About this file
This is an Emergency Purchase Statement filed by the Illinois Department of Corrections (IDOC) with the State of Illinois Chief Procurement Office for General Services. The document authorizes emergency procurement of commissary items from E-Ford Commissary Inc., a vendor located in Greer, South Carolina. The emergency purchase was necessitated by the Department's inability to obtain continued contractual coverage through extensions or amendments to existing commissary arrangements while the agency develops a long-term competitive procurement for statewide commissary services. The vendor will provide approved commissary items including food, clothing, health and beauty products, sundries, and electronics for sale to individuals in custody and correctional facility employees across IDOC facilities. The emergency purchase was made with an estimated cost of $6,000,000.00 and an award date of August 27, 2026, with an estimated final cost form to be submitted no later than the tenth day of the succeeding month. This interim emergency contract is limited to maintaining necessary coverage while the Department completes its competitive procurement for a long-term statewide commissary contract.
The IDOC selected E-Ford Commissary Inc. because the vendor maintains an established product catalog that has already been reviewed, tested, and verified for compliance with correctional safety, security, and operational requirements, eliminating the need for time-consuming product validation during the emergency period. Selection of an alternative vendor would require several months to complete the necessary product catalog review and approval process. The vendor possesses the necessary supply-chain, inventory, distribution, and logistical capabilities to support commissary operations across Department facilities statewide without an extended implementation period. The Department was unable to establish meaningful Business Enterprise Program (BEP) participation goals due to the drop-ship distribution model used by emergency vendors and the unpredictable purchase and subcontracting base resulting from fluctuating operational needs and product availability. Funding for this emergency purchase is derived from sources other than federal funds, state appropriated funds, or state grant funds. The Department explicitly notes that this emergency selection is limited to interim coverage and is not intended to predetermine the outcome of the competitive procurement for long-term commissary services.

TextField2: The Illinois Department of Corrections needs a vendor(s) that is able to provide needed commissary items to the Illinois Department of Corrections for its Individual in Custody and Correctional Facility Employees.
TextField4: Prior to initiating this emergency purchase, the Illinois Department of Corrections (IDOC), has been working through the contractual and procurement requirements necessary to determine whether continued commissary coverage could be accomplished through extensions or additional amendments to the existing arrangements. The Department was ultimately unable to obtain the necessary continued contractual coverage through that approach, requiring IDOC to pursue an alternative means of maintaining commissary operations while development of the long-term competitive procurement continued.
At the same time, the Department continued evaluating the appropriate procurement method and structure for establishing a sustainable statewide commissary contract. Various competitive procurement approaches were considered, each presenting potential advantages and limitations based upon the Department’s operational requirements, the available vendor market, the method of evaluation, statewide distribution needs, product availability, and the process necessary to establish and maintain a consistent catalog of correctional-approved products.
Statewide commissary operations present requirements that extend beyond the procurement of individual commodities. The resulting contract must support multiple correctional facilities, substantial product volumes, statewide distribution, inventory continuity, and access to food, hygiene, personal care, and other authorized products that satisfy applicable Department safety, security, and operational requirements. Consequently, the Department needed to ensure that the selected procurement structure would result in a contract that could be successfully implemented and sustained rather than moving forward with a procurement method that did not adequately address those requirements.
The additional time necessary to evaluate these considerations, determine the appropriate procurement approach, and develop the resulting solicitation extended beyond the period during which commissary operations could continue without contractual coverage. Suspending or interrupting commissary services during this process was not operationally feasible due to the need to maintain consistent access to approved products throughout Department facilities.
Following this analysis, IDOC has determined its long-term procurement approach and is finalizing a Request for Proposals for a competitively procured statewide commissary contract. Emergency purchasing authority is therefore necessary as an interim measure to maintain uninterrupted commissary operations and a consistent supply of approved products while the competitive procurement is completed and the resulting long-term contract is implemented.
ExplanationForSelectingVendor: The Department selected this vendor because it can immediately continue providing commissary products from an established catalog that has already been reviewed, tested, and verified by IDOC for compliance with applicable correctional safety, security, and operational requirements.
Product approval is a significant consideration within a correctional environment. Items intended for distribution within Department facilities must be evaluated to determine whether they are appropriate for use by individuals in custody and within secure institutional settings. The selected vendor currently maintains an established product list containing items that have already completed this review process, allowing commissary operations to continue without requiring the Department to initiate a new product-validation process during the emergency period.
Selection of a different vendor would require IDOC to review the proposed vendor’s product catalog and conduct the testing and approval necessary before those products could be introduced for statewide commissary use. Depending upon the number and type of products proposed, that process could require several months to complete. Undertaking a full catalog transition during the emergency period could therefore delay implementation of replacement services and create a substantial risk of interruption in the availability of approved commissary products.
In addition to maintaining an approved product catalog, the selected vendor possesses the supply-chain, inventory, distribution, and logistical capabilities necessary to support commissary operations across Department facilities statewide. These existing capabilities allow the vendor to meet the Department’s immediate requirements without the implementation period that would accompany establishing a new vendor, validating a new product catalog, and transitioning statewide operations.
Based upon the immediate operational need, the importance of maintaining access to previously approved products, the time required to evaluate and approve an alternative product catalog, and the need for statewide distribution capability, the Department determined that selection of this vendor represented the most practicable means of maintaining continuity of commissary services during the emergency period.
This emergency selection is limited to maintaining necessary interim coverage while the Department completes its competitive procurement for a long-term statewide commissary contract and is not intended to predetermine the outcome of that competitive procurement.
ExplanationSuppliesServices: The Vendor will provide approved commissary items that will allow for the continued sales of food, clothing, health/beauty, sundries and electronics to individuals in custody and Correctional Facility Employees.
TextField3: The nature of our current purchasing cycle and the necessary security protocols do not allow vendors to secure reliable supply chains or establish partnerships with BEP certified businesses. Vendors provide new pricing every 4 to 6 weeks and must respond quickly to shifting product availability. Without long-term volume commitments, it is not practical for the vendors to formalize subcontractor relationships or guarantee consistent opportunities for BEP participation. We will continue to pursue BEP inclusion as market conditions stabilize and we realize our competitive solicitation for a long-term contract.
TextField1: The Department evaluated the feasibility of establishing a BEP/VBP participation goals for the emergency procure, including discussions with the emergency vendors regarding their existing distribution and fulfillment models. The vendors primarily use a drop-ship distribution model, and the products, manufacturers, quantities, and associated expenditures required under the emergency contract fluctuate based upon operational need and product availability. As a result, there was not a sufficiently predictable purchase or subcontracting base upon which to establish and consistently maintain a fixed BEP/VBP participation. Establishing a goal without reasonably identifiable and sustainable participation opportunity could result in a goal that could not be consistently or meaningfully achieved.
