About this file

This is a Data Security Addendum for inclusion in contract GMU-SS0922-25 between George Mason University and a selected vendor to provide gift cards and related services for research participants and employee recognition. The addendum establishes comprehensive data security requirements applicable when the vendor creates, obtains, transmits, uses, maintains, processes, stores, or disposes of the University's protected data as part of contract performance. The addendum defines protected data to include personally identifiable information, credit card data, financial or business data, medical or health data, trade secrets, and confidential student or employee information, and requires vendors to encrypt all electronic protected data in transmission and storage using AES-128 encryption or greater and to securely destroy data upon University request using methods meeting or exceeding National Institute of Standards and Technology guidelines.

The addendum mandates that vendors maintain cyber liability insurance of not less than $2,000,000 per incident with the Commonwealth of Virginia and George Mason University named as additional insureds for the contract term. Vendors handling credit card data must maintain Payment Card Industry Data Security Standard compliance and provide proof of compliance within 10 business days of written request, with the University retaining the right to terminate immediately upon non-compliance. All employees with potential access to protected data must undergo background checks including Social Security Number trace, seven-year criminal records checks, Office of Foreign Assets Control checks, Bureau of Industry and Security checks, and Defense Trade Controls Debarred Persons List checks. Vendors must conduct annual security audits, vulnerability scans, and penetration tests at their expense and provide results to the University upon request, along with independent third-party certifications such as SOC 2 Type II, ISO 27001/2, or equivalent, provided annually at no cost to the University. The vendor assumes full liability for all costs related to investigation and remediation of any security breaches of protected data, including notification costs, credit monitoring, legal fees, and regulatory fines.
