About this file

This is a U.S. Coast Guard Justification for Other Than Full and Open Competition document for a commercial products and services procurement at or below the Simplified Acquisition Threshold (SAT), issued under FAR 12.102(a) and FAR Class Deviation 25-21 Rev. 1.

The Coast Guard is procuring Annual Maintenance and Support (AMS) services from CMLabs USA Inc. (UEI: QZBYYVBE3F23, located at 4700 Millenia Blvd, Suite 175, Orlando, FL 32839-6015) for WLM (Coastal Buoy Tender) and WLB (Seagoing Buoy Tender) simulator systems at USCG Base Portsmouth, Virginia. The procurement requisition number is 61200PR260058497, with an estimated total value including options over the micro-purchase threshold but not exceeding the SAT. The justification type selected is "Only One Source Is Available," as GlobalSim | CM Labs is the Original Equipment Manufacturer (OEM) that performed the 2023 system upgrade and possesses exclusive proprietary software rights, source code, and technical data necessary to provide bug fixes, unlimited remote technical support, and component warranty coverage. Market research and formal vendor documentation (Proposal #2026-P004721) confirm sole-source status. The rationale notes that procuring these services through third-party vendors would void existing hardware/software warranties, require impractical reverse-engineering with substantial cost duplication, and introduce unacceptable delays to critical cutter and seamanship training pipelines. Fair and reasonable price determination methods employed include market research, comparison of proposed price with prices found reasonable on previous purchases, and comparison to Independent Government Cost Estimate (IGCE).

THROUGH YOUR MARKET RESEARCH TO SUPPORT THE JUSTIFICATION TYPE:

Market research and formal vendor documentation (Proposal #2026-P004721) confirm that GlobalSim | CM Labs is the sole source capable of providing the required Annual Maintenance and Support (AMS) for the WLM and WLB simulator systems at USCG Base Portsmouth. As the Original Equipment Manufacturer (OEM) responsible for the 2023 system upgrade, GlobalSim possesses exclusive proprietary software rights, source code, and technical data necessary to deliver bug fixes, unlimited remote technical support, and component warranty coverage. Procuring these services through any third-party vendor is impractical, as it would void existing hardware/software warranties, require unfeasible reverse-engineering resulting in substantial duplication of cost, and introduce unacceptable delays to critical cutter and seamanship training pipelines.
