About this file

This is a Release and Indemnity Agreement document for the City of Owensboro, Kentucky, establishing legal protections for the municipality when contractors perform work on city property. The agreement requires contractors to assume full responsibility and liability for negligent acts or omissions by their agents, servants, and employees, and to maintain control over all means and methods used by their workforce. Contractors must comply with all federal, state, and local occupational safety and health laws and regulations while performing duties or activities on city-owned property. The document explicitly states that the City shall not be liable for any loss of life, injury, property damage, or pecuniary loss resulting from the use of city property, facilities, tools, or materials.

The contractor must execute a complete release and indemnity in favor of the City, discharging the municipality from all claims, costs, attorney fees, and judgments arising from contractor negligence or employee misconduct. Additionally, the contractor agrees to indemnify and hold the City harmless from all expenses related to defending any legal action brought against the City, its employees, agents, and officials, and to cover any claims, attorney fees, costs, and judgments established against the City resulting from contractor-related causes. The agreement requires execution by a duly-authorized representative and notarization by a notary public, with blank fields provided for the contractor name, representative signature, dates, and notary credentials. This indemnity agreement appears to be a standard prerequisite document required prior to contract award for demolition services that the City of Owensboro is soliciting.
