The contractor must provide professional services to assist the FAA in conducting regulatory and policy review that includes analysis, evaluations, plans and information regarding FAA regulatory, environmental, safety, and service and facility development programs.
The contractor must provide support in the following general areas: Aviation Economics, Regulatory Analysis, Airport System Performance, Air Carrier Industry Performance, Accident/Incident Analysis, Financial and Investment Analysis, Risk Analysis, Planning, and Policy Analysis.
This effort requires experience and capabilities in the following areas with an emphasis on aviation economics:
Regulatory aviation regulatory analysis Economic / economic modeling Federal policy Legislative research Model simulation Statistics / econometrics Delay /capacity analysis
C.2 Work Scope
A. Task orders will be issued within the general scope of work set forth in this section. The scope of work is divided into fourteen task areas.
Task Area 1: Analyses of the economic impact of restrictions on access to the National Airspace System including airports. To support this task, the contractor may need to develop economic and policy tools as directed by the COR. Such tools may include models which measure airport and airspace delay.
Task Area 2: Analyses of the economic impacts of delay and congestion on service providers, customers, and the economy. These analyses may include an analysis of how delays (regardless of their cause) at one point in a system may cascade (through a network of airports) and result in delays at other points in the system. Examples of this type of economic analysis include, but are not limited to, the economic disruption of delays and flight cancellations caused at capacity constrained airports. The contractor must also be able to examine the impact of flight delays across the national airspace system at the ARTCC level with the ability to gauge secondary impacts on small communities.
Task Area 3: Analysis and quantification and/or validation of safety risk factors associated with aviation systems. This type of analysis is the foundation of most efforts to quantify the value of safety enhancements within the aviation system.
Task Area 4: Economic analysis, including risk analysis, in support of changes to the Federal Aviation Regulations (FAR).
Task Area 5: Development of tools for legislative planning, policy analysis, performance management, strategic planning, and generalized economic analysis to support FAA’s objectives. Examples include the development of tools/studies to gauge the economic impact of proposed changes to FAA’s existing funding and regulatory structure.
Task Area 6: Analysis of aviation network system performance, and airport/airway capacity. Examples include, but are not limited to, analyses of aircraft performance by location and phase of flight within the National Airspace System.
Task Area 7: Development of aviation forecasts including the demand for FAA services, which are the basis for determining future needs. Examples of forecasting include the development of the U.S.
national fleet forecast for commercial aircraft operations and forecasts of unmanned aircraft systems, and commercial launch activities. Provide methodological assistance in all areas of forecast development and aviation network modeling.
Task Area 8: Studies and policy/economic analyses associated with all aspects of the development and coordination of U.S. Government positions to be taken in aviation policy, including international bilateral and multi-lateral fora. Examples include the impact of mergers and acquisitions on airline domestic and international competition positions.
Task Area 9: Development of alternative methods to estimate benefits and costs in support of FAA policy and regulatory activities. Such methods may include the identification of both national and local impacts resulting from changes to FAA policy and regulations.
Task Area 10: Economic and financial studies of airports to determine such things as financial needs, compliance with FAA rates and charges policies, access to capital markets, competition, and outcomes of public/private partnerships. Examples include, but are not limited to, detailed financial analysis of air carrier and airport financial statements and an examination of FAA’s rates and charges policies.
Task Area 11: Economic studies, including benefit/cost studies, to establish or support a fee structure (limited or comprehensive) to recover FAA costs. Examples include, but not limited to, cost allocation studies of FAA’s Air Traffic Costs, value of time in benefit-cost analysis of FAA investment decisions, assessment of user fees for international overflights, examination of modifications and/or alternatives to FAA funding mechanisms, and value of slots at capacity constrained airports.
Task Area 12: Estimation of economic and aviation parameter values to support benefit/cost studies.
Examples of such parameter values include aircraft capacity and utilization factors, aircraft operating costs, and unit replacement and restoration costs of damaged aircraft.
Task Area 13: Economic, financial, and policy analysis of outsourcing and alternative governance structures.
Task Area 14: Conduct studies/analysis of the impact of U.S. Government policy on aviation and general economy. Examples of such studies include, but are not limited to, economic impact assessments of proposed federal projects.

The Contractor must incur costs only in the performance of TOs issued in accordance with these ordering procedures. No other costs are authorized under this contract without the express written consent of the Contracting Officer.
(iii) From time to time during the period of performance of this contract, the FAA CO will request Task Plans from the Contractor for proposed TOs.
(iv) The Contractor must submit, within fourteen (14) calendar days after receipt of each proposed TO document provided by the CO, a Contractor Task Plan on forms specified and/or provided by the Government. On an individual TO basis, the CO may allow for more or less time to submit the Task Plan. The Task Plan is the Contractor’s overall estimate for the completion of the TO and must include the following:
(1) Contractor’s approach to accomplishing the proposed TO;
(2) Date of commencement of work, and any necessary revisions to the schedule of performance;
(3) Identification of any potential Organization Conflict of Interest (OCI); if no OCIs are identified, a certification that the Contractor is not aware of any potential OCI;

(8) The total estimated cost for completion of the TO, including cost element breakdown of total estimated cost.
(v) The Contractor’s Task Plan is subject to the review of the Government and approval of the Contracting Officer. A TO will be issued by the Contracting Officer once an acceptable Task Plan has been provided to the Government.
(vi) Once a TO is issued, the Contractor is not authorized to incur cost or expend level of effort (man-hours) in excess of those established in the Task Plan without written approval of the Contracting Officer. After a TO is issued, if any revision becomes necessary to the estimated cost or level of effort, the Contractor must promptly submit to the Contracting Officer a revised Task Plan with explanatory notes. Revised Task Plans submitted by the Contractor are subject to the review and approval of the Contracting Officer.
(vii) All TOs will be issued in writing by the Contracting Officer to cover specific work assignments within the scope of the contract. The TOs will be issued on forms specified and provided by the Government. The TOs will be numbered. A revision to a TO will be identified by an alpha designation after the existing TO number, indicating the revision sequence. All TOs must contain the following information:

If the release contains such exceptions, whether to accept it and issue final payment is within the sole discretion of the FAA Contracting Officer

Except as otherwise provided herein, the Contractor must be reimbursed for travel on the basis of actual expenses incurred subject to the FAA Contract Cost Principles and AMS Clause 3.3.2-1, FAA Cost Principles (October 2019), and subject to the following:
All travel whether it is within the continental United States or outside the continental United States, must be accomplished by commercial carrier, rail, privately-owned automobile or auto rental, and the cost paid by the Contractor. The Government will reimburse the Contractor in accordance with the FAA Contract Cost Principles for domestic transportation.
Reimbursable travel includes only that travel (commercial carrier, or private automobile or auto rental) performed from the Contractor’s facilities to the site of work, between worksites, and from the site of work to the Contractor’s facilities.
Travel within a Government installation where Government transportation is available, and travel performed for personal convenience, including daily travel to and from work, will not be reimbursed.
Relocation costs and travel costs incidental to relocation must be approved in advance by the FAA CO in order to be reimbursable under this contract.
The Contractor must use alternate airports where available and within a reasonable commuting distance if it will result in lower costs.
The Contractor must conduct a cost analysis prior to the start of travel to determine the overall most cost effective means of transportation.
G.12.2 Per-Diem
The Contractor will be reimbursed for the expense of meals, lodging, transportation between places of lodging or business and places where meals are taken, and any other miscellaneous travel and living expenses incurred in the performance of this contract at the per diem rate as set forth in the FAA Contract Cost Principles. Per Diem must be payable only when the Contractor’s employee is in an authorized travel status. The per diem rate must be established in accordance with the FAA Contract Cost Principles. Receipts are required for all Per Diem Expenses exceeding $75.00. If the Contractor can demonstrate to the FAA CO that copies of receipts can be made available upon request, the CO may waive the requirement to submit receipts over $75.
G.12.3 Contractor Travel
To the maximum extent practicable, and consistent with travel requirements, the Contractor agrees to use the most economical transportation rates available.

3.1.9-1 Electronic Commerce and Signature (July 2020)
(a) The Electronic Signatures in Global and National Commerce Act (E-SIGN) establishes a legal equivalence between:
(1) Contracts written on paper and contracts in electronic form;
(2) Pen-and-ink signatures and electronic signatures; and
(3) Other legally-required written records and the same information in electronic form.
(b) With the submission of an offer, the offeror acknowledges and accepts the utilization of electronic commerce as part of the requirements of this solicitation and the resultant contract.
(c) Certain documents may need to be provided or maintained in original form, such as large scale drawings impractical to convert to electronic format or a document with a raised seal signifying authenticity. This clause does not change or affect any other requirements that a document must be in paper format to satisfy legal requirements such as for certain real estate transactions.
(d) The use of electronic signature technology is authorized under this solicitation and the resulting contract.
(e) Contractors must not digitally sign any documents with software that uses the Secure Hash Algorithm 1 (SHA-1). All digitally signed documents and contracts sent to the FAA must use a SHA-256 or higher hash algorithm. This is based on the National Institute of Standards and Technology (NIST) Policy Statement on Hash Functions dated August 5, 2015. Further guidance on the use of SHA-256 is in NIST Special Publication (SP) 800-57 Part 1, section 5.6.2 as amended and SP 800-131A, Revision 1 dated November 6, 2015. Additional guidance on the use of SHA-3 is in NIST SP 800-185 as amended.
(f) Contractors do not have to update documents previously digitally signed using SHA-1 hash algorithms unless the document requires updating. The FAA and contractors may continue to use SHA-1 for the following applications: Verifying old digital signatures and time stamps, generating and verifying hash-based message authentication codes (HMACs), key derivation functions (KDFs), and random bit/number generation.
