This document is a Special Provisions attachment to Contract MS-944 issued by Lemoyne Borough in Cumberland County, Pennsylvania, establishing requirements for bituminous pavement work. The contract specifies that all work must be completed by October 31, 2026, with liquidated damages assessed at $500.00 per calendar day for any work extending beyond this deadline. The contractor must notify the municipality five working days prior to project commencement and is responsible for traffic control and safety devices compliant with current MUTCD Publications 212 and 213. The special provisions establish comprehensive material and testing requirements, including delivery tickets for all materials, CS-4171 Certificates of Compliance and TR-465 Daily Bituminous Mixture Certification, and Bills of Lading for each bituminous material shipment per Section 702.1(c) of Specifications 408. Tack coat and prime coat applications are required per specification sections, with bituminous seal required on all abutting pavement and curbs. The contractor must obtain oil samples from each distributor truck (one quart each morning and afternoon) witnessed and retained by the municipality, and collect at least three random stone samples on-site with municipal witness. The municipality retains the right to limit completed work, procure materials best suited to their requirements, make awards based on aggregate totals for like items, and make future contract awards based on work quality. The contract requires notification to all residents of pending work, incidental preparation and cleanup, and final completion with a Notice of Completion and Final Completion Certificate.
