EASTERN FEDERAL LANDS HIGHWAY DIVISION
BLUE RIDGE PARKWAY
PROJECT NP BLRI PVT PRES FY19
MP 0.0 TO 27.2, 37.5 TO 45.3, and 46.1 TO 64.5
REQUEST FOR PROPOSALS
693C73-20-R-000002
Project Description: The project consists of pavement preservation of approximately 53.4 miles of the Blue Ridge Parkway from Milepost (MP) 0.0 to 27.2, MP 37.5 to MP 45.3, and MP
46.1 to 64.5. The project is in Augusta, Nelson, Rockbridge, Amherst, and Bedford Counties, Virginia.
The project will be split into multiple work schedules/contract options, with the cost of the entire project expected to fall within the price range $1,000,000 and $5,000,000.
Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.
These include the Plans, Special Contract Requirements (J Pages), and supplemental reports.
The project will be advertised with the Contractor selected alternative to perform one of the following pavement preservation methods: thin asphalt overlay or chip seal overlay with a fog seal layer.
Procurement Overview of the Project: In accordance with Federal Acquisition Regulation (FAR) Subpart 15.101-2, the Eastern Federal Lands Highway Division (EFLHD) is conducting a Lowest Price Technically Acceptable Source Selection Process for this project. Under this Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two steps will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B Pages).
During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified Offerors based on the pass/fail (acceptable/unacceptable) evaluation criteria as stated in the RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information.
The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government may proceed with the second step (lowest price evaluation) without requesting further information from any Offeror; however, the Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.
During step two, only technical proposals determined to be acceptable, either initially or as a result of discussions, will be considered for award. The price proposals corresponding to the acceptable technical proposals will be opened and ranked according to price and the contract will be awarded to the lowest responsive, responsible Offeror as stated in the RFP’s Proposal Instructions - Basis of Award (B Pages). Only one price proposal may be submitted by each Offeror and the price proposal must be based upon the Offeror’s own technical proposal.
As stated in FAR Clause 52.236-1, the Contractor shall perform on the site, and with its own organization, work equivalent to at least 50% of the total amount of work to be performed under the contract.
Contract award is anticipated to be no earlier than February 2020, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block 12a of the SF-1412 and FAR Clause 52.228-15). Construction activities are to be completed by December 11, 2020, as specified in Subsection 108.01 of the Special Contract Requirements (J Pages). See Subsection 108.01 for additional construction activity restrictions.
It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal. Offerors should limit their technical proposal to the information required by this Notice, and other information that may be relevant to the qualifications and experience of the Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.
Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.

PROPOSAL INSTRUCTIONS
PROJECT: NP BLRI PVT PRES FY19
OFFERORS PLEASE NOTE: Before preparing the proposal, carefully read the Instructions to Offerors. While preparing the proposal, comply with the following:
The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals from all eligible Contractor firms/teams (Offerors) for technical acceptability. After all of the technical proposals have been evaluated, the Offerors that are found technically acceptable will be ranked according to price and the lowest priced Offeror will be awarded the contract.
Each Offeror must provide the required number of Technical and Price Proposals as described below to the Eastern Federal Land Highway Division (EFLHD) in separate, sealed envelopes/boxes clearly addressed and identified for “Project No: NP-BLRI PVT PRES FY19”.
Submit all proposal documents to the EFLHD at the address and contact specified in Blocks 7 and 9a of the SF-1442.
Submit all proposal documents by the due date specified in Block 13 of the SF-1442.
It is the Offeror’s sole responsibility to see that its proposal documents are received. Proposal documents received after the time due will be rejected and returned without consideration or further evaluation.
EVALUATION OF PROPOSAL DOCUMENTS
STEP 1 - TECHNICAL ACCEPTABILITY - Experience in Performing Pavement Preservation for Asphalt Concrete Pavements
1.A. TECHNICAL ACCEPTABILITY EVALUATION DESCRIPTION
Competing Technical Proposals will be evaluated against the solicitation requirements; they are not compared with each other. Each of the technical evaluation factors described below will be rated on a pass/fail (acceptable/unacceptable) basis, and must receive a passing score for an Offeror's proposal to receive further consideration. Failure to receive a passing score for any single technical evaluation factor will result in rejection of an Offeror's proposal notwithstanding passing scores for the other technical evaluation factors. Proposals which satisfy the technical requirements of the solicitation, in light of the evaluation criteria, will be determined technically acceptable.
Offerors will be evaluated on past performance and experience in applying pavement preservation treatments to roadways. The pavement preservation methods proposed for this project include thin asphalt overlay or chip seal overlay with a fog seal layer.
1.B. TECHNICAL PROPOSAL EVALUATION FACTORS
Submit the following qualifications and information, and label as the Technical Proposal.
Include names, titles, phone numbers, and email address for all references submitted.
(a) Relevant experience. The Offeror must have a minimum of five years of experience on pavement preservation projects that were similar in nature, scope and difficulty to the work required by the contract resulting from this RFP. Provide list of three to five projects completed in the last ten years showing a minimum of five years of experience performing roadway pavement preservation projects in similar terrain and locations.
Offerors are to include the experience of the either the prime contractor and/or relevant subcontractor(s) that will perform the work on this project. Offerors should only include experience with the pavement preservation method that team is planning to construct on this project (for example, if the team is planning to use the chip seal with the fog seal method, only past experience with this type of treatment should be included). This evaluation will be based on the Offeror's record and reputation for satisfactorily completing the pavement preservation method they’ve proposed on this project.
In addition, provide a resume of the superintendent that is proposed for this project. The superintendent is to have a minimum of five years of experience on pavement preservation projects including the type of treatment that is proposed on this project. List the pavement preservation projects, including the method that is proposed on this project, in the resume.
Prepare the information for these pavement preservation projects in Times New Roman 12 point font, on two to three 8-1/2” x 11” sheets, and incorporate the information listed below in bullet points. Keep the discussion for any one project within one 8-1/2” x 11” page.
• Project Name;
• Project Location;
• Project Owner and Contact Information including phone number and email address;
• Year (Award of Contract and Completion Date);
• Name of Contractor Project Manager or Resident Engineer;
• Name of Contractor Superintendent;
• Cost Performance - Initial Bid (Contract Award Amount), Final Construction Cost, Reasons for Change; and
• Discussion of project scope.
(b) Past Performance - Provide documentation of three to five projects completed in the past ten years that were similar in nature, scope and difficulty to the work described in the RFP. The documentation must include performance evaluations from at least one pavement preservation project mentioned under (a) above, and include information listed in the bullet points under (a) above. In order to be acceptable, Offerors must have been rated as satisfactory or higher. Acceptable past performance also means the Offeror has a reputation of integrity, reasonable and cooperative conduct, and commitment to customer satisfaction. In reviewing and evaluating an Offeror's past performance, the Government will consider information obtained from the Offeror, and may consider information obtained from other sources. This includes past and present customers and their current and former employees, past and present subcontractors and their current and former employees, current and former employees of the Federal, state and local government agencies (including court records), and private consumer protection organizations.
(c) Offeror's project approach and method of managing the construction schedule. Provide a bar chart schedule or other methods to describe when the work tasks required under this project will occur. List what approach will be used to bring the project back on schedule if the project falls behind schedule. In order to be acceptable, the Offeror’s project schedule must be a practicable schedule showing the order in which the Contractor proposes to perform the work, the dates on which the Contractor contemplates starting and completing the several salient features of the work, and meet the timelines provided in the Special Contract Requirements (SCRs).
1.C. TECHNICAL PROPOSAL SUMMITTAL
Submit four (4) bound paper copies and one (1) unbound paper copy of the Technical Proposal.
In addition, submit one (1) electronic copy of the Technical Proposal on CD ROM. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope or box and clearly labeled as the “Technical Proposal”.
STEP 2 - LOWEST PRICE - Cost to Perform the Proposed Work
2.A. LOWEST PRICE EVALUATION DESCRIPTION
Only Cost Proposals from Offerors that passed the technical acceptability phase will be evaluated. Cost Proposals from Offerors that did not pass the technical acceptability phase will be returned unopened. All acceptable Cost Proposals will be reviewed and evaluated for completeness and reasonableness.
2.B. COMPLETING THE BID SCHEDULE
Complete the Bid Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places, for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit Bid Price and Amount Bid for the pay item. Determine the Bid Total for each specific individual Schedule of Work by adding the amounts of the listed items, and show in the block provided for that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.
To be eligible for award, Offerors must submit prices for each pay item.
Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.
Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Price Proposal Summary page (B-9). Fill in the Evaluation Total Price of Project in the space provided on the Price Proposal Summary page (B-9).
In addition, fill in the Section 420 Pavement Preservation Treatment Type in the space provided on the Price Proposal Summary page (B-9).
The completed Bid Schedule, pages B-1 through B-8, is considered the Offeror's Price Proposal.
2.C. SCHEDULES OF WORK
The Bid Schedule is comprised of the following separate schedules and options of work:
Schedule A (Base Contract) - Page B-2 Schedule B (Government Option 1) - Page B-4 Schedule C (Government Option 2) - Page B-6 Schedule D (Government Option 3) - Page B-8
The Government will award the project as a Base Contract (Schedule A) with the option to award Schedules B, C, and D (Government Options 1, 2, and 3); see FAR Clauses 52.217-4 and 52.217-5.
The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price, by proper utilization of programmed funds and upon receipt of any additional funds required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract), the Government may award Schedules B, C, and D (Government Options 1, 2, and 3) at that time. If additional funding is required for the award of Schedules B, C, and D (Government Options 1, 2, and 3), and is received after award of Schedule A (Base Contract), the Government has the right to exercise Schedules B, C, and D (Government Options 1, 2, and 3) at the unit prices bid according to the following schedule:
Schedule B (Government Option 1): No later than the contract completion date for Schedule A (Base Contract).
Schedule C (Government Option 2): No later than the contract completion date for Schedule B (Government Option 1).
Schedule D (Government Option 3): No later than the contract completion date for Schedule B (Government Option 1).
2.D. COMPLETION OF WORK
The Government has estimated the number of calendar days necessary to complete all contract work from the effective date of the Notice to Proceed to contract completion for the various contract award scenarios. The maximum number of calendar days allowed (i.e., the contact performance period) is shown in Block 11 of the SF-1442 and described below.
If the Government awards the contract as Schedules A + B + C + D, the performance period to complete all contract work will be as stated in Subsection 108.01 of the Special Contract Requirements (J Pages), which specifies all work must be completed by no later than December 11, 2020.
If the Government awards the contract as Schedule A only, the performance period to complete all Schedule A work will be 65 calendar days and will start on the effective date of Schedule A’s Notice to Proceed.
If Schedule B (Government Option 1) is exercised after the award of the original contract, the performance period to complete all Schedule B work will be 40 calendar days and will start on the effective date of Schedule B’s Notice to Proceed.
If Schedule C (Government Option 2) is exercised after the award of the original contract, the performance period to complete all Schedule C work will be 35 calendar days and will start on the effective date of Schedule C’s Notice to Proceed.
If Schedule D (Government Option 3) is exercised after the award of the original contract, the performance period to complete all Schedule D work will be 40 calendar days and will start on the effective date of Schedule D’s Notice to Proceed.
In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCR’s). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc.); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc.); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc.). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection 104.03 of the FP and SCR’s).
Offerors are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-
15) may result in the start of construction activities to be no earlier than April 2020. See Subsection 108.01 of the SCR’s for additional details.
2.E. PRICE PROPOSAL SUBMITTAL
Submit two (2) unbound paper copies of the Price Proposal. As stated above, the completed Bid Schedule, pages B-1 through B-9, is considered the Offeror’s Price Proposal. Submit the Price Proposal copies separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal”.
BASIS FOR AWARD
The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals for technical acceptability.
After all of the technical proposals have been evaluated, the Offerors that were found technically acceptable will be ranked according to price and the contract will be awarded to the responsive, responsible Offeror with the lowest Evaluation Total Price of Project, which is defined as:
Schedule A (Base Contract) Bid Total + Schedule B (Government Option 1) Bid Total + Schedule C (Government Option 2) Bid Total + Schedule D (Government Option 3) Bid Total +
