About this file

This document is a Mandatory Master Terms for Data Access and Data Sharing Agreement template issued by the Savannah-Chatham County Public School System (SCCPSS) in Georgia. The agreement establishes binding terms that apply to all current and future vendors, contractors, and their affiliates who access, control, or share educational records and personally identifiable information of SCCPSS students. All parties entering into data access and data sharing arrangements with SCCPSS must comply with these mandatory terms, which cannot be altered, disclaimed, or replaced through other contractual instruments, including vendor-provided terms and conditions or privacy policies. The agreement applies to any contractor accessing student educational records or personally identifiable information under the School Official exception and requires strict adherence to all applicable federal and state regulations.

The Master Terms impose several critical compliance requirements on vendors, including full compliance with the Family Educational Rights and Privacy Act (FERPA), the Individuals with Disabilities Education Act (IDEA), and the Children's Online Privacy Protection Act (COPPA). Vendors must store all educational records and personally identifiable information exclusively within the United States and employ industry-standard strong encryption for all storage, transmission, and sharing activities. Upon contract termination or when data is no longer needed, vendors must completely and promptly destroy or return all student data. The agreement establishes Georgia law as the governing law and Chatham County, Georgia as the exclusive venue for any disputes. Additionally, SCCPSS cannot enter into indemnity or hold harmless agreements as prohibited by Georgia law, rendering any such contractual provisions void. The document includes signature blocks for both the vendor and SCCPSS to acknowledge acceptance of these mandatory terms.

All parties accessing, controlling and sharing educational records and/or personally identifiable information of SCCPSS students will comply with applicable FERPA requirements and protocols.
