About this file
This is a Claim of Business Confidentiality Form for the Utah Department of Transportation (UDOT) Pavement Marking Waterborne Traffic Paint solicitation. The form allows bidders to assert claims of business confidentiality for specific information submitted in response to the UDOT Invitation for Bid (IFB) for pavement marking waterborne (high build) traffic paint in white, yellow, and black colors that must meet UDOT standard specification 02765. Bidders may claim confidentiality protection for non-public financial statements, specific employee names and contact information, customer or client lists, or other specified information that qualifies as trade secrets or commercially sensitive data under Utah Code Annotated Section 13-24-2. The form requires bidders to identify the specific pages and paragraphs of their proposal for which confidentiality is claimed and to provide detailed reasons supporting the claim based on either trade secret status or potential competitive injury.
Notably, pricing and cost proposals may not be classified as confidential or protected and will be considered public information. Additionally, an entire proposal cannot be identified as "protected," "confidential," or "proprietary" in its entirety. Bidders who submit claims of business confidentiality will be notified if records claimed as protected are later classified as public or if the governmental entity determines that records should be released after weighing interests under applicable Utah Code provisions. The form must be signed by an authorized representative on behalf of the submitting company with the date of submission, and bidders may use additional sheets if necessary to fully document their confidentiality claims.
