About this file
This is an Affirmative Steps compliance document issued by Letcher County Fiscal Court in Kentucky, outlining requirements for contracting with small and minority businesses, women's business enterprises, and labor surplus area firms in accordance with 2 CFR 200.321. The document applies to the 404 Buyout Demolition RFB - Round 5 program and establishes mandatory affirmative action procedures that contractors and subcontractors must follow when soliciting qualified enterprises. These procedures include placing qualified enterprises on solicitation lists, assuring that enterprises are solicited when they are potential sources, dividing total requirements into smaller tasks or quantities when economically feasible to permit maximum participation, and establishing delivery schedules that encourage participation by such enterprises.
The affirmative steps requirement directs contractors to utilize the services and assistance of organizations such as the Small Business Administration and the Minority Business Development Agency of the Department of Commerce to facilitate outreach and engagement with disadvantaged business enterprises. This compliance framework applies to the related title search and closing services contract for one property participating in the 2022 Federal Emergency Management Agency Home Buyout Program, ensuring that qualified minority-owned, women-owned, and labor surplus area firms have equitable opportunities to participate as prime contractors or subcontractors on federally funded projects administered by Letcher County.
