About this file

This is a New Mexico Resident Preference Information form applicable to the Gallup-McKinley County Schools' construction, maintenance, and mobile home materials and supplies price agreement solicitation. The document outlines the resident preference certification requirements that bidders and offerors must meet to receive preferential consideration in the evaluation process. Bidders seeking resident preference must submit a valid Resident Preference Certificate issued by the New Mexico Taxation and Revenue Department with their bid or proposal response. The form identifies four categories of eligible preferences: Resident Business/Contractor, Resident Native American Business/Contractor, Resident Veteran Business/Contractor, and Native American Veteran Business/Contractor. Effective January 1, 2012, all Resident Preference Certificates are issued exclusively by the New Mexico Taxation and Revenue Department, and interested parties are directed to contact that department or visit www.tax.newmexico.gov for application information. The submission of a valid certificate is mandatory; failure to include it with the bid response will result in no preference being applied.

The form specifies that preferences are non-cumulative, with each bidder entitled to only one preference classification. For joint bid or proposal submissions involving both resident and nonresident businesses, the resident business preference is reduced proportionally based on the percentage of contract work, measured by dollar amount, that will be performed by the nonresident business partner. Joint proposals require bidders to clearly identify both the resident and nonresident business entities, their respective work scopes, and the percentage of total contract work each will perform. The document provides a structured table format for documenting these joint venture arrangements and clearly establishes that failure to submit required resident preference documentation will disqualify bidders from receiving any preference consideration in the evaluation process.
