About this file

This is an emergency procurement memorandum from the City of Farmington's Central Purchasing department regarding gas line repairs at the Four Corners Regional Airport. The emergency procurement was initiated after a gas-fired radiant heater malfunction in Hangar 9 led to the discovery of gas line leaks, with some lines being inaccessible behind blown insulation. The immediate replacement of gas lines is required due to approaching freezing temperatures and the presence of fire suppression systems that cannot be allowed to freeze. Due to building classification restrictions, temporary portable heaters are not a viable solution.

The contract was awarded to M & R Plumbing & Heating of Farmington, NM for a one-time purchase amount of approximately $28,000. The scope includes immediate replacement of gas lines to repair leaks and restore heating to Hangar 9 at 1300 W Navajo St. The emergency procurement was justified under NM Statute 13-1-127, citing threats to government function, property protection, and personnel safety, bypassing normal procurement methods due to the urgent nature of the situation.

CITY OF FARMINGTON

CENTRAL PURCHASING

INTER-OFFICE MEMORANDUM

TO: Jennifer Rowland, CPO, CPPB, NIGP-CPP Chief Procurement Officer

FROM: Jason Burgert

DATE: November 14, 2024

SUBJECT: Written Determination, NM Statute 13-1-127 Emergency Procurements

Monday morning we had a gas fired radiant heater malfunction in hanger 9 at the Four Corners Regional Airport. The fire dept. and the gas company turned off the gas to the building until we could get the heater repaired. To turn the gas back on we have to do a pressure test to ensure there are no leaks. We found that we do have leaks and that some of the gas line is behind blown on insulation and is inaccessible to evaluate. At this point the most feasible action is to replace the gas line. We feel this is an emergency as the temperatures are supposed to dip into the teens and low twenties early next week. The building has fire suppression systems which we cannot allow to freeze. Due to the building classification we cannot have ignition sources at the ground level so portable temporary heaters are not an option.

The existence of the emergency condition creates an immediate and serious need for services cannot be met through normal procurement methods and the lack of which would seriously threaten:

1. The functioning of government;

2. The preservation or protection of property; or

3. The health or safety of any person.
