About this file

This is a Drug-Free Workplace Affidavit document required for the Letcher County, Kentucky invitation for bid regarding title services for a property participating in the 2022 Federal Emergency Management Agency (FEMA) Home Buyout Program. The affidavit establishes mandatory drug-free workplace requirements that responding firms must certify they have implemented. Bidding firms must demonstrate compliance with six specific requirements: publishing a statement prohibiting unlawful manufacture, distribution, dispensing, possession, or use of controlled substances in the workplace; informing employees about the dangers of drug abuse and company policy regarding drug-free workplace standards; distributing the drug-free workplace statement to each employee engaged in providing the commodities or contractual services under bid; notifying employees that compliance with the drug-free workplace terms is a condition of employment on the contract and requiring notification of any controlled substance law convictions or guilty pleas within five business days; imposing sanctions or requiring participation in drug abuse assistance or rehabilitation programs for convicted employees; and making a good faith effort to maintain a drug-free workplace through implementation of these provisions.

The affidavit serves as a compliance certification mechanism for the bidding process and does not contain pricing information, set-asides, funding amounts, or other financial terms. Rather, it functions as a prerequisite attestation of workplace safety policies that responding firms must acknowledge and commit to maintaining throughout the contract period for the title search and closing services on the FEMA buyout property.
