TCCC – FAR 52.212-1 Tailored Instructions to Offerors- Commercial Items General Instructions to Offerors. This is an all-electronic solicitation release. No hard copies of the solicitations will be mailed. Amendments to the solicitation will be posted to www.beta.sam.gov. It is the responsibility of each offeror to review the webpage for notice of amendments, updates, or changes to current information. The exclusive responsibility for the source selection will reside with the Government. Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C. 423) as implemented in the FAR. Each offeror is limited to one proposed solution to the solicitation requirement, alternate, multiple proposals are not permitted. Failure to comply with these instructions may result in an offeror’s proposal being excluded from further consideration for award. The request for proposal and corresponding attachments will be unclassified and treated as Source Selection Sensitive Information. Proposal shall not contain classified information. This requirement is set aside for Small Businesses in accordance with (IAW) FAR clause 52.219-6. Proposals received from concerns that are not Small Business concerns will not be considered.
1.1. All proposals must be complete, self-sufficient, and respond directly to the requirements of the solicitation. Any commitments made in the proposal shall become part of the resultant contract. Any significant inconsistency, if unexplained, raises a fundamental issue of the offeror’s understanding and/or ability to perform under a contract. This may be a basis for rejection of the proposal. It is not desirable for the offeror to simply restate or rephrase the Government’s requirements; similarly, for example, it is not desirable for the offeror to generically state the offeror’s capability, approach, etc., to all solicitations for commodities/services. Rather, the offeror’s proposal is expected to contain sufficient details and correspond to the specific requirements in the SOW as applicable under the respective evaluation criteria below. An offeror’s failure to provide adequate details may result in exclusion from further award consideration or the Government assigning levels of weakness, thus increased risk, to the offeror’s proposal. Failure to comply with these instructions may result in an offeror’s proposal being excluded from further consideration for award. Offerors shall submit with their proposal a list of names and telephone numbers of persons authorized to conduct negotiations.
1.2. The evaluation will consist of an evaluation of the Qualifying Criteria and Factors 1-3, Technical, Past Performance, and Price as outlined below. The Government reserves the right to award without discussions. However, after completion of the evaluation, the Government may establish a competitive range and conduct discussions. The Government reserves the right for efficiency purposes to only include the most highly rated proposals in the competitive range. The Government intends to award one contract as a result of this solicitation. The responses shall consist of four (4) separate volumes; Volume I – Qualifying Criteria, Volume II Technical, Volume III – Past Performance, and Volume IV – Price.
1.3. Government Point of Contact (POC). Exchanges of source selection information between Government and Offerors will be controlled by the Senior Contracting Officer (SCO). Offerors are responsible for ensuring receipt of any communication by the designated officials. Verification of receipt of communications will be done via email. Questions and written requests for clarification shall be done via email only to both POCs. POCs are:

1.4. Minimum Proposal Acceptance Period. The term “acceptance period,” as used in this provision, means the time period available to the Government to award a contract from the date specified in this solicitation for receipt of proposals. The Government requires a minimum acceptance period of 120 calendar days from the date of receipt of offers. Offerors may specify a longer acceptance period than the Government's minimum requirement.
1.5. Potential Errors. If an Offeror believes requirements in these instructions contain an error, omission, or are unsound or ambiguous, the Offeror shall immediately notify the SCO in writing via email with supporting rationale.
1.6. Electronic Reference Documents. All referenced documents for this solicitation are available on the Beta-Sam website at https://beta.sam.gov. Potential Offerors are encouraged to subscribe for e-mail notifications to be updated when information has been posted to the website for this solicitation.

The hard copy proposal shall be delivered with the following legend marked on the front of the outer packaging: “PROPOSAL FOR GSA ID04200024, DO NOT OPEN MAIL/PACKAGE.” Offerors shall label each hardcopy with separate identifiers, such as “Hardcopy A, Hardcopy B,.”
Hard copy proposals are to be received by the RFP closing date/time. Hand deliveries are acceptable at the same location as the mailing address. Any proposal received by GSA after the RFP closing date and time is late and shall not be considered for award. In the event of any discrepancy in content between the electronic version and hardcopy version, the electronic version shall control and take precedence. The hardcopy versions of the proposal are also required to be submitted for the Government. Failure to receive the hardcopy versions before the deadline for proposals shall be deemed a material failure by the offeror and the order proposal shall be rejected and ineligible for award because the Government has determined that adhering to the evaluation schedule is essential.
1.8 Electronic Submission Procedures
Proposals shall be submitted electronically in the required file formats within the GSA AASBS Portal. Electronic proposals for this solicitation will only be received via the AASBS Portal. 3.2.3.3 Provide the methodology used to establish proposed Student-to-Instructor ratios, training plans, and associated deliverables based on the predetermined course sizes and requirements provided in the SOW.
3.2.3.4 Provide a complete staffing/skill (job classification)/manpower matrix to accomplish service requirements, including plans and rationale for personnel utilization (full-time, part-time, temporaries, personal time off, leave, sick leave, Guard/Reserve duty, etc.) and duties for all personnel the Offeror plans to employ.
3.2.3.5 Provide an approach for limiting employee turnover and sustaining trained, qualified, and technically capable personnel throughout the life of the contract.
3.2.4 Subfactor 3- Quality Control Plan: This subfactor assesses the Offeror’s approaches and processes to effectively measure, track, analyze, report, and implement corrective actions. Details shall include: capability and capacity (either in-house or partnership), inventory ordering/delivery network, and test/inspection capability and capacity (either in-house or partnership). The offeror’s layout shall indicate whether the production facility will be dedicated solely to TCCC or if the production facility will be shared. Deliveries of all items listed in the LOM are required within 120 days after receipt of delivery order.
3.3 VOLUME II – PAST PERFORMANCE: (FACTOR I)
3.3.1 General Information. Each Offeror shall submit a past performance volume with its proposal. The past performance volume shall be prepared IAW all instructions contained within this Section. Each Offeror’s proposal will be evaluated IAW the evaluation criteria identified Part e Evaluation of Commercial Items (Oct 2014, Tailored). Pages in excess of those allowed will not be considered for evaluation. Volume II shall contain the following:
3.3.1.1 Volume Organization. The past performance volume shall be organized according to the following general outline:
i. Summary Page the role of the offeror and each subcontractor, teaming partner, and/or joint venture partner for which the offeror is required to provide Past Performance Information Sheets.
ii. Past Performance Information Sheets (PPIS)
iii. Specific Content
iv. Organizational Structure Change History (Not included in page count)
v. Client Authorization Letters by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information so the offeror can respond to such information. (Not included in page count)
3.3.1.2 Summary page. Describe the role of the Offeror and each subcontractor, teaming partner, and/or joint venture partner. Past Performance Information is required for the Offeror and subcontractors, teaming partners, and/or joint venture partners that will perform major or critical aspects of the requirement when such information is relevant to the acquisition. Offerors are cautioned that the Government will use data provided by each Offeror in this volume and data obtained from other sources in the evaluation of past performance.
3.3.1.3 Past Performance Information Sheets (PPIS). Submit information on contracts considered most recent and relevant in demonstrating the ability to perform the proposed effort. The offeror shall submit three (3) PPIS identifying active or completed contracts/task order by the prime contractor or subcontractor, either Government or commercial that the Offeror considers most recent and relevant to this acquisition; demonstrating ability to perform the proposed effort. An offeror cannot submit the same contract or non-competitively awarded delivery/task order to account for more than one submission. The offeror, at a minimum, must be the prime in at least one (1) of PPIS submitted. “Recent” is defined as ongoing contracts or those completed within four (4) years of the date of issuance of the solicitation. Efforts that are determined to be outside the bounds of recency may not be further evaluated. PPIS for each contract is limited to four (4) pages. Include rationale supporting the Offeror’s assertion of relevance (“relevant” is defined as similar in scope/requirements). For a description of the characteristics or aspects the Government will consider in determining relevancy, reference Section 3.3.2 and the PPQ (attachment 9). The following may be provided as part of the PPIS: Quality and satisfaction rating for contracts completed in the past four years, e.g. Contractor Performance Assessment Reports (CPARs), letters, metrics, customer surveys, independent surveys, etc., which demonstrates customer satisfaction with overall job performance and quality for relevant contracts. The Government requests the offeror provide references including current POCs for /each contract identified. Contact information for each POC and reference shall include both a current phone number and e-mail address. The Government may collect additional references from other sources during the evaluation of past performance.
3.3.1.4 Specific Content. Offerors shall submit information on contracts that are considered relevant in demonstrating the ability to perform the proposed overall effort in the PPIS. The Offeror is required to explain what aspects of the past/current contracts are deemed relevant to the proposed effort and to what aspects of the proposed effort they relate. Applicable information for each contract shall include the following:
1. Identify if the effort was/is for Government and/or private industry
2. Company Being Assessed
3. Contract Title
4. Contract #
5. Description
6. Award Amount
7. Total Contract Value
8. Contract Type
9. Award Date
10. Point of Contact (POC)
11. Phone Number POC
12. Email POC
13. Deliver Date/ Period of Performance
14. Place of Performance
15. Key Subcontractors
16. Offerors shall submit information on contracts that are considered relevant in demonstrating the ability to perform the proposed overall effort in the PPIS. PPIS shall include specific information for each effort regarding experience IAW the following areas outlined below. NOTE: If the experience in the following areas was not required under the referenced contract, the offeror shall also indicate that it was not applicable or relevant on the PPIS. Offerors should clearly show:
a. Provide a brief narrative for each contract or subcontract listed. Explain the nature of the work involved and the extent the work involved was/is similar to the TCCC effort in terms of operations, contract scope, schedule, and risk.
b. Management of the major functional requirements as outlined under the SOW specifically, program management, subcontractor management, assembly, delivery, spiral development and training.
c. Information on problems encountered on contracts and the offeror's corrective actions. This may include a discussion of efforts accomplished by the Offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. Merely having problems does not automatically equate to a “No Confidence” rating, since the problems encountered may have been on a more complex program, or an Offeror may have subsequently demonstrated the ability to overcome the problems encountered. The Offeror is required to clearly demonstrate management actions employed in overcoming problems and the effects of those actions in terms of improvements achieved or problems rectified. For example, submittal of quality performance indicators or other management indicators that clearly support that an Offeror has overcome past problems.
3.3.1.5 Organizational Structure Change History. Companies may have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. If such changes have taken place during the recency period of relevant past performance efforts submitted, provide a proposal volume a "roadmap" describing all such changes in the organization of your company. A pamphlet or other commercial document describing such reorganizations may suffice. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government may consider past performance information provided by other sources as well as that provided by the Offerors, your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources. There is no page limit applied to Organizational Structure/Change History; however, the Offeror is requested to limit the number of pages to the minimum required to clearly articulate the pertinent information.
3.3.1.6 Subcontractor Letters of Consent. Past performance information pertaining to a subcontractor cannot be disclosed to the prime Offeror without the subcontractor’s consent. Proposals must include a Subcontractor Consent Letter executed by each subcontractor, teaming partner, and/or joint venture partner, that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
3.3.1.7 Past Performance Questionnaires (PPQ) (See Attachment 9). The Government will evaluate the quality and extent of the Offeror’s performance deemed recent and relevant to the requirements of this RFP. The Government will use information submitted by the Offeror and other sources such as other Government offices and commercial sources, to assess performance. Offerors shall send the questionnaire (Attachment 9) to references on no more than three (3) contracts identified in their PPIS. The completed questionnaires are requested to be received no later than 30 calendar days after issuance of this solicitation. The responsibility to send out the PPQs and ensure receipt by the Government rests solely with the Offeror. Ensure the POC provided is available and knowledgeable of the services/supplies provided under that contract in order to facilitate efficient follow ups as deemed necessary. Completed PPQs shall be sent by the reference directly to the Government POCs identified in the PPQ form. It is highly recommended that Section 1 of the PPQ be pre-filled by the Offeror prior to sending to respondent. Once submitted, the information contained therein shall be considered source selection sensitive and shall not be released to the Offeror. The Government shall bear no responsibility or obligation for distributing, seeking, or following up with POCs about any PPQs. An Offeror’s failure to ensure that the Government receives all of the fully completed PPQs from the POCs by the RFP closing date will not result in the Offeror’s proposal being rejected, but may result in the Government assigning increased doubt in the rating of the offeror the past performance factor.
3.3.1.8 Relevancy will be determined based on contract references reflecting past performance over the past four (4) years. Relevancy is defined as contracts that are most similar to this overall effort. Some of the factors in determining relevancy include: similarity of procurements, assembling, performing quality assurance/control, NET Training, duration and magnitude of past efforts (i.e. quantities, contract value). The more the overall effort is similar in all areas, the more relevant it becomes.
3.3.2 When making the relevancy determination the definitions contained within Table 3 below will be utilized:
Table 3 Relevancy Criteria Table
Very Relevant (VR)
Past Performance effort involved essentially the same scope of effort and complexities this solicitation requires For the purpose of this solicitation, past performance as a prime contractor in the execution in delivering medical/rescue sets, kits, outfits, materials, and conducting associated kit implementation/rescue technique training with similarity of procurement as listed in 3.3.1.8

3.4 VOLUME IV- PRICE (FACTOR 3)
3.4.1 General Information. The offeror shall submit pricing for all items on RFP Attachment 6, (List of Materials (LOM) and Total Evaluated Price (TEP) Spreadsheet). Offerors shall not re-format or remove cells from the Attachment 6. Submission of the pricing data shall be complete and accurate. Offerors shall submit pricing for all items contained in Attachment 6 for each year. All prices will be provided as a Firm Fixed Price per Section B with one T&M CLIN per ordering period, therefore all proposed prices shall be inclusive of all direct (i.e., direct labor, material, travel, and other direct costs) and associated indirect costs plus fee related to each CLIN. The Contracting Officer has determined there is a high probability of adequate price competition on this acquisition. However, if at any time during this acquisition the Contracting Officer determines that adequate price competition no longer exists then offerors may be required to submit information to the extent necessary for the Contracting Officer to determine the reasonableness of price. Additionally, all information related to pricing shall be included in the section of the proposal defined as “Volume IV Price Proposal.” Under no circumstances should pricing data be included elsewhere in the proposal. Unbalanced Pricing may pose an unacceptable risk to the Government and may be a reason to reject an Offeror’s proposal IAW FAR 15.404-1(g) – Unbalanced Pricing. Offers should be sufficiently detailed to demonstrate reasonableness and balance. Even though price is a substantial factor in source selection, this competition may result in an award to a higher-rated, higher-priced Offeror. However, the significance of price as an evaluation factor will increase with the degree of equality in overall merit of competing proposals in meeting solicitation requirements.
