About this file

This is a Brand Name Justification document from the Federal Highway Administration (FHWA) for the procurement of an Infratest USA GTR model Asphalt Analyzer under FAR Part 13 Simplified Acquisition Procedures (under $250,000). The procurement is being handled by FHWA's office located at Quantum Park in Ashburn, VA.

The justification establishes that the Infratest GTR Asphalt Analyzer is the only suitable equipment that meets FHWA's specific requirements based on years of market research. The key technical requirements include: ability to test mixtures containing synthetic fibers or ground tire rubber, capability to use dimethylchloride as a solvent, and operation without requiring a chiller when using trichloroethylene (TCE) through heat and vacuum functionality. The document notes that other brands were tested but failed to meet these requirements due to inadequate filtration systems for ground tire rubber/fibers collection, incompatibility with dimethylchloride solvent, and the need for chillers when using TCE without vacuum capability.

Rationale supporting specific brand name acquisition under the simplified acquisition threshold (Authority under FAR 11.105(a)(1) and FAR 13.501(a)(1))

FAR 11.105 “Items peculiar to one manufacturer. Agency requirements shall not be written so as to require a particular brand name, product, or a feature of a product, peculiar to one manufacturer, thereby precluding consideration of a product manufactured by another company, unless -

(a)(1) The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.“

After years of market research the infratest GTR Asphalt Analyzer is the only type of bitumen extractor that will accommodate testing of mixtures containing synthetic fibers or ground tire rubber.

The Infratest infratest GTR Asphalt Analyzer model is the only model that can confidently use dimethylchloride as an solvent.

Infratest model is the only brand that known not to require a chiller when using trichloroethylene (TCE) through use of heat and vacuum.

Other brands either tested or tried did not have filtration systems to accommodate collection of ground tire rubber or fibers. Dimethylchloride was tried in another brand with our facility and the device could not be used with that solvent at our facilty in those conditions. Other brands require chiller for use of TCE and contain no vacuum.
