1.0 Combined Synopsis/Solicitation

This is a combined synopsis/solicitation for commercial services prepared in accordance with the Format in Subpart 12.6, as supplemented with additional information in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

The solicitation is issued as a Request for Quote (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2023-03 dated April 26, 2023. This requirement is being solicited as Small Business Set-Aside using FAR Part 12 Acquisition of Commercial Items and FAR Part 13.5 Simplified Acquisitions for Certain Commercial Items. The NAICS Code is 561720 -Janitorial Services with a small business size standard of $22.0 million. The solicitation number is 6923G524Q0574.

**NOTE: Offerors must be registered in SAM.gov and have an active registration at the time of this solicitation closing.

SCHEDULE OF SUPPLIES/SERVICES: See Attachment B –Pricing Sheet.

DESCRIPTION OF WORK: The Contractor shall provide janitorial services at the Great Lakes St. Lawrence Seaway Development Corporation Visitor Center located in Massena, NY. All in accordance with this solicitation and the attached Performance Work Statement (Attachment A).

CONTRACT TYPE: This solicitation is a Request for Quote (RFQ) that will result in the award of a labor hours contract under FAR Part 12 and FAR Subpart 13.5, subject to the availability of funds.

CONTRACT PERIOD OF PERFORMANCE: The performance period for this requirement includes a (1) one-year base period that starts on or about April 1, 2024, and two (2) one-year option periods.

PLACE OF PERFORMANCE: The place of performance shall be located at the Seaway Visitor Center at Eisenhower Lock, Massena, NY.

QUESTIONS DUE DATE: Quotations must be sent via e-mail to Purchasing@dot.gov, arriving no later than February 27, 2024, 2:00 PM EST. After this due date further requests may not be accepted due to time constraints. For questions regarding this solicitation, email purchasing@dot.gov.

QUOTE DUE DATE: March 5, 2024, 2:00PM EST Quotes must be sent via e-mail to Purchasing@dot.gov, no later than March 5, 2024, 2:00 PM EST.

2.0 General Instructions

This requirement is being solicited as Small Business Set-Aside using FAR Part 12, Acquisition of Commercial Items and FAR Part 13.5, Simplified Acquisition for Certain Commercial Items. The Government intends to issue a Labors Hour Contract. Offers shall be submitted in electronic format to:

Contracting Officer: Chora Snyder chora.snyder@dot.gov Proposals Due Date: 2:00 pm Eastern Standard Time (EST) on March 15, 2024.

Proposals are valid for 120 calendar days unless otherwise stipulated by the Offeror.

Questions must be submitted via email to purchasing@dot.gov, no later than 2:00pm EST on February 27, 2024.

Hard copies will not be accepted.

In response to this RFQ, the Offeror shall prepare a detailed proposal for meeting all stated requirements and comply with the following limitations and characteristics:

• Do not include marketing materials

• Margins (Top, Bottom, Right and Left) no smaller than 1" (headers and footers are allowed in the margins)

• Submission shall be provided in electronic format

• Arial size 11 font or Times New Roman 12 font shall be used

• Offers shall be submitted in a format readable by Microsoft (MS) Word 2007, MS Excel 2007, or in text searchable PDF format, as applicable.

• Proposals shall be subdivided into sections as follows: Section 1 Technical Proposal, and Section 2 Price Proposal. Page limits apply to each section as describe in paragraph 3.0.

3.0 Proposal Organization

Proposal materials shall be organized as follows: Section 1 Technical Proposal and Section 2 Price Proposal. All Sections are to be clearly separated from the other (i.e, page break, blank page divider, separate electronic files, etc). Each Offeror shall provide all price information only in the Price Proposal.

The Technical Proposal shall not contain any price information.

To be acceptable, the proposal must meet all the requirements set forth in the Performance Work Statement (PWS).

3.1 Section 1 Technical Proposal

The technical proposal is limited to 15 pages that includes all pages include cover, table of contents, indexes, etc. unless otherwise specified in this solicitation.

This volume addresses the technical aspects of the requirement. It shall indicate the Offeror’s capabilities and approach used to satisfy the requirements stated in the attached Performance Work Statement. Reference the PWS for specifics of the Government’s requirements for this service. At a minimum, the offeror shall address the following technical elements:

(1) Offeror shall provide an overall technical approach that demonstrates its knowledge and understanding of all aspects of PWS.

(2) The Offeror shall provide a Project Plan that demonstrates, in detail, approach to completing the services stated in the attached Performance Work Statement, PWS, to include detailed description of approach, organization and resource management. The Project Plan shall include clear milestones, realistic timelines and schedules; and identification of risks and issues. The Project Plan shall be included with the offeror’s response to this solicitation.

(3) The Offeror shall provide a Quality Control Plan (QCP) that includes the offeror’s development and implementation procedures to identify, prevent and ensure non-recurrence of defective services. The Quality Control Plan shall be included with the offeror’s response to this solicitation.

3.2 Section 2 Past Performance

Offerors shall submit at least three (3) but no more than four (4) past performance references of contracts (for the prime and any subcontractors) accomplished within the last three years that are of a similar scope and complexity. The references shall include the following information:

• Award Amount

• Brief description of the work and relevance to this solicitation

• Contract Type (i.e., Firm Fixed Price, Time and Materials, etc.)

• Final contract amount to include a statement as to whether there was a contract under / overrun, as applicable

• Customer Technical Point of Contact (name, email address, and phone number)

• Customer Contractual Point of Contact (name, email address, and phone number)

3.3 Section 3 Price Proposal

The Offeror shall provide the fully burdened fixed hourly prices in accordance with the LCAT Pricing Sheet. Submit the Price Sheet in Excel format. Provision FAR 52.216-31 Time and Materials/Labor Hour Proposal Requirements -Commercial Item Acquisition (Feb 2007) applies.

4.0 Evaluation Factors

EVALUATION CRITERIA

The Government will evaluate offerors based on Lowest Price Technically Acceptable (LPTA) for this solicitation. The offeror shall submit sufficient information, description, quantities, and technical specifications in its quote for the Government to make a comprehensive evaluation of its capability in providing the requirements listed in the solicitation. Quotes submitted must meet characteristics presented in the RFQ and PWS to be deemed technically acceptable. An “unacceptable” rating on any section (technical, past performance, or pricing) will make the overall proposal rating “unacceptable” which causes the quote to be ineligible for award.

Technical Factor The Government evaluate the Offeror’s proposal as follows:

(1) The Government will evaluate the offeror’s overall technical approach for demonstration of knowledge and understanding of all aspects of PWS.

(2) The Project Plan will be evaluated for thoroughness, efficiency and effectiveness. The Project Plan will be finalized and incorporated into the contract award.

(3) Quality Control Plan will be evaluated for efficiency and reasonableness. The approved Quality

Control Plan will be incorporated into the contract award.

This factor will be rated as either “acceptable” or “unacceptable.”

Rating Description

Acceptable Quote clearly meets all the requirements listed in the solicitation in accordance with the PWS.

Unacceptable Quote does not clearly meet all the requirements listed in the solicitation in accordance with the PWS.

Past Performance Factor The Government will evaluate the relevant merits of the offeror's past performance based on its record with its current and former customers. The government will evaluate for relevancy -performance that has taken place within the past three years. The government will evaluate for similarity and size in provided past performance to the scope and size of the PWS.

Past performance ratings for contracts that were completed more than three years before the date of the issuance of this solicitation are not considered relevant and will not be evaluated.

Offerors are advised that in conducting the past performance assessment, the Government may also use past performance information obtained from sources other than those identified by the offeror (i.e., CPARS).

Past performance will be evaluated as defined below:

RATING DESCRIPTION

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort

Neutral Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance but will be assigned a Neutral rating.

Price Factor The price evaluation will determine whether the proposed prices are complete and reasonable in relation to the solicitation requirements and market rates. Proposed prices must be entirely compatible with the technical proposal and consistent with the pricing requirements listed in this solicitation.

5.0 Contract Type

The Contractor shall provide the requirements described in the Performance Work Statement (PWS).

This is a labor hours contract.

6.0 Payment- Labor Hours

Labor Hours payments will be made on a monthly basis after acceptance of work and receipt of a proper invoice. The Contractor shall provide sufficient detail, including fully burdened labor rates and hours worked, and receipts for material to support the invoice.

The Contractor shall not accrue costs in excess of the amount funded under this Time and Material/Labor Hours contract. Any work performed in excess of the amount funded is at the Contractor’s own risk.

7.0 Submittal of Invoices

Submit invoices and required supporting documents, electronically via e-mail to the following e-mail address: sls.finance@dot.gov

Email a copy of the invoice to the Contracting Officer’s Representative (COR).

Invoices shall be prepared as follows:

(a) A separate invoice shall be submitted for each billing period under this contract.

(b) Invoices shall be submitted within 10 days after delivery or performance of work, but not more frequently than monthly.

(c) Include the invoice and supporting documents as an attached PDF document.

(d) Include in the e-mail subject line the following:

(i) Invoice #

(ii) GSA Contract Number and Task Order Number

(iii) Name of your Company/Organization

(iv) Attention: Contracting Officer’s Representative (COR)

(v) Example: Invoice No. 1 of Task Order No. 6923G524FXXX ABC Corporation, Attention: Jimmy Dear

(e) Documentation shall include:

(i) Name and address of the Contractor.

(ii) Invoice number and invoice date

(iii) Task Order number and title.

(iv) Period of work billed.

(v) Amount billed by CLIN under the contract

(vi) Hours expended per individual under the Task Order (for Time and Material/Labor

Hour Task Orders)

(vii) Total amount of billing and cumulative total billed for all work under the contract to date.

(viii) Name and address of the individual to whom payment should be sent.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (2) While not required, the Contractor may include in its subcontracts for commercial products and commercial services a minimal number of additional clauses necessary to satisfy its contractual obligations.

52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 7 days.

52.217-9 Option to Extend the Term of the Contract (Nov 1999)

(a) The Government may extend the term of this contract by written notice to the Contractor within 7 days; provided that the Government gives the Contractor a preliminary notice of its intent to extend at least 7 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 30 months.
