About this file

This is a Sole Source Request and Determination Form from the New Mexico Department of Public Safety (DPS) for Drivewyze, LTD to provide Smart Roadways Alerts software upgrades to existing Smart Roadside Inspection Systems (SRIS) at all New Mexico Port of Entries. The scope includes setting up and deploying Smart Roadways Alerts, creating coverage corridors, configuring and deploying reporting dashboard, providing 6 Tableau licenses, and delivering dashboard training. The contract term is for two years.

The contract value is $252,681.76 before tax, with an estimated tax amount of $12,318.24. The sole source justification is based on Drivewyze being the owner of the proprietary SRIS system installed in 2009, and the only entity capable of providing compatible software upgrades. The system currently achieves 94% decode rates for CVSA decal readers, 93% for Hazmat placard readers, 90% detection rate for thermal inspections, and 96% decode rate for truck identification and vehicle matching. The upgrade will enable real-time alerts to commercial vehicle drivers through their electronic logging devices to improve safety and travel time efficiency.

Unexpected Slowdown and Sudden Slowdown Alerts throughout

New Mexico.

Estimated tax amount (tax is subject to change): $12,318.24

Term of prospective contract: 2 years mailto:Marilee.Gallacher@dps.nm.gov mailto:jimmy.rodriguez@dps.nm.gov mailto:mark.savage@drivewyze.com

Note: For terms longer than one year, Request for Policy Exemption from DFA MUST be included.

III. Agency is required to state purpose/need of purchase and thoroughly list the services

(scope of work), construction or items of tangible personal property of the prospective contract (if this is an amendment request to an existing contract, include current contract number issued by SPD):

The Department of Public Safety’s (DPS) New Mexico State Police Commercial Vehicle

Enforcement Bureau (CVE) is requesting to upgrade the existing Smart Roadside

Inspection Systems (SRIS) to include the Smart Roadways Alerts software at all New

Mexico Port of Entries. Contractor will setup and deploy Smart Roadways Alerts, create coverage corridors, configure and deploy reporting dashboard, provide 6 licenses of

Tableau and provide one dashboard training session and reference guide. Follow-up meetings will be scheduled to review performance, answer questions, and discuss continuous improvement efforts and opportunities.

The addition of Smart Roadways Alerts system will integrate the existing SRIS into the commercial truck industry through the Commercial Motor Vehicle’s (CMV’s) electronic logging devices by sending alerts to in-cab devices allowing truck drivers enough time to slow down or change routes. Reducing the risk of crashes and reducing costs associated with crashes or delays, improving safety and increasing travel time.

IV. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

The criteria for performing this work are:

• Knowledge of the proprietary SRIS Systems software installed in 2009;

• Only Drivewyze software can communicate with the Drivewyze SRIS system

• Operations and maintenance support for a single, unified system (SRIS) meeting

DPS requirements and enabling continuity of a critical public safety service;

• Ability to provide 24-hour-per-day, 365-days-per-year hotline support regarding the Smart Roadside solution.

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a

“sole source.”)

Drivewyze is the owner of the SRIS system and is the only entity that can provide this product for their software. Only Drivewyze technicians receive current field change notices and can update the software timely and on a regular basis. Their technicians receive current training as these updates occur, plus undergo an annual recertification process per manufacturer requirements.

VI. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The SRIS system was acquired by DPS for statewide implementation in 2009, at all 15

NM Port of Entry locations. Over that time, the system has been modified to interface with all SRIS instruments used by DPS. SRIS Weigh-in-Motion (WIM) meets American

Society for Testing and Materials (ASTM), Type III, ASTM e 1318 site performance specifications and its integration supports end-to-end SRIS system testing, system adjustments, initial calibration, and scheduled calibration testing.

VII. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.

Procurement of a new Port of Entry system cannot be an alternative to customization of the existing SRIS system. The requirements determination, development, testing, deployment, and training of SRIS were a multi-year activity involving stakeholders from

DPS’ CVE Bureau, New Mexico Department of Transportation (NMDOT), United States

Department of Transportation (USDOT), and the vendor. A break in this service would present a collapse in business and safety continuity.

Currently, the SRIS provides:

• 94% decode rates for automated Commercial Vehicle Safety Alliance (CVSA) decal readers on the trucks;

• 93% decode rates for automated Hazmat placard readers on the trucks;

• 90% detection rate for automated thermal inspections for bad brakes and flat tires on the trucks;

• 96% decode rate for truck identification rates through a combination of automated Automatic License Plate Reader (ALPR) and USDOT readers at highway speeds; and

• 96% vehicle matching for the Vehicle Waveform Identification System tracks a vehicle at every point, from mainline exit to re-entry in the State of New

Mexico.

VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet; contacting similar service providers; and reviewing the State Purchasing

Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact

(telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

No other available solution can meet NM DPS requirements without significant customization, or without introducing risk to continuity of a critical public safety function. Each possible alternative uses different proprietary content and algorithms that would require integration into a suite of authoritative data sources and equipment including a Thermal Inspection System, Automated License Plate Reader, Hazmat

Placard Identification System (HPIS), CVSA Safety Sticker Recognition (SSR), Advanced Lane Controllers, and Vehicle Waveform Identification (VWI).
