IDENTIFICATION OF STATUTORY AUTHORITY

This acquisition is conducted under the authority of Section 201 of the Federal Property and Administration Act of 1949 (40 U.S.C. 501). The circumstances and rationale for restricting consideration of contractors is FAR 6.302-1, “only one responsible source and no other supplies or services will satisfy agency requirements.”

DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

THE NATURE OF THE ACQUISITION REQUIRE THE USE OF THE AUTHORITY CITED

FAR 6.302-1 allows restricting consideration of contractors whenever the supplies or services required by the agency are available from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements.

In a memorandum dated September 25, 2020, the customer stated the following:

1. The Supply Branch of the USAGJ supports five (5) major facilities on the main Japanese island of Honshu. These facilities include: Camp Zama, Yokohoma North Dock, Sagami General Depot, Akizuki / Kawakami Ammunition Storage Area, and Hiro Ammunition Area. These facilities contain critical international response assets for the western Pacific region. Each of these facilities are geographically dispersed to an extent that requires independent facility support infrastructure.

2. The USAGJ area of operation is subject to numerous natural disasters including frequent earthquakes, landslides, flooding, and annual typhoons. Less frequent but within our support requirement are major snowfalls, tsunamis, and volcanic activity.

Additionally, much of the underground utility system is approaching 50 years old with some infrastructure dating back to pre-WWII era.

3. The USAGJ is authorized five (5) backhoe/loaders to support Honshu. The backhoe/loaders would be used for underground utilities repair, road clearance, debris removal, flood control support, and as a multi-purpose platform for special attachments. USAGJ has six (6) backhoe/loaders on hand with only one (1) operational. The current on hand equipment consists of three (3) Unimog (no longer manufactured), two (2) CASE, and one (1) John Deere backhoe/loaders Currently the USAGJ is renting this equipment capability when required. In the midst of a natural or manmade disaster, renting equipment may result in significant ramification for security, availability, cost, and international relations.

4. Maintenance support for USAGJ equipment must be carefully considered in any equipment purchase. Parts availability, supply chain accessibility, mechanic familiarity with equipment, vendor responsiveness and service call costs are the main considerations to maintenance support in Japan. Our overall construction equipment fleet consists of CASE, John Deere, Kubota, Caterpillar, Unimog, and Bobcat. Of these, CASE, John Deere, and Kubota are the manufacturers of our current, overall general construction equipment fleet. The lines of supply and maintenance support for these three manufacturers are well established and would not require establishing new lines of parts supply and support within Japan.

DETERMINATION BY THE CO THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL

BE FAIR AND REASONABLE.

As was previously stated, in accordance with FAR 6.302-1, competition will be limited to Backhoes manufactured by CASE, John Deere, and Kubota. However, among vendors carrying these items, competition will be promoted to ensure fair and reasonable pricing.

The Contract Specialist will conduct price analysis techniques in order to substantiate the price reasonableness of the items requested in the award decision document. This includes comparing the proposed award price with pricing received from other vendors in response to the RFQ, as well as making direct and indirect price comparisons to the same and similar commercial items.

IAW FAR 5.2, the Contracting Officer will synopsize and post the solicitation and Justification for Other Than Full and Open Competition to BetaSAM.

DESCRIPTION OF THE MARKET RESEARCH CONDUCTED

The Contract Specialist sent out a Sources Sought to a number of GSA vendors. No responses were received from any vendors carrying a CASE or Kubota Backhoe Loader. Therefore, the Contract Specialist determined that an Open Market procurement would be the best course of action, as this would allow for competition among multiple vendors carrying items from the aforementioned manufacturers.

DESCRIPTION OF ANY OTHER FACTS SUPPORTING THE JUSTIFICATION

Please see DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED for details.

STATEMENTS OF ACTION TO OVERCOME BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION

See DESCRIPTION OF THE MARKET RESEARCH CONDUCTED for details.

CONTRACTING OFFICER CERTIFICATION

The contracting officer has determined that the actions taken under this acquisition meet the conditions described in FAR 6.302-1. Based on the circumstances described in this document, it is in the best interest of the Government to solicit quotes only from vendors carrying Backhoe Loaders manufactured by CASE, John Deere, and Kubota.

The information contained in this Justification for Other than Full and Open Competition for this acquisition is accurate and complete to the best of the Contracting Officer’s knowledge.
