Project Location The Mineral Mountain Mine Closure Project is located roughly 3 miles west of the town of Nederland and 1 mile north of Eldora in western Boulder County on Pomeroy, Mineral, and Eldorado mountains. See the attached location map.

Project Summary The project includes four (4) adits and eighteen (18) shafts/stopes/prospect pits related to the Grand Island - Caribou mining district. Most mines were extracting vein minerals associated with intrusive stocks including silver, lead, gold, zinc, tungsten, and minor amounts of uranium. This is one of the oldest mining districts in Colorado, dating back to the 1860s and still contains active mines.

The features are located in areas that are readily accessible to public using USFS roads and trails, and local landowners who recreate in the area. There is evidence of visitation to many of these sites, increasing landowner worry about possible injuries and liability.

Access to the mine features is generally by rough 4WD roads and will require up to 4 miles of machine walk-in distances. Trailers and haul trucks will not be able to access these locations. Closure methods include machine backfilling, hand backfilling, PUF, CSPs, bulkheads, and monolithic plugs.

Mandatory Pre-Bid Meeting The mandatory pre-bid meeting for the Mineral Mountain Mine Closure Project will be held virtually by telephone/video conference on Wednesday January 21, 2026 at 2 p.m. MT.

Interested parties must pre-register (with name, company, company address, and email address) to attend the virtual pre-bid by contacting TC Wait at TC.Wait@state.co.us by 4 p.m. MT on January 19, 2026. Once you have expressed an interest in the project by registering, you will be emailed specific information regarding the project and details for attending the virtual pre-bid meeting by phone/video conference.

Any CONTRACTOR interested in submitting a bid for the above referenced project must attend the entire virtual pre-bid meeting by telephone/video. Registered CONTRACTORs are strongly advised to review provided information regarding the project prior to the virtual pre-bid meeting to ensure that any necessary questions and clarifications can be addressed by the PROJECT MANAGER. The virtual pre-bid held by telephone/video conference is for the purpose of explaining the work, location, and access. No onsite showing of the proposed project will be provided. The PROJECT MANAGER will record the firms in attendance by requesting the company/individual name, mailing address, phone number and email. Failure to register for and attend the entire virtual pre-bid meeting will be cause for rejection of a bid.

Each individual may represent themselves or a single company at the virtual pre-bid for the purpose of bidding.

All interested bidders must attend. Bidders shall review all Documents including the Meeting Requirements prior to the pre-bid meeting.

Bidders are cautioned that, notwithstanding any remarks or clarifications given at this meeting, all terms and conditions of the contract documents remain unchanged unless they are changed by written amendment issued by DRMS. If the answers to questions, or any amendment to the contract documents create ambiguities, it is the responsibility of the bidder to seek clarification prior to submitting a bid.

Written Inquiries Prospective Offerors may make written inquiries concerning the IFB to obtain clarification of requirements. Inquiries may be submitted to the Single Point of Contact via email by 4 p.m. MT on January 28, 2026.

The preferred method for submitting inquiries is via email with attachments in a PDF or Word format. Please use the bid number in the subject line of the email and include your name, company name, address, and contact information. Inquiries sent by fax or mail service will not be accepted. An amendment containing questions and their answers will be posted on the ColoradoVSS website.

A conflict of interest may include, but is not limited to, access to any non-public information by the Respondent regarding the solicitation or its subject matter.

The Respondent acknowledges that even the appearance of a conflict of interest may be harmful to the State’s interests. In such event the CONTRACTOR shall be liable for any cost of procuring the work which exceeds the amount of the bid, and the bid guarantee shall be available toward offsetting such difference.

Conditions Affecting the Work In addition to examining the drawings and specifications, completion schedule, and other instructions, bidders shall visit the site and take such other steps as may be reasonably necessary to ascertain the nature and location of the work, including average climatic conditions and the general and local conditions which can affect the work or the cost thereof. Failure to do so will not relieve bidders from responsibility for estimating properly the difficulty or cost of successfully performing the work.

Notice of Intent to Award Notice of intent to award will be made with reasonable promptness, by written notice to the low responsive and responsible bidder whose bid meets the requirements and criteria set forth in the IFB. These criteria will include, but not be limited to the lowest Grand Total Price, corrected if necessary for errors in price extension and/or addition, on the Bidder's equipment if a List of Equipment Offered is required with the bid, and capability to meet the performance time requirements. Federal Funding And Regulations Please reference Addendum 2, Additional Terms and Conditions for Federal Provisions on the linked Purchase Order Terms and Conditions or the Federal Funding and Regulations section of the Construction Contract template for Federal Provisions applicable to this project.

Applicant Violator System The successful bidder may be required to submit a completed AML (Abandoned Mine Land) CONTRACTOR Ownership and Control Form and pass a check of the Applicant Violator System (AVS).

Although there are many circumstances under which a bidder might be found "not responsible", any CONTRACTOR who has had direct or indirect association with a firm that has had a permit revoked or a bond forfeited by the Division of Reclamation, Mining and Safety or the Mined Land Reclamation Board will be considered not responsible, and not eligible to be awarded any bid. Any firm listed in the federal Office of Surface Mining's Applicant Violator System or who is not confirmed by the Office of Surface Mining will be considered not responsible.

Davis-Bacon Act The CONTRACTOR shall comply with the wage requirements of the Davis Bacon Act, 40 U.S.C. 3141-3148 as supplemented by the Department of Labor regulations 29 CFR Part 5, and any other applicable federal labor or workplace law. Certified payroll is also known as a Davis-Bacon certified payroll report. Copies of certified payroll forms, WH-347, can be found at: https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/wh347.pdf, and must be submitted to the PROJECT MANAGER on a weekly basis after the Notice to Proceed and the project has begun. Build America, Buy America Act Note: This term is effective as of January 13, 2023. For more information on DOI’s approved waiver, see:

https://www.doi.gov/grants/BuyAmerica/GeneralApplicabilityWaivers.

As required by Section 70914 of the Bipartisan Infrastructure Law (also known as the Infrastructure Investment and Jobs Act), P.L. 117-58, on or after May 14, 2022, none of the funds under a federal award that are part of Federal financial assistance program for infrastructure may be obligated for a project unless all of the iron, steel, manufactured products, and construction materials used in the project are produced in the United States, unless subject to an approved waiver. The requirements of this section must be included in all subawards, including all contracts and purchase orders for work or products under this program.

Recipients of an award of Federal financial assistance are hereby notified that none of the funds provided under this award may be used for a project for infrastructure unless:

1. all iron and steel used in the project are produced in the United States--this means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States;

2. all manufactured products used in the project are produced in the United States— this means the manufactured product was manufactured in the United States; and the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55 percent of the total cost of all components of the manufactured product, unless another standard for determining the minimum amount of domestic content of the manufactured product has been established under applicable law or regulation; and

3. all construction materials are manufactured in the United States—this means that all manufacturing processes for the construction material occurred in the United States.

The Buy America preference only applies to articles, materials, and supplies that are consumed in, incorporated into, or affixed to an infrastructure project. As such, it does not apply to tools, equipment, and supplies, such as temporary scaffolding, brought to the construction site and removed at or before the completion of the infrastructure project. Nor does a Buy America preference apply to equipment and furnishings, such as movable chairs, desks, and portable computer equipment, that are used at or within the finished infrastructure project, but are not an integral part of the structure or permanently affixed to the infrastructure project.

For further information on the Buy America preference, please visit www.doi.gov/grants/BuyAmerica. Additional information can also be found at the White House Made in America Office website: www.whitehouse.gov/omb/management/made-in-america/.

Waivers When necessary, recipients may apply for, and the Department of the Interior (DOI) may grant a waiver from these requirements, subject to review by the Made in America Office.

The DOI may waive the application of the domestic content procurement preference in any case in which it is determined that one of the below circumstances applies:

1. Non-availability Waiver: the types of iron, steel, manufactured products, or construction materials are not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality;

2. Unreasonable Cost Waiver: the inclusion of iron, steel, manufactured products, or construction materials produced in the United States will increase the cost of the overall project by more than 25 percent; or

3. Public Interest Waiver: applying the domestic content procurement preference would be inconsistent with the public interest.

There may be instances where an award qualifies, in whole or in part, for an existing DOI general applicability waiver as described at:

www.doi.gov/grants/BuyAmerica/GeneralApplicabilityWaivers. If the specific financial assistance agreement, infrastructure project, or non-domestic materials meets the criteria of an existing general applicability waiver within the limitations defined within the waiver, the recipient is not required to request a separate waiver for non-domestic materials.

If a general applicability waiver does not already apply, and a recipient believes that one of the above circumstances applies to an award, a request to waive the application of the domestic content procurement preference may be submitted to the financial assistance awarding officer in writing. Waiver requests shall include the below information. The waiver shall not include any Privacy Act information, sensitive data, or proprietary information within their waiver request. Waiver requests will be posted to www.doi.gov/grants/buyamerica and are subject to public comment periods of no less than 15 days. Waiver requests will also be reviewed by the Made in America Office.

1. Type of waiver requested (non-availability, unreasonable cost, or public interest).

2. Requesting entity and Unique Entity Identifier (UEI) submitting the request.

3. Department of Interior Bureau or Office who issued the award.

4. Federal financial assistance listing name and number (reference block 2 on DOI

Notice of Award)

5. Financial assistance title of project (reference block 8 on DOI Notice of Award).

6. Federal Award Identification Number (FAIN).

7. Federal funding amount (reference block 11.m. on DO Notice of Award).

8. Total cost of Infrastructure expenditures (includes federal and non-federal funds to the extent known).

9. Infrastructure project description(s) and location(s) (to the extent known).

10. List of iron or steel item(s), manufactured goods, and construction material(s) the recipient seeks to waive from Buy America requirements. Include the name, cost, countries of origin (if known), and relevant PSC or NAICS code for each.

11. A certification that the recipient made a good faith effort to solicit bids for domestic products supported by terms included in IFB, contracts, and nonproprietary communications with the prime contractor.

12. A statement of waiver justification, including a description of efforts made (e.g., market research, industry outreach) by the recipient, in an attempt to avoid the need for a waiver. Such a justification may cite, if applicable, the absence of any Buy America-compliant bids received in response to a solicitation.

13. Anticipated impact if no waiver is issued.

Approved waivers will be posted at www.doi.gov/grants/BuyAmerica/ApprovedWaivers;

recipients requesting a waiver will be notified of their waiver request determination by an awarding officer.

Questions pertaining to waivers should be directed to the financial assistance awarding officer.
