About this file
This document is an Addendum (#4) to a Request for Proposals (RFP #6000001251) issued by the Port Authority of New York and New Jersey for Expert Professional Integrity Monitoring Services for Port Authority Facility Infrastructure Projects. The contract is for services to be performed on a "call-in" basis during the period of 2023 through 2028, with firms competing for specific work through task orders.
The addendum addresses three key questions from potential bidders regarding the proposal. The Port Authority clarified that there is no set maximum profit amount for the multiplier, though they reserve the right to reject costs not aligned with industry standards. They also specified that employee bonuses are not accepted as part of multipliers. Additionally, the Authority indicated they generally do not entertain exceptions to agreement terms, and firms awarded under this call-in program will be expected to assess risk and decide whether to submit task order proposals based on the detailed work requirements outlined in each specific task order.

SUBJECT: PERFORMANCE OF EXPERT PROFESSIONAL INTEGRITY
MONITORING SERVICES FOR PORT AUTHORITY FACILITY INFRASTRUCTURE
PROJECTS – AS REQUESTED ON A “CALL-IN” BASIS DURING 2023 THROUGH 2028
(RFP# 6000001251) - ADDENDUM # 4
The following questions were received from a Request for Proposals (RFP) recipients(s). The questions and the corresponding Authority answers are provided for your information and use, as appropriate.
Question1: What is the program of periodic merit referred to in 7A?
Answer 1: The program of periodic merit” referenced in 7A relates to any request of the firm for an increase in salaries/billing rates. Any such request must be in accordance with the items listed in a-d, but a specifically relates to the firm’s “program of periodic merit and cost of living increases normally administered by it” – in this instance, the “it” being the firm itself.
Question 2: Is there a maximum profit amount for the multiplier? Are employee bonuses part of the multiplier?
Answer 2: There is no set “maximum” allowable profit and whatever a firm elects to propose as a profit is a business decision, but may impact its competitive position with respect to the selection process. The Authority reserves the right to reject any cost that is not in line with industry standards. The Port Authority does not accept bonuses as part of multipliers.
Question 3: Can you please confirm that it is the intention of the Authority to include Section 23 as part of the proposed agreement terms and that the Consultant must agree to accept that indemnification obligation should it be selected?
Answer 3: The Port Authority generally declines to accept or entertain exceptions on the agreements awarded under its Call-in Programs.
Firms that are awarded an Agreement under this Call-in Program will compete for specific work on a Task Order basis. Firms are encouraged to make a determination as to the risk and tolerance of applicable Agreement terms and conditions when assessing the work in a particular
Task Order, and whether to compete for it. The Task Order will outline the work that is required in detail; as such, firms holding Agreements may make an informed decision and choose not to submit Task Order proposals, or may choose to submit exceptions on a Task Order basis. However, as noted, the Port Authority is under no obligation to entertain any such exceptions at that time.
