Offeror Responses to FENS SIR Amendment 9 Submission Instructions

Background:

Amendment 9 contains updates to AMS clauses and a change to the offer validity period in Section L.4. Because of a delay in the award date that was originally anticipated, the FAA is revising the required validity period from “360 calendar days from the original due date for proposals or, in the event of an amendment, the last due date for amended proposals” to a fixed date of March 31, 2023.

General Instructions:

The FAA does not expect that there should be any impacts to offeror proposals based on the updates to AMS clauses in Sections F, H, I, and K. With respect to the change in the offer validity period in SIR Section L.4, the FAA is permitting offerors to submit values for two linear multiplier factors that the FAA will apply to each offeror’s prices. See below under “Instructions Specific to the Price Proposal” for additional details.

While impacts to offeror proposals are not expected (aside from any impacts addressed by the multiplier factors), the FAA is allowing a one-week review and comment period for offerors to assess potential impacts. A response is required from each offeror with an explicit statement as to whether any changes to its proposal may be required. The response is due no later than April 12, 2022 at 5:00pm Eastern Standard Time. Each response must: (1) notify the FENS Contracting Officer as to whether there are any impacts to its proposal that, in the opinion of the offeror, require a change to their proposal; and (2) if so, identify the scope of the impacts (i.e., specific sections) including a description of the nature of any changes sought and the rationale for the changes.

Offerors are advised that no changes to proposals as a result of Amendment 9 to the FENS SIR will be permitted unless the scope of the change is: (1) limited to and directly related to the scope of Amendment 9; and (2) determined by the Government to materially affect the evaluation of proposals or the execution of the FENS contract.

The FAA will assess any proposed changes and make a determination of whether any changes will be permitted and whether those changes would be offeror-specific or applicable to all offerors. If the FAA determines that one or more offerors will be permitted to make changes to specific proposal sections, the affected offerors will be advised of the due date for any changes.

Instructions Specific to the Price Proposal:

In consideration for the extension of the FENS offer validity period in Section L.4, the FAA is allowing offerors to make a one-time change to its proposed pricing in the form of two linear multiplier factors, one for support services and one for all other services required by the contract (e.g., Communications Services, Enterprise-Level Functions, etc.). Additional details pertaining to the multiplier factors are as follows:

1. Offerors are being provided with the opportunity to propose two linear multiplier factors (where a factor of 1 means do nothing to the prices, a number > 1 will increase the prices, and a number < 1 will decrease the prices)

a. Factor 1: Update all the prices in the following tables

i. Support_services1_clins

ii. Support_services2_clins

iii. Labor_rate_table

b. Factor 2: Update all the prices in the remaining tables Each offeror must submit its proposed values for Factor 1 and Factor 2 to the FENS Contracting Officer at 9-ajw-fensinfo@faa.gov no later than April 19, 2022 at 5:00pm Eastern Standard Time.

No other factors or changes to individual prices are permitted.

2. The FAA will apply these two factors to the offeror’s price tables as follows

a. Multiply Factor 1 against every price in every CY in the following three tables

i. Support_services1_clins

ii. Support_services2_clins

iii. Labor_rate_table

b. Multiply Factor 2 against every price in every CY in the remaining tables

3. The FAA will update the affected price in AcquServe and run the Pricer.

4. After the Pricer is run, the FAA will use the resulting prices and reports as the offeror’s Total Evaluated Price (TEP) for evaluation. Each offeror will have visibility into its updated TEP value through AcquServe.

In addition to the values for Factor 1 and Factor 2, each offeror must submit a letter by April 19, 2022 at 5:00pm Eastern Standard Time that is signed by a corporate official who is duly authorized to bind the offeror and commit to a proposal validity period through March 31, 2023.
