1.2.2.2. Affirmative Action in Subcontracting
1.2.2.2.1. Generally, either a Bidder will use subcontractors or it will do all the work itself.
1.2.2.2.2. If Not Using Subcontractors, you must complete and sign Form GFE-1, which is included with this Bid in the HRC’s “Good Faith Efforts Requirements” document, to indicate work will be self-performed.

BACKGROUND
Louisville Metro Public Works manages the installation of vertical deflection devices by request of Metro Council on Metro owned roadways within Jefferson County. In addition to basic maintenance of our roadways that includes paving, potholes, sidewalks, and alleys, Public Works is committed to safety through implementation of proven traffic calming methods. As funding is available and applications for projects are approved by Public Works for installation, expectations are for the successful contractor(s) to work expeditiously to complete the installation within the stated timeline.
In Fiscal Year 24 (July-June), contractors for Public Works installed 134 devices over 39 projects. In Fiscal Year 25, contractors successfully completed 141 devices over 39 projects valued at approximately $662,000. We expect a similar investment in the coming year and recognize potential for additional investment as additional funding sources are made available.

Contractor will have 3 business days to accept work order and provide a detailed cost estimate using agreed upon unit pricing within the contract. Contractor representative will also include project timeline and schedule when project will be completed.
C. The Metro project manager will review the contractor’s proposed cost and project schedule.
Once approved, Metro project manager will provide a purchase order with a Notice to Proceed day. Work shall not start until a Notice to Proceed is given.
D. If the awarded primary contractor exhibits inability to complete or close out projects within 2 months of receiving the Notice to Proceed or does not meet the standards of quality, Metro Public Works may elect to utilize secondary or tertiary contractors. Work not conforming to these requirements, including substitutions not properly approved and authorized, may be considered defective. If required by Metro the Contractor shall furnish satisfactory evidence as to the kind and quality of materials and equipment.
B. The Contractor’s obligation to perform and complete the work in accordance with the Contract Documents shall be absolute. None of the following will constitute an acceptance of work that is not in accordance with the Contract Documents or a release of the
Contractor’s obligation to perform the work in accordance with the Contract Documents:
1. Observations by the Project Manager
2. Payment by Metro
3. Use or occupancy of any part of the work by the Metro
4. Any inspection, test or approval by others; or
5. Any correction of defective Work by Metro
C. Failure on the part of Metro to insist on strict performance by the Contractor of any provision of this Contract is not a waiver of Metro’s rights and/or remedies, nor shall it relieve the contractor from performing any subsequent obligations strictly in accordance with the terms of this Contract.
D. Metro may, at its option, waive compliance with any specific contract requirement. No waiver shall be effective unless in writing and signed by both Metro and the Contractor.
Written waivers shall be limited to the specified provisions of this Contract specifically referred to herein, and shall not be deemed a waiver of any other provisions. The written waiver shall not constitute a continuing waiver unless it states otherwise.
All work shall be warranted for three (3) years from the date of Final completion unless specified otherwise.
EQUIPMENT STORAGE
A. If approved by the Engineer in writing, permits for on-street overnight parking of the Contractor’s equipment may be issued providing such equipment, including barricades, cones, and any other safety devices, will be entirely contained within one traffic lane.
Otherwise, during non-working hours of each day, all equipment and signing devices required during the working hours shall be placed off the right-of-way. Personal vehicles will not be permitted to park within the right-of-way except in specific areas designated by the Engineer. The contractor must seek permission from the property owner to use any area outside of the ROW for storage or staging. All areas must be restored upon completion of work.
SITE CONDITIONS
A. The Contractor shall visit each project and note any variations from Public Works’ estimate.
Public Works will respond to the Contractor's request for approval within seven (7) days of receipt. A memo will be prepared with recommended corrections to document all needed measures. All changes to be approved in writing by Public Works prior to construction.
B. Prior to starting any activity that may remove existing pavement markings, the Contractor shall prepare scaled drawings showing the locations of existing centerlines, turning lanes and lane markings and submit to the Engineer before existing markings are removed.
C. Differing site conditions.
1. During the progress of the work, if subsurface or latent physical conditions are encountered at the site differing materially from those indicated in the contract or if unknown physical conditions of an unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent in the work provided for in the contract, are encountered at the site, the party discovering such conditions shall promptly notify the other party in writing of the specific differing conditions before the site is disturbed and before the affected work is performed.
2. Upon written notification, the engineer will investigate the conditions, and if it is determined that the conditions materially differ and cause an increase or decrease in the cost or time required for the performance of any work under the contract, an adjustment, excluding anticipated profits, will be made and the contract modified in writing accordingly. The engineer will notify the contractor of the determination whether or not an adjustment of the contract is warranted.
3. No contract adjustment which results in a benefit to the contractor will be allowed unless the contractor has provided the required written notice.
4. No contract adjustment will be allowed under this clause for any effects caused on unchanged work.
SUSPENSIONS OF WORK ORDERED BY THE PROJECT MANAGER
A. If the performance of all or any portion of the work is suspended or delayed by the project manager in writing for an unreasonable period of time (not originally anticipated, customary, or inherent to the construction industry) and the contractor believes that additional compensation and/or contract time is due as a result of such suspension or delay, the contractor shall submit to the project manager in writing a request for adjustment within seven (7) calendar days of receipt of the notice to resume work. The request shall set forth the reasons and support for such adjustment.
B. Upon receipt, the project manager will evaluate the contractor’s request. If the project manager agrees that the cost and/or time required for the performance of the contract has increased as a result of such suspension and the suspension was caused by conditions beyond the control of and not the fault of the contractor, its suppliers, or subcontractors at any approved tier, and not caused by weather, the project manager will make an adjustment (excluding profit) and modify the contract in writing accordingly. The contractor will be notified of the project manager’s determination whether or not an adjustment of the contract is warranted.
C. No contract adjustment will be allowed unless the contractor has submitted the request for adjustment within the time prescribed.
D. No contract adjustment will be allowed under this clause to the extent that performance would have been suspended or delayed by any other cause, or for which an adjustment is provided or excluded under any other term or condition of this contract.
TRAFFIC CONTROL
A. 24 hours before any part of the work is started, the Contractor shall post “NO STOPPING” signs as required by the Department of Public Works and remove the same as soon as work is completed and open for use by the public. The Contractor is required to keep record of Time & Date of the streets posted with the signs and notify the Department of Public Works 24 hours in advance of posting these signs. The contractor must provide the No Stopping signs. Design and wording should be approved by Metro prior to posting.
B. Except as provided herein, traffic shall be maintained in accordance with the current edition of the KYTC Standard Specifications and current Manual on Uniform Traffic Control Devices.
A pedestrian detour plan should be in place anytime an existing sidewalk is closed for construction. Do not leave lane closures in place during non-working hours, unless prior approval has been made by the engineer. Installation of devices will only be allowed during the hours of 9 a.m. and 3 p.m. as to limit the number of lane closures to aid traffic flow. Work outside these hours may be granted with permission from the project manager.
C. When requested, the Contractor shall provide the project manager a copy of the project specific Maintenance of Traffic Plan as approved for all projects.
D. The Contractor shall assign a supervisory level employee to be the Traffic Control Coordinator (TCC). This information is to be presented to the project manager prior to the start of work.
E. All workers, including emergency responders, within the right-of-way who are exposed either to traffic (vehicles using the highway for purposes of travel) or to work vehicles and construction equipment within the TTC zone shall wear high-visibility safety apparel that meets the Performance Class 2 or 3 requirements of the most current ANSI/ISEA 107 publication entitled “American National Standard for High-Visibility Safety Apparel and Headwear” (see Section 1A.11), or equivalent revisions, and labeled as meeting the ANSI 107 standard performance for Class 2 or 3 risk exposure.
