The solicitation is for a fixed-price variable-scope contract, where the total mileage to be awarded may be less than the 116.910 mile maximum. The work includes roadway reconditioning and adding 4 inches of aggregate surface course, with costs for incidental items like watering for dust control and subexcavation. The anticipated schedule is to advertise in September 2024, award in Fall 2024, and perform construction from June 2025 through September 2025. The anticipated contract value is $8,650,000. Questions and Answers during Advertisement for CO OMAD 300(69) Minuteman Missile Access Road

October 23, 2024

Questions Answers 1 Reference: I.) Invitation for Bid, E-34, Section 204 – Excavation

& Embankment, 204.07 Subexcavation, 2nd Paragraph, “Dispose of unsuitable material according to Subsection 204.14.” II.)

Standard Specifications for Construction of Roads and Bridges on Federal Highway Project (FP-14), Section 204.14, Disposal of Unsuitable or Excess Material. “Dispose of unsuitable or excess material according to Subsection 203.05(a).”, Section 203.05 Disposing of Material, (a) Remove from project.

a. Does the Government have any disposal areas or potential disposal areas that can be provided to the Contractors?

See SCR Subsection 204.07, FP-14 204.14, FP 14 203.05(a).

2 Reference: I.) CO OMAD 300(69) Minuteman Missile Access Roads Plans, Sheet B2, Note 4. “No specific locations requiring subexcavation have been identified. Perform subexcavation as directed by the CO. Cost is incidental to placing the aggregate surface course.”

a. While we acknowledge that no specific subexcavation locations have been identified at this stage, leaving subexcavation entirely "as directed by the CO" without clear boundaries introduces significant uncertainty. Requiring that the cost be considered incidental to the aggregate surface course is placing all the risk on the Contractor for undefined, unquantifiable, variable work. To ensure both parties are fairly protected, and any additional work can be properly accounted for and compensated as needed will the Government

Refer to FAR Clause 52.236-3 Site Investigations and Conditions Affecting the Work.

entertain establishing unit prices or allowances for subexcavation by the cubic yard performed?

3 Reference: I.) CO OMAD 300(69) Minuteman Missile Access

Roads Plans, Sheet F1, Note 7. “Furnish geotextile filter type conforming to subsection 714.01(a).”

a. The Subexcavation geotextile filter costs are considered incidental to the aggregate surface course, placing all the risk on the Contractor for undefined, unquantifiable, variable work. To ensure both parties are fairly protected, and any additional work can be properly accounted for and compensated as needed will the Government entertain establishing unit prices or allowances for subexcavation geotextile filter by the square yard installed?

4 Are there any additional details/requirements for erosion control.

a. Will winning contractor be required to submit state/federal approved SWMPP plans for each section of road? Or will one SWMPP cover all roads included in the project?

b. The IFB and Specs mention a contract erosion and sediment control plan. Is this available?

Per review of the Colorado, Wyoming, and Nebraska General Construction Permits, the project activities are exempt from NPDES permitting.

5 Will the erosion control plan be regulated by the EPA or individual states?

a. Would stormwater permitting be under the Federal umbrella, or does the project require three separate State-based discharge permits?

Per review of the Colorado, Wyoming, and Nebraska General Construction Permits, the project activities are exempt from NPDES permitting.

6 Specifications mention required 2 non work days for every 14 calendar days – Does this include weekends?

Weekends are calendar days. Refer to SCR 156.07(j)

7 Where will the required contractor training take place?

Refer to SCR 108.01. Typically this training is completed virtually.

8 Why is the “mileage bid “being used to calculate the per unit price for deduction on the aggregate surface course? Using this method places undue risk on the contractor.

See Amendment A002

9 FP 106.05 states that “ (5) Adjusted payment for material in a lot will be made at a price determined by multiplying the contract unit bid price by the lot pay factor as determined above,” there is no mention of figuring a “deduction amount”. We request that the AGGREGATE SURFACE COURSE Item be used to calculate per unit price for deduction, per lot, as is consistent with the FP Manual.

See Amendment A002

10 107.03A Public Notice – Advertisements in the rural area of this project are very difficult. Many local papers only publish on one day now, and that day is not Sunday. Please consider changing requirements to publish on any day one week apart.

Refer to SCR 107.03A.

11 108.04 Failure to Complete Work on Time. – The section does not describe the amount for Liquidated Damages. Usually this is figured from Table 108-1. However, this section says to delete this table. Please clarify.

See 52.211-12 of the contract clauses

12 We feel the frequency of material testing on these gravel road maintenance projects is too much. It was a problem last year for getting splits and materials sent to CFL in a timely fashion. Is there any way the frequency can be increased to say 1 per 750 tons for densities, and one per 1000 tons for gradations and atterburg limits?

Bid per plan.

13 Are survey plats required for this project that are provided by a

RPLS?

Refer to 104.03(a)(3), SCR Subsection 152, FP-14 Subsection 152.

14 Is this project Tax Exempt?

See FAR 52.229-3 Federal, State, and Local Taxes clause. Refer to specific state tax exempt information.

15 Is there a minimum number of crew(s) expected to perform this project in the allotted time frame?

See FAR 52.236-6 Superintendence by the Contractor.

16 If multiple crews are utilized does each crew need an onsite superintendent or can the assigned superintendent manage multiple crews and locations?

See FAR 52.236-6 Superintendence by the Contractor.

17 Is a full-time SSHO required for this project?

Refer to SCR 107.01, SCR 107.08

18 Could you please give more clarity on the following statement:

“Note #4 Sheet B2 – No specific locations requiring subexcavation have been identified. Perform subexcavation as directed by the CO. Cost is incidental to placing the aggregate surface course.”

19 Is the following statement, correct? How was this calculated?

“52.211-12 Liquidated Damages - Construction. (SEP 2000) - a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $5,800 for each calendar day of delay until the work is completed or accepted. (b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.”

Refer to pages E-16 and E-17, 52.211-12.

20 Pease clarify the following statement: “Where the specification make reference to AASHTO Test T310, “Direct Transmission Method of In-Place Nuclear Density and Moisture Content” shall be the procedure followed. 106.2 Visual Inspection. Acceptance is based on visual inspection of work for compliance with the contract requirements. In the absence of specific contract requirements or tolerances, use prevailing industry standards.”

Follow the referenced tests and specifications. These two sentences in the “Question” column are from two separate subsections. No clarification needed.
