers in three capacity options: 250 gallons, 300 gallons, and 345 gallons. The contract anticipates awarding to a single bidder per container size. UDOT will order product on an as-needed basis with no guaranteed minimum purchase amount. The contract term is three years with two optional one-year renewals. Paint received cannot be older than 90 days from the date of manufacture, and the contractor must provide milestone notifications regarding shipment status, including real-time tracking capability at 30-minute intervals for full truckloads.

The contract pricing will be guaranteed for one year from award, with any subsequent price adjustments requiring equal guarantee periods and 30 days' notice, supported by documentation demonstrating a logical mathematical link between current and proposed pricing. The paint must meet specific technical requirements including minimum pigment content of 60 percent by weight across all colors, total solids of 77 percent by weight minimum, viscosity of 80-95 KU at 77 degrees Fahrenheit, and volatile organic content not exceeding 100 g/L. Additional requirements include no-pick-up time of three minutes maximum and no-track time of 10 minutes maximum per ASTM D-711. Totes must be lined to prevent paint degradation, equipped with quick couplers, capable of being stacked two-high when full, and remain the property of the supplier. Seller errors must be corrected within 14 calendar days, and penalties for returning improperly filled totes range from $100 to $500 per occurrence depending on violation frequency. The contractor must comply with all non-discrimination statutes and regulations specified in the appendix.
