About this file

This document is an addendum to FAR clauses 52.212-1 and 52.212-2 that provides instructions to offerors for a firm fixed-price Request for Quotation (RFQ) for DPW Carlisle Barracks Refuse and Recycling services (Solicitation W91QF026Q1000) issued by the Department of the Army Materiel Command Mission and Installation Contracting Command Fort Eustis. Offers must be submitted electronically by the closing date specified in the RFQ to Bethany Flynn, Contract Specialist (bethany.l.flynn@army.mil), with a copy to Bill Byrne, Contracting Officer (william.a.byrne.civ@army.mil). All questions must be submitted via email by 8:00 AM EST on March 17, 2026, and no telephone inquiries will be accepted. All vendors must be registered in the System for Award Management (SAM).

Offerors must submit three separate volumes: Volume 1 containing acknowledgment of modifications, representations and certifications, and exceptions; Volume 2 containing technical proposal and minimum three current and relevant past performance examples from the past three years with points of contact and performance context; and Volume 3 containing firm fixed-price quotes for all CLINs including option years as a separate file. Evaluation will be conducted under three factors: Technical (Acceptable/Unacceptable), Past Performance (Acceptable/Unacceptable based on recent and relevant work), and Price (evaluated for reasonableness using FAR 12.203 price analysis techniques). To be eligible for award, offerors must receive an "Acceptable" rating on all non-price factors, and non-small business offerors must have an acceptable Small Business Subcontracting Plan. The Government intends to award without discussions and reserves the right to use artificial intelligence tools to support evaluation, though final award decisions remain the exclusive responsibility of Government personnel.

FAR 52.212-2 Evaluation-Commercial Items Addendum

The Government shall evaluate the offer in accordance with FAR Part 12.203 evaluation procedures.

EVALUATION CRITERIA

1. The quotes will be evaluated under three (3) evaluation factors: Technical, Past Performance, and Price.

Factor 1: Technical Factor 2: Past Performance Factor 3: Price

1. Factor 1 - Technical. The Technical evaluation will evaluate the contractor’s level of understanding of tasks to be accomplished in accordance with the PWS and qualifications of the contractor in accordance with the PWS.

Table 1. Technical Rating(s) Acceptable/Unacceptable Ratings

Rating
Description
Acceptable
Quote meets the requirements of the solicitation.
Unacceptable
Quote does NOT meet requirements of the solicitation.

2. Factor 2 - Past Performance. The Past Performance evaluation will assess the offerors’ probability of meeting the solicitation’s requirements as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offerors recent past performance and focusing on performance that is relevant to the supplies/services being procured under this RFQ. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the quote and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems and State Department Watch Lists. Past performance references for similar services performed within the last three (3) years are required to be submitted. Past performance areas of evaluation include:

· Business Relations

· Quality of Service

· Schedule

· Customer Satisfaction

1. Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past three (3) years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

1. Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services/products being procured under this solicitation. Recent past performance is defined as not more than three (3) years from the solicitation’ release date, relevant in terms of similar nature of work, size, and complexity.

Contractors without a record of relevant past performance, the contractor may not be evaluated favorably or unfavorably on past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” Past Performance must be both recent and relevant.

The purpose of the rating is to reflect the degree to which the Past Performance is ACCEPTABLE or NOT in meeting the minimum performance or capability requirements.

Table 2. Past Performance Evaluation Ratings

Rating
Description

Acceptable

Based on the contractor’s performance record, the Government has a REASONABLE expectation that the contractor will successfully perform the required effort, or the contractor’s performance record is unknown.

Unacceptable
Based on the contractor’s performance record, the Government has NO reasonable expectation that the contractor will be able to successfully perform the required effort.

3. Factor 3 - Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 12.203 Through these techniques the Government will determine whether prices are reasonable, complete, and balanced. Unless indicated otherwise, all lines shall be quoted on, including all option years.

Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

Basis for Award.

(a) For an Offeror to be considered for award, the quote must receive an “Acceptable” rating in every non-price Factor. A quote receiving a rating of “Unacceptable” in any non-price Factor will not be eligible for award.

(b) Additionally, any other than small business offeror must have an acceptable Small Business Subcontracting Plan to receive an award in accordance with Federal Acquisition Regulation (FAR) 19.702(a).

(c) The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

Use of Artificial Intelligence (AI) tools in Proposal Evaluation

(a) Use of AI tools in Support of Evaluations: The Government will employ AI as a tool to assist in the analysis and review of offerors. AI tools may be used to support tasks such as summarizing proposal content, identifying compliance with request for solicitation requirements, and highlighting areas of potential strength, weakness, or risk.

(b) Maintaining Inherently Governmental Functions: Notwithstanding the use of AI tools to support the evaluation process, all final evaluation judgements, including the assignment or assessment of adjectival ratings, best value determinations, and source selection decisions, will be made exclusively by duly appointed Government personnel. The Government retains sole responsibility for all inherently governmental functions and will not delegate decision making authority to any AI tool.

(c) Offeror Confidentiality and Data Protection: The AI tools utilized by the Government will be employed in a manner consistent with applicable regulations that govern the protection of proprietary and source selection sensitive information. The AI tool will be an output-only system. Any generated report data is not saved. No proposal data will be transmitted to or processed by external, non-Government systems without appropriate safeguards and authorizations in place.

Notice of award.

A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
