About this file

This document is an Addendum #2 for a Request for Proposals (RFP# 6000001251) issued by the Port Authority of New York and New Jersey for Expert Professional Integrity Monitoring Services for Port Authority Facility Infrastructure Projects. The contract is for a call-in program spanning 2023 through 2028, where consultants will provide professional integrity monitoring services on an as-needed basis. The addendum addresses 17 questions from potential bidders, covering topics such as MBE certification processes, conflict of interest disclosures, insurance requirements, rate structures, and administrative details.

Key points include clarification that pricing is not confidential, subconsultant rates are not required in the proposal, and only one multiplier should be used across all staffing titles. The Port Authority emphasizes maintaining a fair and equitable process, declining to accept exceptions to agreement terms. For Minority and Women-owned Business Enterprises (MBE/WBE), a firm can self-fulfill participation goals if they are Port Authority certified, though all firms are encouraged to utilize certified subconsultants to the maximum extent feasible. The pre-proposal meeting was held on January 10, 2023, with an extensive list of attendees from various consulting and advisory firms.

SUBJECT: PERFORMANCE OF EXPERT PROFESSIONAL INTEGRITY

MONITORING SERVICES FOR PORT AUTHORITY FACILITY INFRASTRUCTURE

PROJECTS – AS REQUESTED ON A “CALL-IN” BASIS DURING 2023 THROUGH 2028

(RFP# 6000001251) - ADDENDUM # 2

The following questions were received from a Request for Proposals (RFP) recipients(s). The questions and the corresponding Authority answers are provided for your information and use, as appropriate.

Question1: How long does the MBE certification process typically takes from application date to receiving the certification?

Answer 1: The certification can take between 30 – 90 days from receipt of the application.

Question 2: How do we address a potential conflict of interest?

Answer 2: As per Section IV, Letter K of the RFP Letter, “If the Proposer or any employee, agent or subcontractor/subconsultant of the Proposer may have, or may give the appearance of a possible conflict of interest, the Proposer shall include in its Proposal a statement indicating the nature of the conflict and a proposed mitigation plan.”

Question 3: Is pricing confidential?

Answer 3: No, refer to Attachment B (Agreement on Terms of Discussion) included in the solicitation package.

Question 4: Is it acceptable for law firms to satisfy only the professional liability insurance requirement? Is there a place in our response we can include comments regarding our coverage?

Answer 4: The insurance requirements apply to the selected Consultant(s) and its subconsultant(s). If the insurance requirements are too stringent, the selected Consultant(s) would seek approval from the Authority to potentially adjust the insurance requirements depending on the scope of work and location of operations. However, the Authority is under no obligation to accept insurance exceptions. The insurance limits can be designed with a combination of a Primary policy(s) (General Liability, Auto, etc.) with an Excess/Umbrella policy that “follow form” with the underlying policy(s). In addition, you may also include any insurance exceptions for consideration in your proposal submission under letter L, Again, these exceptions would be considered on a Task Order basis.

Question 5: We are a current PANYNJ service provider. Is there a place in our response we can include comments regarding the terms of the agreement?

Answer 5: The Port Authority is not accepting exceptions under this Call-In Program. In order to maintain a fair and equitable process for all awardees we decline to accept exceptions. Should you have exceptions to the insurance limits, these may be discussed with the Project Manager and the Port Authority’s Risk Unit at a task order level. However, note that, the Port Authority is under no obligation to entertain requests to change the limits.

Question 6: Per Addendum 1, Question 2, can you please confirm no breakdown of multipliers is needed? Will rates without multipliers result in disqualification?

Answer 6: Per Section IV, Letter D of the RFP letter, “ Provide the “multipliers” referred to in subparagraph 7A of the accompanying standard Agreement including a breakdown of said multiplier, indicating all of its components (e.g., vacation, holiday, sick pay, workers’ compensation, office rent, insurance, profit)”. Should additional information be required from your firm, this can be provided after proposal submissions.

Question7: Can you please confirm that subconsultants do not need to provide rates/multipliers?

Answer 7: As per Exhibit I, “Rates [and multipliers] indicated should be for the Prime Consultant only, not subconsultants”.

Question 8: Do subconsultants need to complete Attachment B (Agreement on Terms of Discussion)?

Answer 8: Attachment B (Agreement on Terms of Discussion) is to be completed only by the Prime proposer.

Question 9: Section IV, Paragraph D - Is the multiplier a single, same factor that is to be applied to each proposed staffing title, or can different multipliers be applied to different proposed staffing titles?

Answer 9: Please refer to section 7.A of the standard agreement. Only one multiplier shall be used for all proposed staffing titles.

Question 10: Section IV, Paragraph F – Are names, titles, hourly rate(s), and billing rates required of subconsultants of the Proposer, or is this information only required of the Proposer?

Answer 10: See answer # 7 above.

Question 11: Should hourly rates for subcontractors be included in this schedule? While it’s clear that the breakdown of “multipliers” is required for the prime consultants, it is a bit unclear whether we should provide subcontractor rates in this proposal.

Answer 11: See answer #7 above.

Question 12: Since the call-in period runs from 2023 through at least 2028, should we provide in our proposal any proposed rate increases over the term of the call-in period?

Answer 12: See section 7A, fourth paragraph of the standard agreement regarding rate increases.

Question 13: Will the selected team be performing all administrative work remotely within the selected Consultant’s currently running office space(s)?

Answer 13: It is anticipated that space will be made available at JFK for projects located there, if desired. Use of the space is not required for administrative work.

Question 14: Can you distribute the attendee list for the Pre-Proposal meeting held on January 10, 2022.

Answer 14: The Authority has attached the subject pre-proposal meeting’s attendee list for your reference.

Question 15: Can you please define “Actual Hourly Rate” as referenced in Section IV, Letter F?

Answer 15: Refer to Section 7A in the standard agreement regarding compensation.

Question 16: With regard to rates for subconsultants, Exhibit I indicates no rates are needed. Is there somewhere you would like subconsultant rates reflected?

Answer 16: See answer #7 above.

Question 17: If a proposer is an MBE, is the MBE required to have additional MBE participation through a subcontractor?

Answer 17: A firm can meet and self-fulfil their relative M/WBE and SDVOB participation goals if they are Port Authority certified MBE, WBE and SDVOB, subject to the approval by the Office of Diversity, Equity and Inclusion on a task order basis. Note that all firms are encouraged to use every good-faith effort to utilize subconsultants who are Port Authority certified MBEs, WBEs or SDVOBs to the maximum extent feasible.
