Airport Traffic Control Tower Design Initiative

Questions and Responses Set 3 January 18, 2022

NOTE: All proposal submissions must include the SIR with an Authorized Signature (Block 14A of the face page), all amendments with an Authorized Signature, completed Section K, and the Design Concept and Execution Statement Proposal.

Q1. Does selection for any further step in this proposal process preclude the team from pursuing any implementation of these towers in the future?

R1. As a general matter, the FAA follows AMS Guidance Section T.3.8.2.A.18.b.2, which provides that “No construction contract may be awarded to the firm that designed the project, unless the project is being solicited and awarded as a design-build.” Relative to any future construction contracts not solicited and awarded as design-build (which decisions will be made on a case-by-case basis at the FAA’s discretion), such guidance is expected to be followed unless it is found that a rational basis exists for alternative action, i.e. that a deviation from guidance clearly enhances one or more factors of cost, schedule, requirements, or benefits; or that circumstances otherwise clearly show that a deviation from guidance is required. A rational basis determination must also include an analysis of the potential conflicts of interest and any measures being taken to reduce or eliminate them (see AMS Guidance Section T3.1.7:

Unequal access to information/competitive advantage; biased ground rules; impaired objectivity).

For further clarifications, the awardee may participate in future “design” adaptation requirement and design-build requirement but restrictions relative to future participation on construction only portion of implementation projects are set forth above.

Q2. Response to Q12 on Q&A Set 2 suggests submission of Section K. Could you please confirm whether Section K needs to be submitted with Phase 1 proposal.

R2. That is correct, Section K must be completed in its entirety and must be submitted with Offeror’s proposal.

Q3. If so, could you please clarify where shall we sign the Section K as the document does not indicate the location for signature?

R3. Offeror will sign the face page of the solicitation (SIR). In doing so, Offeror is acknowledging no exceptions are being taken in the SIR unless noted otherwise.

Q4. Is a DUNS required at the time of Phase I submission or can that be provided at Phase II?

R4. As Offerors are registering for SAM.gov and requesting DUNS number for the effort, the DUNS number is not required in Phase I. However, Offeror who have received a DUNS number are encourage to provide that information to complete their proposal package.

Q5. How do we complete the Section K that ask for DUNS and SAM information?

R5. Offeror who have not received DUNS number will annotate “SAM.gov registration have been initiate and awaiting DUNS number.”

Q6. Must a firm be registered and have a DUNS number to submit?

R6. Offerors are required to register for SAM.gov to receive a DUNS number. However, the DUNS number is not required to participate in Phase I of this requirement. SAM.gov registration and DUNS number will be required for later phases.

Q7. Shall we leave this section blank until DUNS and SAM registration are received?

R7. Offeror will annotate in this section “SAM.gov registration have been initiate and awaiting DUNS number.”

Q8. Is it acceptable to send a link to a dropbox file for download instead of including the submission document as an attachment to the email?

R8. Offerors may provide links to proposal. However, Offerors are cautioned it is not the Government’s responsibility to ensure the link is working properly or received timely. The Government is not responsible for potential file corruptions in the transmission or downloading of proposals.
