124 L Page 84 VOLUME III – PAST PERFORMANCE

QUESTION:

Reference L.13 Volume III – Past Performance. The third bullet states: “PPQs from teammates or subcontractors of the Offeror are not acceptable. PPQs from the members of a Joint Venture formed specifically for the purposes of this competition are acceptable. Would the government accept a contractor Teaming Agreement in lieu of a Joint Venture? And accept the past performance of all Teaming Agreement members?

REVISED ANSWER:

Please be advised that L.10.3 states that the Government will not accept contractor teaming arrangements for this procurement. Please also refer to the amended SIRs regarding Past Performance under Section L.13 for more information, in particular the requirements pertaining to past performance references. The third bullet in L.13 reads “References from teammates or subcontractors of the Offeror are acceptable. References from the members of a Joint Venture formed specifically for the purposes of this competition are acceptable; however, offerors must be mindful of limitations set forth in AMS Guidance T3.6.1(A)(9)(a) regarding small business status.” Please note that FAA AMS does not specifically reference a “contractor teaming arrangement,” and any type of teaming agreement must satisfy the language in the SIR and AMS. Further, for clarity, vendors must include three Past Performance References as per L.13. Per M.6.2, at least one of these References must be received in accordance with the SIR. Additionally, L.13 states, “The FAA reserves the right to contact any identified reference identified by each Offeror, and any other reference the FAA may deem appropriate. All information received may be used in the evaluation of an Offeror’s past performance.”
