About this file

This document is a Written Determination memorandum from the City of Farmington Central Purchasing Office regarding an emergency procurement to replace a damaged gas line at the Four Corners Regional Airport. Due to a malfunction in a gas-fired radiant heater, the fire department and gas company were forced to shut off gas to Hangar 9, creating an immediate need to repair the gas lines to prevent the building's fire suppression systems from freezing in cold temperatures. Given the emergency nature and safety concerns, the City determined the normal procurement process could not be followed, and awarded a $28,000 one-time contract to M & R Plumbing & Heating to immediately replace the damaged gas lines and restore heating to the hangar.

The memo provides the required statutory information for this emergency procurement, including the existence of an emergency condition, the serious threat to the functioning of government, preservation of property, and health and safety, as well as details on the contract award to the selected vendor. No additional pricing terms, set asides, or funding information is included in the document.

CITY OF FARMINGTON

CENTRAL PURCHASING

INTER-OFFICE MEMORANDUM

TO: Jennifer Rowland, CPO, CPPB, NIGP-CPP Chief Procurement Officer

FROM: Jason Burgert

DATE: November 14, 2024

SUBJECT: Written Determination, NM Statute 13-1-127 Emergency Procurements

Monday morning we had a gas fired radiant heater malfunction in hanger 9 at the Four Corners Regional Airport. The fire dept. and the gas company turned off the gas to the building until we could get the heater repaired. To turn the gas back on we have to do a pressure test to ensure there are no leaks. We found that we do have leaks and that some of the gas line is behind blown on insulation and is inaccessible to evaluate. At this point the most feasible action is to replace the gas line. We feel this is an emergency as the temperatures are supposed to dip into the teens and low twenties early next week. The building has fire suppression systems which we cannot allow to freeze. Due to the building classification we cannot have ignition sources at the ground level so portable temporary heaters are not an option.

The existence of the emergency condition creates an immediate and serious need for services cannot be met through normal procurement methods and the lack of which would seriously threaten:

1. The functioning of government;

2. The preservation or protection of property; or

3. The health or safety of any person.

Contract award details and the required statutory information is below:

1. M & R Plumbing & Heating 1215 Mission Ave Farmington, NM 87401

2. $28,000 – One Time Purchase, Approximate.

3. Immediate replacement of gas lines to repair the leaks found and restore heating to hangar 9 building at the Four Corners Regional Airport 1300 W Navajo St, Farmington, NM 87401.
