About this file

This document is an Attachment Supplement to Exceptions for Solicitation No. BPM004453, issued by the State of Arizona's Department of Child Safety (DCS), Office of Procurement & Contracts. The document involves International Business Machines Corporation (IBM) and pertains to DCS IT Maintenance and Operations Services. The attachment contains a series of conformance statements and detailed exceptions to various sections of the solicitation, including Instructions to Offerors, Scope of Work, Pricing, and Contract Terms and Conditions.

The contract covers IT maintenance and operations services, with IBM proposing minor modifications to insurance requirements, indemnification clauses, warranty of services, and pricing adjustment terms. Key pricing provisions include honoring initial contract prices for one year after award, allowing price increase requests 45 days before contract year end, and requiring documented justification for any price increases based on unpredictable cost changes. The document outlines specific insurance coverage requirements, liability limitations, and first-party liability caps, with IBM seeking clarification and slight adjustments to certain contract language. The solicitation appears to be for comprehensive IT support services with detailed risk management and pricing flexibility provisions.
