About this file
This is a Schedule A Statement of Work document revised from Request for Proposal No. 260000001881 issued by the Michigan Department of Treasury, Unclaimed Property Division, detailing requirements for unclaimed property examination (audit) services. The Department seeks contractors to conduct examinations of entities domiciled in Michigan or with significant Michigan operations, as well as entities located anywhere in the United States that hold unclaimed property subject to the Unclaimed Property Act, Michigan Public Act 29 of 1995. Examinations will be performed at holders' offices where accounting records are maintained or at contractor offices when electronic records are provided. This is a multi-awarded contract pool. The Statement of Work establishes comprehensive examination procedures including contractor-initiated written requests to the State Program Manager for approval prior to examination commencement, execution of Non-Disclosure Agreements with property holders within 90 days of approval, and completion of examinations within three years from NDA signature unless extended by the State Program Manager. Contractors must identify overdue and unreported unclaimed property in accordance with Generally Accepted Audit Standards, provide preliminary examination findings to holders every 30 days, direct property delivery to the Department within 30 calendar days of final identification, and submit final reports in National Association of Unclaimed Property Administrators (NAUPA) format with separate valuation reports for digital assets and securities.
Pricing is firm and fixed for the contract term, with adjustments considered only upon documented evidence of actual contractor cost changes and at the State's sole discretion. Payment occurs via Electronic Funds Transfer upon State Program Manager approval of invoices documenting completed work and deliverables; contractors must allow 45 days from receipt of complete invoices for payment and pay subcontractors timely without awaiting State payment. The contract requires contractors to appoint a Contractor Representative for State inquiries, comply with ADA digital accessibility standards, provide monthly work-in-progress reports by the 15th of each month, and submit SOC 2 Type 2 security audit reports annually at no cost to the State. Service Level Agreement metrics include 100 percent compliance with meeting attendance (with penalties of $100-$500 per non-compliance occurrence), monthly reporting deadlines, and annual security reporting. Liquidated damages of $5,000 plus $100 per day apply for late or improper completion of contract activities. The State reserves the right to terminate examinations if not finished by the completion date and to reauthorize terminated examinations on a case-by-case basis. If contractors utilize subcontractors for more than 20 percent of deliverables, at least 20 percent of subcontracted work must be awarded to Michigan-based Geographically Disadvantaged Business Enterprises unless exemption justification is provided.
