About this file

This Sole Source Justification and Approval (J&A) document details a federal contract requirement for Haivision and LiveU video streaming and cell bonding equipment. The agency headquarters seeks to expand its inventory by adding two more Haivision MaKto X4 decoders capable of receiving up to four 1080p/60 HD streams or a single full 2160p/50/60 4K UHD stream over IP, with AES encryption capabilities. Additionally, the agency wants to refresh its cell bonding and mobile production equipment with LiveU brand equipment.

The procurement is being pursued as a 100% small business set-aside, targeting authorized Haivision and LiveU resellers on SAM.gov. Market research conducted between March and October 2024 determined these are the only products that can meet the government's specific needs. The justification highlights that no competitive functional replacement products exist, and the agency requires these specific brands to maintain consistency with existing infrastructure, ensure interoperability with partner organizations, and continue receiving warranty and support coverage. The contracting officer will make a final determination of fair and reasonable pricing, and the requirement will be published on SAM.gov for potential vendor responses.

(Source Selection Information - See FAR 2.101 and 3.104) and high-quality video delivery. Haivsion is widely recognized for its SRT protocol, which ensures reliable performance even over unpredictable networks. By standardizing on one vendor, will maintain consistency in workflows, compatibility across devices, and simplified management, while also ensuring strong vendor support and updates. current infrastructure for video over IP streaming is Haivision.

LiveU is the proposed brand name manufacturer. This requirement is for proprietary products and no competitor functional replacement products exist in the market at this time to meet the Government’s need. We are choosing LiveU equipment to ensure interoperability and consistency with partner organizations that already use the same platform. By aligning with their technology, we can streamline collaboration, simplify training and support, and maintain compatibility across shared operations.

(3) Impact. If does not procure Haivision warranty and support coverage for any of its equipment, will be unable to get needed software updates for all of it’s equipment as well as 24/7 support from Haivision for any technical problems that may arise. Additionally, if does not procure LiveU, we risk losing compatibility with partners, creating inefficiencies for our teams, and driving up long-term costs because alternate solutions may require extra equipment or processes, driving up-long term expenses.

6. CONTRACT OPPORTUNITIES ANNOUNCEMENT/POTENTIAL SOURCES: In accordance with FAR 5.102(a)(6), this brand name justification and the solicitation of this requirement will be published on the SAM.gov website. All vendor responses to the notice received within the time limit will be considered.

7. DETERMINATION OF FAIR AND REASONABLE COST: The contracting officer will make a final determination of fair and reasonable price based on competition among OEM’s (if applicable) authorized service providers and comparison with the independent government cost estimate.

8. MARKET RESEARCH: engineers attended the Satellite Expo 2024 at Washington DC and National Association of Broadcasters (NAB) 2024 in Las Vegas, NV. The Requirements team was able to talk to multiple vendors and manufacturers in reference to different cellular bonding and video distribution technologies. Discussions with potential vendors indicated there are at least two (2) small business capable of fulfilling this requirement. All companies from market research have been verified in System for Award Management.

In accordance with DFARS 208.74 and PGI 208.7403, a search was conducted on DoD Enterprise Software Initiative (ESI) to determine if the required Haivision products were available through the DoD inventory or on enterprise software agreements (ESAs), and there were no Haivision and LiveU products available to fulfil the requirement. Additionally, market research was conducted via Government-Wide Acquisition Contracts and NASA SEWP, but a

Page 4 of 6 Pages search did not yield anything related to the purchase of the equipment required to fulfill this request. A search was conducted within the ICD database for Cellular bonding end video streaming equipment, and no results were found that matched our criteria.

Based on current market research, dated March – October 2024, it has been determined that only the aforementioned brand-name encoders/decoders provided by Haivision and LiveU, can fully meet the Government’s need. This requirement is for proprietary products and/or product support and no competitor functional replacement products exist in the market at this time to meet the Government's need. The recommendation is to compete this requirement as a 100% small business set-aside to authorized Haivision and LiveU resellers on SAM.gov.

9. OTHER SUPPORTING FACTS: N/A

10. LISTING OF INTERESTED SOURCES: None. When market research was conducted, no other sources expressed interest in this requirement. As stated in Para. 6 above, a combined synopsis/solicitation will be published.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History. In FY 18, procured encoder, decoders, media gateways and support for all Haivsion products.

(b) Actions to Remove Barriers. will issue a Request for Information (RFI) or Sources Sought Notice to gather data from vendors. This helps identify new and emerging products that could meet the requirement and informs the industry that the agency is moving towards competition, or (2) Evaluate "brand name or equal" products: Thoroughly evaluate any "equal" products offered by vendors to see if they meet the agency's salient (essential) characteristics versus going with the specific brand name.
