Performance Work Statement (PWS) Research on Smart Toys and Additional Toys

1. Description of Services: The Contractor shall design and conduct consumer panels, child observation studies, and conduct literature and online search to identify developmentally appropriate ages for toys, common recognition of toys by caregivers, and determine potential hazards associated with smart toys1 during play.

2. Background: Technology has been transforming toys in many ways since the CPSC Age Determination Guidelines were last released in 2002. Changes include increased interactivity with the user, declining cost of electronic components, more detailed die-cast molds and 3D prototypes, and increased presence of mobile devices/apps that enable augmented reality and hybrid play with toys and books. STEM features abound, as do toys with a surprise element stemming from consumer social media “blind bag” videos.

• The Contractor will examine the wide range of toys on the market with robotic, STEM, and social media elements to identify physical safety hazards.

• The Contractor will evaluate smart toys as well as products that are not currently covered in the Guidelines via consumer feedback panels, social media research, and child observations.

3. Contract Type: This is an Indefinite-Delivery, Indefinite-Quantity (“IDIQ”) that shall include a one-year base period and four option years. The minimum guaranteed amount is one task order for the base year only.

a) Issuance of Task Orders: Task orders will be issued against this IDIQ contract. The

Government will send a written request for quotation for a proposed task. The Contractor shall submit a written proposal describing the technical approach to complete the work, a firm fixed price and price breakdown, substantiating hours and any other supporting information required by the request for quotation. Upon completion of negotiations for a task, the Government will issue a firm fixed priced task order. The Contractor is not authorized to commence work on a task until after a task order has been awarded. The issuance of all task orders will be contingent upon the agency decision to fund the service.

4. Period of Performance: The contract performance period shall begin on the effective date of this contract and continue for one year, with four optional periods of performance of one year each. Individual task order performance dates shall be governed by the individual task order.

1 Smart toys in this context include toys that contain embedded electronic features such as robotic toys and wearables as well as toys that can connect to internet-based platforms or other devices.

5. Description of Work: Independently, and not as an agent of the Government, the Contractor shall furnish all necessary personnel, materials, services, facilities, and resources to perform the work set forth below:

a) The Contractor shall provide a draft list of specific toys that will be studied for the toy categories and overall quantity specified in the task order. The Contractor shall adjust the list based on feedback from CPSC staff, which will be provided within 2 weeks of delivery.

b) The Contractor shall conduct a search including online videos, consumer reviews, and blogs to gather information on marketing, advertising, and promotion as well as common recognition for these toys. Social media listening tools can be utilized after approval by CPSC staff.

c) The Contractor shall apply for and obtain the Institutional Review Board (IRB) approval for the study if necessary.

d) The Contractor shall prepare all necessary paperwork, including the script, for Office of Management and Budget (OMB) Paperwork Reduction Act (PRA) approval when required. The Contractor shall adjust the materials based on CPSC's two-stage (AED and 6b6) clearance process, any comments received through the PRA requirement fulfillments, and OMB approval process.

e) The Contractor shall conduct consumer panels to obtain feedback from adults regarding the toys to gauge their interest and purchasing decisions (e.g., whom do they buy these items for, adults or children; what factors influence their decisions such as number of pieces; if for a child, what age child do they buy it for?)

f) The Contractor shall conduct observational studies of children playing with the toys, including observations of children opening packages that are intended for the child during play, and collect data on their interaction with the toys including duration of interactions and actions performed.

g) The Contractor shall secure an appropriate facility, conduct the study, and collect the data, obtain consent for video recordings to be shared with staff where applicable, and record video and/or audio and collect written materials.

h) The Contractor shall prepare a written technical report containing detailed results, findings, and conclusions. The technical report shall be in the format of a technical report including sections for background, participants, methods, results, and discussion. The report shall include analysis and interpretation of all results including descriptive bar graphs of use by age for toy play; descriptive bar graphs of use by age to open packaging;

ages parents are likely to purchase for; a final age recommendation for each toy;

marketing research showing target age for product in question and similar competitor products; summary of consumer reviews showing what age product is commonly recognized for; analysis of any discrepancies with final age recommendation for product.

A draft report shall be submitted at least 4 weeks prior to the end of the period of performance, to allow for 2 weeks for government review, and two weeks for preparation of a final report incorporating government feedback.

6. Reporting Requirements/Deliverables: The Contractor shall submit all deliverables and reports to the Contracting Officer’s Representative (“COR”).
