BACKGROUND:

The T/S STATE OF MAINE is a U.S. Government owned training ship provided to Maine Maritime Academy for training young men and women for a career in the U.S. Maritime Industry. The ship is part of the USDOT-Maritime Administration’s National Defense Reserve Fleet (NDRF). The ship maintains a U.S. Coast Guard Certificate of Inspection (COI) and American Bureau of Shipping (ABS) Classification with the following designations and notations:

USCG Service / ABS Description: Public Nautical School Ship.

SOLAS Category: Cargo Ship.

MARPOL Category: Not an Oil Tanker.

ABS Class Notations:

The ship is enrolled in a Continuous Hull and Continuous Machinery Survey with ABS.

As a Public Nautical School Ship and Cargo Ship (non-tanker), the regulations of 46 CFR 167, in addition to ABS Rules and SOLAS Regulations for a Cargo Ship (non-tanker), govern all work performed aboard.

The Contractor shall ensure that all work performed in the execution of this Statement of Work (SOW) be in conformance with the requirements of 46 CFR 167 and all applicable ABS Rules and SOLAS Regulations and shall not knowingly perform any action which may compromise the ship’s Certificate of Inspection (COI) and/or ABS Classification. If the Contractor is aware of anything, either within this SOW or missing from this SOW, that might compromise that compliance, they shall make it known immediately, and in writing, to the Contracting Officer’s Representative (COR). If there are apparent differences between the requirements of the CFRs, ABS Rules and SOLAS Regulations as they relate to the work being performed, the more stringent requirement shall apply.

INTENT:

It is the Intent of this Statement of Work (SOW) to perform the various work “ITEMS” below (Items 1 thru 28) in addition to any emergent work the government deems necessary in order for the ship to be able to perform its mission safely and efficiently.

Emergent work shall be addressed in accordance with the requirements of Item 29 (Supplemental Labor and Materials/Subs). It shall be understood that emergent work may or may not be directly related to the work defined in Items 1 thru 28.

Due to the current government shut down and resulting challenges with funding, a number of the below work ITEMS are listed as “OPTIONAL”. These OPTIONAL ITEMS shall only be exercised if sufficient government funding can be obtained. It is requested that Contractor pricing for these OPTIONAL ITEMS be considered valid for a period of 90 days following submission of pricing.

LOCATION:

The TS State of Maine is moored alongside her pier at the Maine Maritime Academy, Castine, Maine 04421.

PERIOD OF PERFORMANCE:

The overall period of performance for this SOW shall be from the date of contract award (anticipated in early 2019) through March 1, 2020, however, individual work ITEMs within this SOW may require earlier completion dates (as stated in the Period of Performance within each ITEM). The 2019 Summer Training Cruise will begin the first week in May 2019 and end approximately mid July 2019. The Contractor shall not be permitted to perform work on the ship during the period between those dates (first week of May 2019 thru mid-July 2019).

GENERAL REQUIREMENTS:

The following general requirements apply to ALL work performed in the execution of this SOW including all work performed in accordance with ITEM 29 - “Supplemental Labor and Material/Subs”. Additional requirements are stated within each ITEM.

1. General: The Contractor shall provide all labor, materials and services (except where noted as being “Government Furnished”) to accomplish the ITEMS in this SOW in accordance with all applicable ABS Rules, USCG Regulations and original equipment manufacturers’ (OEM) instructions. This includes all removals and re-installations of interferences and the proper disposal of all wastes generated from the execution of this SOW. Any equipment or materials damaged during removals and/or re-installations shall be replaced at the Contractor’s expense.

2. Supervision: The Contractor shall employ a Manager/Supervisor to oversee all work aboard the ship and ashore. This Manager/Supervisor shall be available by phone 24/7. In addition, this Manager/Supervisor shall be available to meet with the COR aboard the ship within two hours after a request is made by the COR. This requirement shall help to ensure that an efficient and timely response is made by the Contractor concerning any emergent requirements or problems. This Manager/Supervisor shall have full authority to negotiate pricing with the COR and to sign Delivery Orders on behalf of the Contractor. This requirement ensures that the MARAD Contracting Officer (CO) or Contracting Officer’s Representative (COR) will be negotiating with someone intimately familiar with the work.

3. Government Furnished: Any materials, equipment, labor and/or services provided by the Government shall be listed in the Government Furnished section of an ITEM. The Contractor shall be responsible for providing all other materials, equipment, labor or services necessary to accomplish each ITEM.

4. Use of Government Materials and/or Equipment: Unless specifically stated in this SOW, the Contractor shall not use any of the ship’s spare parts, equipment, material, etc., unless authorized in writing by the COR. Any spare parts, material, etc., authorized to be provided to the Contractor shall be replaced at the Contractor’s expense.

5. Welders Certifications & Approved Welding Procedures: All welding shall be performed by welders possessing ABS certification for the welds they perform. All piping materials provided by the Contractor shall be equal to or better than the original material and of similar form, fit and function. Pipe hangers and supports shall be installed on all new and/or modified piping, as necessary, in accordance with ASTM F708-92(2014)-Standard Practice for Design and Installation of Rigid Pipe Hangers.

8. Penetrations: All hull, deck, bulkhead, beam or structural penetrations made by the Contractor shall be in accordance with the requirements of the National Shipbuilding Research Program, “Industry Standards for Hull Structural Penetration Design Criteria and Details”. It is available free of charge at: http://www.dtic.mil/dtic/tr/fulltext/u2/a445982.pdf. All deck and bulkhead penetrations made by the Contractor shall be in a manner which retains the structural fire protection rating of the deck or bulkhead as identified by the ship’s structural fire protection drawing. If the Contractor must run wiring as part of this SOW and desires to use an existing penetration, (such as a multiple cable transit), they must first determine that the existing penetration meets the required structural fire protection requirements. If it does not, they shall either create a new and separate penetration (which does meet code) or modify the entire existing penetration so that it meets code. If piping and/or electrical penetrations need to be re-routed from the routes indicated in the drawings to comply with these guidelines, it shall be accomplished via a change order and at the Contractor’s expense.

9. Hydrostatic Tests: Upon completion of any piping modifications and/or installations, and in the presence of the USCG, ABS and the COR, the Contractor shall perform a hydrostatic test of that installation in accordance with the requirements of 46CFR 56.97-30 (which is a test pressure equal to 1.5 x MAWP for a period of at least 10 minutes, not to exceed 90% of the yield strength of the material).

10. Operational Tests: The Contractor’s work shall also be tested via operational tests performed by the ship’s crew. The Contractor shall be required to correct any deficiencies in their work or the materials they supplied.

11. Electric Motor Overhauls: All electric motor overhauls shall be performed in accordance with ANSI/EASA Standard AR100-2010. All electric motor bearings shall be replaced with sealed bearings, the grease fittings removed and a plug put in its place.

In addition, the Contractor shall provide the personnel required to safely direct the crane operator and to guide the hoisted tools/equipment/materials.

31. Parking: Parking of vehicles throughout the work day is typically permitted at the Castine town parking lot but only upon approval from the Town Selectman. The contractor shall be responsible for obtaining that approval to include providing the Town Selectman a list of all Contractor and subcontractor vehicle models, license plate numbers, and driver’s license numbers prior to the start of the contract. The town parking lot is approximately 1,000 feet from the ship. Overnight parking at the town lot is not permitted. If a Contractor desires to leave a work trailer on the pier or Academy grounds, it shall be in a location agreed to by the ship’s Chief Mate (who will also coordinate with the Maine Maritime Academy Police Department). Work trailers and other vehicles must never obstruct emergency (fire and ambulance) vehicle access to the ship.

32. Toilets: The Contractor shall provide portable toilet facilities for their employees and subcontractors. The Chief Mate shall designate a space on the dock for them to be placed. The Contractor shall maintain them clean and shall empty them as required.

33. Availability of Drawings and Technical Manuals: The Chief Engineer shall assist, in as much as possible, by providing access to any requested drawings or manuals. These drawings and manuals shall not leave the ship but may be copied on board with the written approval of the Chief Engineer. Most of the ship’s drawings have been electronically copied to a pdf format. CD copies of available drawings shall be provided to the Contractor upon request.

34. Hazmat Handling and Documentation: The Contractor must recognize that ships may contain hazardous materials which require special handling. These materials may include, but are not limited to; asbestos (used in heat and electrical insulation, brake linings, deck coverings, boiler refractory, joiner work and other areas), mercury, oils, bilge water and slops containing fuel, grease and lubricating oils, lead, lead-based anti-foulants, etc. This SOW attempts to make the Contractor aware of any known HAZMAT materials and substances that may be encountered in the execution of this SOW, however, the responsibility for identifying, handling and disposing of these materials shall be the Contractors. Removal and disposal of all hazardous material or waste shall be in accordance with all applicable Federal, State, and local rules and regulations. The Contractor shall submit documented evidence of that compliance, if applicable, within five working days after the end of the contract. These documents shall include the types and quantities of hazardous waste generated, the procedures followed for custody and disposal, and copies of receipts for same. Additional charges required for handling and disposing of hazardous materials after contract award shall not be permitted unless it is related to work authorized under the “Supplemental Labor and Material/Subs” ITEM of this SOW.

35. Credit for Scrap: Unless stated otherwise in this SOW, all scrap material generated as a result of this SOW shall be removed from the ship, become the property of the Contractor, and be disposed of in accordance with all Federal, State and local requirements. A credit to the Maritime Administration for the value of any scrap material removed shall be included in the Contractor’s pricing for each ITEM in this SOW which generates any scrap material and/or salvaged equipment.

36. Trash Removal and Clean-up: The Contractor shall remove ALL trash generated each day and sweep down each area worked on at the end of each day. Upon completion of all work in an ITEM, all affected areas shall be thoroughly cleaned to a condition equal to or better than originally found. The ship is used by the faculty and cadets of the Maine Maritime Academy and is open to the public and prospective students for tours. For this reason, it is important that all public areas remain clean and orderly. If the Contractor soils or dirties any public areas or areas of the ship outside of the areas being worked on, they shall clean them immediately.

37. The ship shall provide the Contractor with one UHF radio and charger for contacting the COR (or his designated representative). The radio and charger shall be signed for by the Contractor and returned at the end of the contract period.

38. Equipment Information: The Contractor shall provide the COR with an electronic copy (in pdf format) of all drawings, operating manuals, repair manuals, parts manuals, cut sheets etc., for any equipment that the Contractor provides to the ship as part of this SOW. In addition, any drawings required as a deliverable in this SOW shall also be provided in AutoCad format.

39. Accuracy of Information: Dimensions and measurements in this SOW (or referenced in this SOW) are provided in good faith, however, their accuracy is not guaranteed. The Contractor is responsible for verifying the accuracy of dimensions, measurements, sizes, etc., provided in any sketches, drawings, plans and specifications, within this SOW prior to quoting, fabricating, ordering, etc., anything required in this SOW. All drawings provided or referenced in this SOW, whether they are considered “as builts” or not, are not guaranteed to be accurate. Furthermore, these drawings should not be scaled to determine the actual location of existing piping/wiring runs, etc. in hidden areas such as bulkheads and/or joinery. The Contractor shall be aware that numerous drawings and manuals represent the ship’s configuration prior to the conversion in 1997 and as such, may no longer accurately represent the ship’s current configuration. For this reason, it is important to determine whether a drawing or manual being reviewed represents the pre or post conversion configuration. In some instances, it may be necessary to combine information from both pre and post conversion drawings to determine the current configuration of a system or compartment. Material Lists provided in a drawing are only a guide and may not accurately reflect the full extent of materials required. The Contractor shall be responsible for determining the actual quantities/types of materials required to satisfy the “INTENT” of each ITEM.

40. Daily Meeting: Prior to the start of each work day and for informing the ship’s crew of the Contractor’s activities (location of hot work, etc.), the Contractor’s Manager/Supervisor shall meet with the COR (if aboard) and the Ship’s Officers to discuss the work plan for that day. This meeting should not take longer than 10 minutes.

41. Subcontractor Info: Contact information is provided within each ITEM, when appropriate, to enable the Contractor to readily identify reliable sources of OEM Technicians, ABS Recognized Specialists and/or other Subcontractors who have consistently demonstrated their ability to perform the work or parts required. The absence of a company name does not preclude their use by the Contractor providing they can demonstrate, to the COR, their ability to perform the work or provide the part as an Authorized Representative of the OEM, ABS Recognized Specialist or reliable Subcontractor, as required.

42. Progress Meetings: Progress Meetings shall be scheduled as necessary depending on the availability of the Contractor, COR, Chief Engineer and Chief Mate. Prior to invoicing for an ITEM, the Contractor shall provide the COR with a document containing the signature of the Chief Engineer or Chief Mate, as appropriate, acknowledging receipt of delivered materials and/or acceptance of equipment operational tests and/or demonstrations as required by this SOW.

43. Invoicing: The COR will maintain a spreadsheet which documents the cost and per cent completion of each Work ITEM and Supplemental Delivery Order. The Contractor and COR shall agree to these numbers prior to invoicing.

44. Safety Management System: The Training Ship and Maine Maritime Academy employ a Safety Management System as documented in their Safety Management Manual. The Contractor shall familiarize themselves with that manual and abide by all references made relative to Contractor(s) procedures/requirements in that manual. The references to Contractor(s) are: 2.2-Drug and Alcohol Policy, 2.3-Tobacco Policy, 3.3-Risk Assessment, 7.14-Environmental Protection, 7.22-Hot Work, 7.25-Working Aloft, 7.27-Commercial Diving Operations, 8.3 Vessel Security.
