About this file

This is a Final Waiver and Release of Lien form prescribed by Florida Statute Section 713.20 for use by the Marion County Board of County Commissioners in connection with the SW 38th Avenue/SW 3rd Street/SW 40th Avenue Resurfacing Project in Florida. The project involves milling and resurfacing of existing roadway, installation and restriping of pavement markings, and sodding of roadway shoulders extending from SW 38th Court to SR 40 (W Highway 40). The form serves as a statutory document that lienors must complete and notarize upon receipt of final payment to waive and release their lien rights for labor, services, or materials furnished to the project.

The waiver form includes a blank field for the final payment amount and requires the lienor to provide their name, address, and signature with notarization before a notary public. Florida law permits lienors to condition the waiver upon clearance of the payment check, rendering the release null and void if collected funds are not received upon deposit. As of October 1, 1996, contractors and suppliers cannot be required to furnish a waiver or release of lien that differs from this statutory form, ensuring standardized documentation for final payment releases on Marion County projects.
