About this file
This is a Certification of Noninvolvement in Prohibited Activities in Russia or Belarus required by the State of New Jersey (N.J.S.A. 52:32-60.1, et seq., L. 2022, c. 3) for any vendor seeking to enter into or renew a contract with a State agency for the provision of goods or services, or the purchase of bonds or other obligations. The certification form requires vendors to complete mandatory compliance verification by checking the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list and certifying their status relative to Russia and/or Belarus-related activities. Vendors must select one of three certification options: confirming they are not identified on the OFAC list for Russia/Belarus activity, indicating they are unable to certify due to identification on the OFAC list for Russia/Belarus activity, or certifying they are on the OFAC list but their Russia/Belarus-related activity is consistent with federal law, regulation, license, or exemption with detailed explanation required. The form requires completion of vendor contact information, FEIN, authorized representative signature and date, and supporting documentation as necessary.
The Department of the Treasury is authorized to enforce compliance and may impose sanctions, seek compliance recovery, declare parties in default, and pursue debarment or suspension for vendors making false certifications. The definition of "Vendor" under this requirement is comprehensive, encompassing natural persons, corporations, partnerships, governmental entities, multilateral development institutions, and any parent, successor, subsidiary, or entity under common ownership or control with specified entities. This certification requirement applies to all State of New Jersey contracts and is effective as of the revision date of January 22, 2024.
