QUESTIONS:
Question: Why are you requiring detailed resumes for the Metrology Technicians, when the RFP has a requirement of right of first refusal? This limits the competition for qualified companies.
RFP 6973GH-20-R-00051 contains the following two requirements:
• 3.6.2-40 NONDISPLACEMENT OF QUALIFIED WORKERS (APR 2009) (a) The contractor and its subcontractors must, except as otherwise provided herein, in good faith offer those employees (other than managerial and supervisory employees) employed under the predecessor contract whose employment will be terminated as a result of award of this contract or the expiration of the contract under which the employees were hired, a right of first refusal of employment under this contract in positions for which employees are qualified.
• SUB-FACTOR 2.2: KEY PERSONNEL REQUIREMENTS
Purpose: The offeror must submit resumes that describe background, experience, education, publications, licenses, certifications, and professional recognition. Resumes must be submitted for both the Technical Manager and Metrology Technicians.
The Offeror must submit resumes for proposed key personnel to include Technical Manager and Metrology Technicians that meet qualification requirements listed in the PWS (section 3.4).
AMS Clause 3.6.2-40 is no longer a valid clause and will be removed from the Request for Proposal with Amendment 0001.
RFP clause 3.8.2-17 Key Personnel and Facilities lists only the Technical Manager as Key personnel.
However, RFP L.5 Technical Proposal – Volume II, FACTOR 2: UNDERSTANDING MANAGEMENT AND KEY PERSONNEL REQUIREMENTS, SUB-FACTOR 2.2: KEY PERSONNEL REQUIREMENTS, pg 64 outlines that resumes must be submitted for key personnel listing Technical Manager and Metrology Technicians.
Does key personnel include Metrology Technicians? Are resumes for all metrology technicians required to be submitted at time of proposal? Yes and yes. Metrology technicians are key personnel and resumes are required at time of proposal. Clause 3.8.2-17 applies to contract after award.
RFP L.5 Technical Proposal – Volume II, FACTOR 2: UNDERSTANDING MANAGEMENT AND KEY PERSONNEL REQUIREMENTS, FACTOR 3: ORGANIZATIONAL EXPERIENCE, pg. 64 outlines that a minimum of 3, but no more than 5, Organizational Experience Forms are to be submitted against prime contracts. This clause further states, “Also, include Organizational Experience Forms on a maximum of three subcontractors who are most relevant in demonstrating their ability to perform the proposed effort”. Must a contractor submit any Organizational Experience Forms for subcontractors, if they do not plan on using any subcontractors to perform the work? No, this is intended to be used if the PRIME plans to use subcontractors as part of their team.
A CBA and Wage Determination 2015-5315, Rev 10 were provided as solicitation documents. Is the Wage Determination or the CBA the basis for salary calculations for each employee? An established CBA takes precedence and governs over Wage Determination. Therefore, the Wage Determination will be removed from the Request for Proposal with Amendment 0003.
