ADDENDUM TO FAR 52.212-1

INSTRUCTIONS TO OFFERORS: PERIOD OF ACCEPTANCE OF OFFERS FOR

THIS SOLICITATION IS 180 DAYS FROM THE DATE SPECIFIED FOR RECEIPT OF

PROPOSALS. The offeror shall hold the prices in its proposal firm for 180 days from the date specified for receipt of proposals.

SUBMISSION OF QUESTIONS

Offerors are requested to submit questions grouped by solicitation section and make reference to the particular Section/subsection number. Questions must be received before the date specified for receipt of questions.

Submit questions via e-mail to Marcus Sims at jamie.morton@gsa.gov.

Questions Due: March 18, 2019 Proposals Due: June 12, 2019-revised

This section discusses general proposal submission requirements and detailed instructions for formatting the technical and cost proposal. The offeror proposal submitted in response to this solicitation shall be in two (2) separate volumes as described below:

-Volume I – Technical Proposal (1 copy)

Factor 1: Corporate Experience

To be considered technically acceptable under this factor, the Offeror must demonstrate prior experience concurrently managing operation and maintenance for one 12 month (one year) contract, and repairs of at least one office/plant building, with contract values of at least $4,000,000.00 per year each within the last five years.

Operations and maintenance services must have included the following:

• Preventive maintenance

• Repairs

• Energy efficiency program

• A service call program

• Use of a computerized maintenance management system

• Quality control program

For each building, the Offeror shall submit the following information:

• Company name

• Role of company in this prior experience project

• Type of facility

• Project location (address, city, state)

• Annual dollar value of contract

• Description of services provided

• Contract award date

• Date of contract start/completion, mailto:jamie.morton@gsa.gov

[2]

• Name and title of the building’s owner

• Contact information for two individuals with direct knowledge of Offeror’s performance.

Because the prime contractor will be ultimately responsible for managing this effort, Offerors may not substitute subcontractor performance for prime contractor performance. Subcontractors may have been involved in Offeror’s performance as prime contractor, but Offeror must have been responsible for performance.

Factor 2: Past Performance.

To be considered technically acceptable under this factor, at least one reference per building submitted for consideration under Factor 1 must answer the following questions affirmatively:

• Would you contract with this firm again for a similar requirement?

• Was Offeror responsible for operations and maintenance of this building?

• Did Offeror perform acceptably?

• Did the Offeror communicate effectively? Did Offeror generally respond timely to service calls and other complaints?

• Was Offeror generally cooperative?

• Did Offeror observe all required policies and procedures?

• Did Offeror adhere to relevant safety requirements?

• Was Offeror’s staff respectful of the property and building occupants?

• After accounting for a reasonable learning curve, was Offeror competent?

Factor 3: Key Personnel To be considered technically acceptable under this factor, Offeror must provide resumes, qualifications, licenses, and certification for staff proposed to fill the following key personnel positions that meet the criteria in the referenced sections:

(1) Project Manager

(2) Site Supervisor

(3) Master Electrician

(4) CMMS Manager)

(5) Pump Mechanic

(6) Industrial Control Tech

(7) Steam fitter/welder

-Volume II – Price Proposal (1 copy)

52.212-2 Evaluation—Commercial Items (Jan 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Corporate Experience

2. Past Performance

3. Key Personnel

The proposal with the best value meeting or exceeding the acceptability standards for non-cost factors as reflected above and below may receive award as the responsible offeror whose offer conforms to the solicitation and is most advantageous to the government, considering price and the non-cost factors.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

ADDENDUM TO FAR 52-212-2 (EVALUATION - COMMERCIAL ITEMS)

METHOD OF AWARD

The Government anticipates awarding a contract to the offeror whose proposal is the most advantageous to the Government, price and other factors considered. GSA reserves the right to consider as acceptable only those proposals submitted in accordance with all the requirements set forth or referenced in the RFP. In order to fully

[4] assess and evaluate the merits of the submitted proposals, the contracting officer may seek clarifications from offerors.

BASIS FOR AWARD

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines discussions to be necessary.

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

4. Proposals will initially be screened for price and placed in order of price (lowest price to highest price). To ensure sufficient benefits of contract consolidation, The Government will utilize a two-step process to evaluate price:

Step 1 - adding the total price for the Base and all Option Years, excluding any offers that exceed $30 million total for the Base and all Option years.

Step 2 – adding the Additional Services (multiplied by estimated quantities) to the total price including all options to determine the lowest price.

5. The Government will then evaluate the technical factors of the lowest priced proposal. The Government intends to make award to that firm if it is technically acceptable. Accordingly, under this methodology, the technical factors of some proposals may not be evaluated by the Government. If discussions are deemed necessary by the Contracting Officer, all proposals will be evaluated (both technical and price) for the purpose of establishing a competitive range.

6. The Government will make its determination of the acceptability of the Offeror’s proposal meeting the Evaluation Factors described in the RFP. The proposal will be rated as either Acceptable or Unacceptable. The purpose of the Acceptable/Unacceptable rating is to determine the Offeror’s ability to fully meet critical eligibility/performance requirements.

[5]

An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UN-ACCEPTABLE” unless corrected through discussions (if any). An overall non-price factors rating of “UN-ACCEPTABLE” makes a proposal ineligible for award.
