About this file

This is a Form of Agreement between the Schuylkill Economic Development Corporation (SEDCO), serving as Owner, and a Contractor for the Highridge Business Park – Lot #12 project located in Foster Township, Schuylkill County, Pennsylvania. The work consists of site clearing, grubbing, grading, stormwater management infrastructure installation, paving, curbing, and water and sewer extensions. The project is designed by WJP Engineers, who will serve as the Owner's representative. The Contract requires Substantial Completion within 120 days from the commencement date and final completion within 180 days. The sealed Request for Proposals was due electronically via PennBid by Noon on September 7, 2026. The Contractor must provide Performance and Payment Bonds, each equal to 100 percent of the Contract Price with a corporate Surety approved by the Owner.

The Contract Price is to be determined by the Contractor's Bid, with payment structured as progress payments on or about the 30th day of each month. Prior to Substantial Completion, progress payments equal 95 percent of Work completed with 5 percent retainage, and 90 percent of materials and equipment costs not yet incorporated with 10 percent retainage. Once 50 percent completion is achieved and progress is satisfactory, no additional retainage applies. Upon Substantial Completion, payment increases to 100 percent of completed Work less Engineer-estimated costs for remaining items. Final payment occurs upon completion and acceptance, with interest accruing at six percent per annum from Substantial Completion. Liquidated damages are assessed at $100 per day for delays beyond the specified completion dates. The Contractor is subject to Pennsylvania prevailing wage requirements, must employ workers without discrimination based on race, gender, creed, or color, and must use only United States-produced steel and cast iron products per Pennsylvania Acts 3, 161, and 141. The Contractor assumes all risk and liability for damages or injuries occurring during performance.
