About this file

This is a sample Bid Bond form for the City of Owensboro, Kentucky, establishing the surety requirements and payment terms for bidders on municipal projects. The bond serves as a guarantee that a bidder will execute the required contract agreement and provide performance and payment bonds if selected. The bond becomes null and void upon three conditions: acceptance of the bid with timely delivery of executed agreements and required bonds, rejection of all bids by the owner, or failure of the owner to issue a Notice of Award within the timeframe specified in the bidding documents or any approved extensions not exceeding 120 days from the bid due date without surety consent. Default occurs when a bidder fails to deliver the executed agreement and required bonds within the time specified in the bidding documents.

Payment under the bond is due within 30 calendar days of the owner's written notice of default and is limited to the penal sum amount stated on the bond's face, which represents the sole and exclusive remedy available to the owner. No legal action may be commenced under the bond prior to 30 days after notice of default is received, and all actions must be filed no later than one year after the bid due date in a court of competent jurisdiction within the project's state. The surety must provide a current Power of Attorney demonstrating the authorized representative's authority to execute and bind the surety to the bond, and all notices must be provided in writing via personal delivery, commercial courier, or certified mail to the addresses listed on the bond face.

5. Surety waives notice of any and all defenses based on or arising out of any time extension to issue Notice of Award agreed to in writing by Owner and Bidder, provided that the total time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from Bid due date without Surety’s written consent.

6. No suit or action shall be commenced under this Bond prior to 30 calendar days after the notice of default required in Paragraph 4 above is received by Bidder and Surety and in no case later than one year after Bid due date.
