DEPARTMENT OF TRANSPORTATION
FEDERAL HIGHWAY ADMINISTRATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity
Department of Transportation, Federal Highway Administration, Central Federal Lands Highway Division (CFLHD), 12300 Dakota Avenue, Lakewood, Colorado.
2. Nature and/or description of the action being approved
Justification and approval to use other than full and open competition to award a contract for w-beam guardrail terminals.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value)
The project scope includes sixteen tangent w-beam guardrail terminals:
• Pay item 61702-1500 TERMINAL SECTION, TYPE MGS TANGENT (4 EA)
The total estimated amount of this product is $20,000.
The proprietary type for the tangent w-beam terminal is shown in the Special Contract Requirements. The product name is SoftStop, manufactured by Trinity Industries https://trinityhighway.com
4. Statutory authority permitting other than full and open competition
The authority to enter into a contract for this effort without full and open competition is FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited
The project is located on Chain of Craters Road in Hawaii Volcanoes National Park on the island of Hawaii. Chain of Craters Road is owned and maintained by the National Park Service.
The current crash testing criteria for roadside safety hardware is provided in the AASHTO Manual for Assessing Safety Hardware (MASH). The project proposes to replace the existing guardrail terminals with a terminal type that meets the current MASH criteria. There are no generic tangent terminals that meet MASH criteria. There are other proprietary tangent terminals that meet MASH, but the SoftStop is the preferred option due to aesthetics. The project is located in a scenic national park where visual https://trinityhighway.com/ impact is a concern. The SoftStop provides a crashworthy terminal with a narrow impact head that minimizes the visual impact.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized
The Justification for Other than Full and Open Competition will be posted with the solicitation as required by FAR 5.102(a)(6).
7. Determination that the anticipated cost to the Government will be fair and reasonable
The FHWA will ensure that all costs associated with the proposed contract are fair and reasonable. The FHWA will perform a thorough analysis of the Offeror’s bid and/or proposal to substantiate this determination.
8. Description of the market research conducted and the results or a statement of the reason market research was not conducted
The SoftStop is commercially available. The SoftStop is one of the terminals currently used by the Hawaii Department of Transportation (a SoftStop was recently installed by HDOT on Highway 11 within the park limits). There is crash testing documentation available to show that the SoftStop has successfully passed MASH crash test level 2 criteria.
9. Other facts supporting the use of other than full and open competition
None.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
None.
11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
None. This is the only guardrail terminal that meets crashworthy criteria while minimizing visual impact.
12. Certification
I certify that the information provided in this justification is complete and accurate to the best of my knowledge and belief.
