About this file

This document is Appendix G to a Delaware Department of Education contract solicitation for Kitchen Equipment Preventative Maintenance and Repair Services supporting the School Nutrition Program (SNP). The SNP comprises five sub-programs: the National School Lunch Program, School Breakfast Program, Special Milk Program, After School Snack Program, and Fresh Fruit and Vegetable Program (FFVP). The appendix establishes compliance requirements for contractors providing services or goods to schools and agencies utilizing SNP funding. The document does not specify quantities, response dates, due dates, site visits, bidders' meetings, award dates, or contract terms and renewal options, as it functions as a regulatory attachment rather than a detailed solicitation notice.

The appendix imposes multiple federal compliance obligations on contractors, including Buy American provisions requiring product options meeting 7 CFR 210.21(d) standards (commodities produced in the United States or final food products processed in the United States using at least 51 percent domestically produced agricultural commodities). For contracts exceeding $100,000, contractors must comply with the Contract Work Hours and Safety Standards Act, providing overtime compensation at 1.5 times the basic rate for hours over 40 per week and maintaining safe working conditions. Contracts exceeding $150,000 must demonstrate compliance with the Clean Air Act and Federal Water Pollution Control Act. Additional requirements include the Byrd Anti-Lobbying Amendment certification, Resource Conservation and Recovery Act compliance for environmentally responsible procurement, preference for products produced in the United States, immediate notification of debarment or suspension status, and USDA nondiscrimination standards. No pricing information, set-asides, incumbent contractor details, or funding amounts are specified in this compliance appendix.

Work Hours and Safety For contracts in excess of $100,000 the Contractor agrees to comply with the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708) parts 3702 and 3704, as supplemented by the Department of Labor regulations (29 CFR Part 5):

a) Per 40 U.S.C. 3702 of the Act, each contractor is required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided the worker is compensated at a rate of not less than one and a half time the basic rate of pay for all worked in excess of 40 hours in the work week.

b) Per 40 U.S.C. 3704 no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous, or dangerous.

c) Contractor is responsible for compliance by any subcontractor or lower tier subcontractor with the clauses set forth in this agreement.

d) These requirements to not apply to the purchases of supplies or materials or articles ordinarily available on the open market.

Environmental Compliance Contractor agrees to comply with all applicable standards, orders or regulations pursuant to the Clean Air Act (42 U.S.C. 7401-7671q) and the Federal Water Pollution Control Act (33 U.S.C.

1251-1387) as amended where the contract exceeds $150,000. Contractor agrees to report violations to the Contracting Officer who will notify the Federal awarding agency and the Regional Office of the Environmental Protection Agency.

Anti-Lobbying Pursuant to the Byrd-Anti-Lobbying Amendment (31 U.S.C. 1352), the Contractor agrees to file required certification that it will not, has not used Federal appropriated funds to pay any person or organization for influencing or attempting to influence an office or employee in connection to obtaining this contract. The certification form can be found at: https://www.state.gov/key-topics-bureau-of-democracy-human-rights-and-labor/lobbying-disclosure-and-certification/. The certification form is incorporated in this Attachment and is required if the Contractor will be providing goods or services under the SNP.

Conservation of Resources The Contractor agrees to opt for those products and services that conserve natural resources, protect the environment, and are energy efficient by complying with and facilitating compliance with Section 6002 of the Resource Conservation and Recovery Act, as amended, 42 U.S.C. § 6962, and U.S. Environmental Protection Agency (U.S. EPA), “Comprehensive Procurement Guideline for Products Containing Recovered Materials,” 40 C.F.R. part 247.

Produced in the United States The Contractor shall, as appropriate and to the extent consistent with the law, opt for the purchase, acquisition, or use of goods, products, or materials produced in the United States (including but not limited to iron, aluminum, steel, cement, and other manufactured products).

“Produced in the United States” means, for iron and steel products, that all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States.

“Manufactured Products” means items and construction materials composed in whole or in part of non-ferrous metals such as aluminum, plastics and polymer-based products such as polyvinyl chloride pipe; aggregates such as concrete, glass, including optical fiber; and lumber.
