About this file
This is a Trench Safety Act Requirement form issued by a Florida county for the Septic Tank Elimination Area 3A-Y fixed contract project. The document establishes compliance requirements for vendors undertaking work involving trenches exceeding 5 feet in depth. Vendors must affirm awareness of and commitment to comply with Florida Trench Safety Act standards (Sections 553.60-553.64, Florida Statutes) and OSHA excavation safety standards (29 C.F.R. Section 1926.650). The completed form must be submitted with the vendor's proposal or within three business days of the county's request, with failure to comply potentially resulting in a nonresponsive designation. The form requires vendors to identify anticipated methods and associated costs for compliance with applicable trench safety standards, including any special shoring requirements if applicable.
Vendors must complete either the Open-end Contract or Fixed Contract section of the form, specifying unit prices and compliance methods for linear feet of trenching work and square footage of special shoring if required. The document does not specify pricing amounts, quantities, or response deadlines within this particular form. The assurance provided by the vendor regarding trench safety compliance is legally binding on all vendor employees and subcontractors. All costs and methods for meeting trench safety standards must be clearly identified and documented as part of the vendor's submittal to demonstrate understanding of and commitment to regulatory compliance before contract award.

TRENCH SAFETY ACT REQUIREMENT
The completed form should be returned with the Vendor’s submittal. If not provided with the submittal, Vendor must submit the form within three business days after County’s request. Vendor may be deemed nonresponsive for failure to fully comply with the stated timeframes.
Florida Trench Safety Act, Sections 553.60 through 553.64, Florida Statutes, incorporates the Occupational Safety & Health Administration (OSHA) excavation safety standards, 29 C.F.R. Section 1926.650, as Florida's own standards. The Trench Safety Act will apply to any individual project that has trenches in excess of 5 feet deep.
The Vendor, by virtue of the solicitation submission, affirms that the Vendor is aware of this Act, and will comply with all applicable trench safety standards, including any special shoring requirements, if applicable. Such assurance shall be legally binding on all persons employed by the Vendor and subcontractors.
The Vendor is also obligated to identify the anticipated method and cost of compliance with the applicable trench safety standards. The Vendor further identified the costs and methods summarized below: (fill in either the Open-end or the Fixed Contract section)
