The purpose of this amendment is to add Attachment 5, NAVFAC P-307, Weight Handling Program Mgmt, Section 8 to the 1449 Request for Quote (RFQ), N3904022R0006 to include the Physical Qualif ications that apply to contractors and to issue an update to the addenda to FAR 52.212-1 “Instruction to Offerors- Commercial Items”.

SUPPLEMENTAL INSTRUCTIONS
Addenda To FAR 52.212-2 “EVALUATION--COMMERCIAL ITEMS” (OCT 2014)
The Government intends to solicit, evaluate and award contracts resulting from this solicitation using the policies and procedures in FAR Part 12 and FAR Part 13.5. The Government does not intend to include price or cost as an evaluation factor at the contract level; instead, the Government intends to award contracts to each and all qualifying offerors as defined in FAR 2.101. The Government does not intend to include price or cost as an evaluation factor at the contract level, but will use price as one of the factors in the selection decision for each task order placed under the contract in accordance with FAR 13.106-1(a)(2)(iv)(A) and (B). The task orders may be awarded using either a Lowest Price Technically Acceptable (LPTA) or Trade-off process depending upon an analysis of the limitations and prohibitions in DFARS 213.106-1(a)(2)(ii) that may apply to specific task orders. A determination whether evaluations will be LPTA or trade off shall be determined and announced in each solicitation at the task order level.
Submissions shall be evaluated in accordance with the factors described below. The evaluation factors represent key areas of importance to be considered in the source selection decision. The factors and associated elements have been chosen to support meaningful discrimination between and among competing proposals. As demonstrated in their submissions, prospective Vendors shall be evaluated in terms of their ability to meet or exceed the program’s requirements stated in the PWS. The Vendor’s quotation shall demonstrate a clear understanding of the nature and scope of the work specified in the PWS. Failure to provide a complete quotation shall reflect a lack of capability to perform the work requirements and may result in a determination that the Vendor’s quotation is unacceptable.
Quotations received for less than the entire requirement will not be eligible for award.
*NOTE: Awards will only be made to a Vendor that has no Organizational Conflict of Interest (OCI) as defined in FAR 9.5 or that the Government determines has provided a satisfactory mitigation plan. Vendors are advised that technical submissions may be evaluated without consideration of any proposed subcontractor which is deemed to have an OCI and for which an unsatisfactory mitigation plan has been proposed.
Factor 1. Technical Capability. The Government will evaluate whether the Vendor has demonstrated an understanding of and the capability to perform this requirement in a manner that conforms to the contract by considering:
The Technical Capability factor will be rated at the Factor level using the adjectival definitions below. The individual elements will not be rated, but the Government’s evaluation of the elements, individually or collectively, will affect whether a quotation is rated Acceptable or Unacceptable.
Mobile Cranes Equipment Plan: Whether the Vendor has submitted a Mobile Cranes Equipment Plan that addresses the requirements identified in the addendum to 52.212-1 in a clear and concise manner and that demonstrates its capability to provide the four (4) mobile crane sizes that are identified in and will comply with the Performance Work Statement (PWS).
Crane Operator Certification: Whether the Vendor has submitted the documentation identified in the addendum to 52.212-1 that demonstrates that its Crane Operators possess or will possess before contract award the current certifications and qualifications required to operate all mobile cranes identified within its Mobile Cranes Equipment Plan.
Experience: Whether the Vendor has clearly demonstrated that it has recent and relevant experience in at least two of the crane capacities described in the PWS.
Subcontractors: Whether the Vendor has identified its intention to rely upon subcontractors, and if so, described their role under the contract, provided the information required under the Mobile Cranes Equipment Plan or Crane Operators Certification elements, and provided information that demonstrates the subcontractor’s experience.
Adjectival Rating Description
Acceptable Submission meets the requirements of the solicitation.
Unacceptable Submission does not meet the requirements of the solicitation.
Factor 2. Past Performance.
The Government will evaluate the recent and relevant Past Performance of Vendors and any proposed subcontractors, teaming/joint venture partners or affiliates (hereafter, contractor or Vendor) to determine how well the contractor performed on the referenced contracts and to assess the Vendor’s probability of performing the solicitation’s requirements. The Government will use information that is recent and relevant to determine how well the contractor performed on the referenced contracts in the following areas:
Quality of Service: The degree to which the services provided meet the requirements of the contract, including safety measures, and the degree to which they were similar to this solicitation.
Delivery/Completion Schedule: The extent to which the Vendor satisfied customer requirements for contract completion in accordance with the agreed upon schedule.
Past Performance Recency and Relevancy Ratings – The following definitions will apply to this evaluation:
Recency: To be recent, the effort must have been performed during the past five (5) years from the date of issuance of this solicitation. Information that fails to meet this condition will not be evaluated.
Relevancy: To be relevant, the effort must be similar in scope, magnitude and complexity to the services being procured under this solicitation.
Scope: Measures experience in the areas defined within the PWS. Prior projects or contracts are considered similar if they demonstrate that the Vendor has provided a mobile crane of a size capacity specified in the PWS (60 Tons, 100 Tons, 120 Tons and 275 Tons), with qualified operators.
Complexity: The measure of similarity of technical efforts that exists between the PWS and the Vendor's other contracts. Prior projects or contracts are considered similar if they involved the use of two (2) mobile cranes working in tandem, in a complementary manner or in close proximity to each other, or required the Vendor to submit a critical lift plans.
Magnitude: Measures similarity of the dollar values between the prior contract or project and the Navy’s Mobile Crane contract or the projected value at the Task Order level.
Past performance will be evaluated using the adjectival ratings in the Past Performance Evaluation Ratings Table below:
*NOTE: Vendors are advised that the Government may consider past performance information obtained from sources other than those identified by the Vendor, including Federal, State and local Government agencies, better business bureaus, published media and electronic databases including, but not limited to, Supplier Performance Risk System (SPRS) and Contractor Performance Assessment Reporting System (CPARS). The Government may research Vendor performance on any Federal, State, local and commercial procurement that is known to the Government, but not included on a submitted reference.
The following adjectival ratings/definitions shall be used for the Past Performance evaluation factor: There are two aspects to the past performance evaluation.
1) Relevancy of Past Performance The first aspect is to evaluate whether the Vendor’s past performance is relevant or not relevant to the effort to be acquired through the source selection, using the criteria set forth in the addendum to 52.212-1.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires
2) Performance Confidence Assessment
The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. Past Performance information that is not recent or relevant is not considered in the assessment of Past Performance Confidence.
In conducting a performance confidence assessment, each Vendor shall be assigned one of the ratings below:
Acceptable Acceptable Based on the Vendor’s performance record, the
Government has a reasonable expectation that the Vendor will successfully perform the required effort, OR the Vendor’s performance record is unknown. (See Note Below)
Unacceptable Unacceptable Based on the Vendor’s performance record, the Government does not have a reasonable expectation that the Vendor will be able to successfully perform the required effort.
*NOTE: In the case of a Vendor without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Vendor may not be evaluated favorably on past performance (see FAR 15.305(a)(2)(iv)).
Therefore, the Vendor shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

SUPPLEMENTAL INSTRUCTIONS
Addenda to FAR 52.212-1 “Instructions to Offerors – Commercial Items”
I. GENERAL
In addition to FAR 52.212-1, Instructions to Offerors--Commercial Items and any other instructions contained elsewhere in this solicitation, the following information is provided:
Vendors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factor and elements of evaluation factor.
Failure to meet a requirement may result in an offer being ineligible for award. If the Vendor finds it necessary to take exception to any of the requirements specified in the solicitation, the Vendor shall clearly identify where it is addressed in its proposal and provide a complete explanation of why the exception was taken, what benefit (if any) accrues to the Government, and its impact (if any) on the performance, schedule, cost and specific requirements of the solicitation. Each exception shall clearly identify the specific paragraph and/or part of the solicitation to which the exception is taken.
Important Notes:
Vendors shall respond to all requirements of the solicitation document. Vendors are cautioned not to alter the solicitation.

II. CONTENT OF QUOTE
Vendors’ quotes shall comply with the requirements outlined below and incorporated herein.
1. Completed and Signed SF 1449.
2. Signed Copies Acknowledging Amendments, if applicable
3. System for Award Management (SAM): Vendors must be registered in the SAM database to be considered for award. Registration is free and can be completed on-line at http://www.sam.gov/
4. A point of contact, name, email address, phone/FAX number, CAGE Code
5. Representations and Certifications completed by the vendor in accordance with instructions contained elsewhere in this solicitation. Note, If the vendor has completed all of the representations and certifications required by this solicitation in SAM.gov in accordance with FAR 52.204-8, then the vendor need not submit the hardcopy Representations and Certifications.
6. Technical Acceptability Submission as noted below.

8. Price. Vendors are not required to submit any pricing information. The Government does not intend to include price or cost as an evaluation factor at the contract level, but will use price as one of the factors in the selection decision for each task order placed under the contract in accordance with FAR 13.106- 1(a)(2)(iv)(A) and (B).
Factor 1, Technical Acceptability Submission. Vendors shall demonstrate their Technical Acceptability by providing the information required under the following three elements: (i) Mobile Cranes Equipment Plan; (ii) Qualified Crane Operator Certification; (iii) Experience and (iv) Subcontractors.
Mobile Cranes Equipment Plan: Vendors shall submit a plan that identifies all mobile cranes that it proposes to use to perform this contract. The Vendor’s plan must demonstrate the capability to provide the four mobile crane sizes that are identified in and will comply with the performance work statement (PWS).
For each Crane, the Vendor shall provide the following information: Crane Manufacturer, Model, and Number; current Crane Inspection Certification, Crane Manufacturer’s specifications and applicable ratings and the name(s) of the company(ies) that owns and will operate the crane during contract performance. An annual Crane Inspection Certificate is considered “current” if issued within one year from the date this solicitation was issued. A quadrennial Crane Inspection Certificate is considered “current” if issued within four years from the date this solicitation was issued.
Crane Operator Certification: Vendors shall submit documentation demonstrating that its Crane Operators possess or will possess before contract award the certifications and qualifications required to operate all mobile cranes identified in its Mobile Cranes Equipment Plan. For each Operator, the Vendor shall provide the following information: Operator’s Name, a current medical certificate attesting to the operator’s physical qualifications (see Amendment 000#, PWS, Attachment 1, para 8.4), proof of current qualification from a source that qualifies crane operators, the crane on which the Operator is qualified and the names of the operator’s employer. Vendors must provide written assurances in its quotation that it will obtain certifications or qualifications before contract award for all crane operators who do not currently possess the required certifications and qualifications.
Experience: Vendors shall submit documentation of two projects or contracts that demonstrate recent and relevant experience with at least two (2) of the mobile crane sizes identified within the PWS. Contracts or Projects are considered recent if they have been completed within the last five (5) years. Contracts or Projects are considered relevant if they are similar to the requirements of the PWS and Attachment 3. For each contract or project, Vendors shall provide the following: customer’s name, organization and contact information; contract or project number and title; dates of performance; a description of the work performed and how it is relevant to the PWS.
Subcontractors: Vendors that intend to use subcontractors, teaming partners or affiliates (hereafter, subcontractors) shall identify those entities in their response and describe their role under the contract and their experience. Vendors that intend to rely upon a subcontractor’s mobile cranes or crane operators shall provide the same type of information required under the Mobile Cranes Equipment Plan or Crane Operators Certification elements. Vendors that intend to rely upon a subcontractor to operate mobile cranes must submit two (2) recent and relevant contracts or projects that demonstrate the subcontractor’s experience.
Vendors shall submit the same information required under the Past Performance factor, except that subcontractors only need to demonstrate experience in the specific mobile crane that it intends to operate during contract performance. Vendors that do not intend to use subcontractors to perform this contract shall include that statement in their quotations.
Factor 2, Past Performance Submission.
Past performance information described herein is required for the Vendor and all subcontractors, teaming/joint venture partners, and affiliates that are proposed to perform on the contract. In order to facilitate the Government’s evaluation of this factor, the Vendor shall provide at least two (2) projects or contracts that demonstrate recent and relevant Past Performance with at least two (2) of the mobile crane sizes identified within the PWS. The Government will only evaluate projects or contracts that have already been performed. For each contract or project, the following information shall be provided:: (i) customer’s name, organization and contact information; (ii) contract or project number and title; (iii) dates of performance (identify the start and end dates using months and years); (iv) the dollar value of the work performed; (v) a description of the work performed and how it is relevant to the PWS, including safety measures used; (vi) whether the prior project was performed as the prime contractor or subcontractor, (vii) any negative comments or assessments regarding the mobile crane operator’s compliance with safety measures and (viii) copies of any Contract Performance Assessment Reports or similar assessments, if available.
The Vendor shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming/joint venture partner and affiliate, authorizing release of adverse Past Performance information to the Vendor so the Vendor can respond to such information. For each identified effort for a commercial customer, the Vendor shall also submit a client authorization letter authorizing release to the Government of requested information on the Vendor’s performance.
