ATTENTION OFFERORS: This notice has been prepared to point out some of the important sections or requirements of this solicitation or to pro-vide you with additional information related to this proposed contract.

Please note that it is not inclusive - you are cautioned to carefully read the entire solicitation in order to be fully aware of all requirements, provisions, and clauses.

GENERAL SERVICES ADMINISTRATION’S MISSION

To provide quality services required by our clients in a timely manner and to ensure the best value to the Federal Government and the public thereby enhancing our clients’ ability to accomplish their mission.

“SHALL” “WILL” and “MUST” Throughout this solicitation, the terms “shall” “will” and “must “ are used. “Shall” “will” and “must” denote the imperative. They indicate an obligation to act. In this solicitation, and any resulting contract, “shall” “will” and “must” have the same meaning.

INFORMATION COLLECTION REQUIREMENTS

The information collection requirements contained in this solicitation/contract are either required by regulation or approved by the Office of Management and Budget pursuant to the Paperwork Reduction Act and assigned OMB Control No. 3090-0163.

SYSTEM FOR AWARD MANAGEMENT (SAM)

All contractors must be active in the System for Award Management (SAM), www.sam.gov, prior to sub- mission of offers to be considered for award. AFFIRMATIVE PROCUREMENT PROGRAM (APP)

GSA has implemented an Affirmative Procurement Program intended to maximize the use of recovered materials, environmentally preferable, and bio-based products. Offerors should familiarize themselves with the requirements for using and reporting on the use of such materials in performance under any resultant contract.

FAR 23.7 requires consideration of environmental factors when purchasing products and services.

FAR 4.303 and FAR 52.204-4 requires double sided printing on recycled paper for all reports required by this contract. FAR 52.223-10 encourages vendors to practice waste reduction.

SAFEGUARDING DOCUMENTS

Associated plans, drawings, or specifications provided under this solicitation are intended for use by prospective quoters/offerors (and their subcontractors and suppliers). In support of this requirement, GSA requires quoters/offerors to exercise reasonable care when handling documents relating to building draw- /plans, security equipment, security equipment installations, and contract guard service, to include:

1) Limiting reproduction and/or dissemination of covered materials only to persons/parties related to this acquisition or otherwise authorized to receive such information;

2) Making every possible effort that is reasonable and prudent to prevent unauthorized disclosure of this information;

3) Upon award and completion of any appeals process, unsuccessful quoters/offerors making every reasonable and prudent effort to destroy or render useless all information/documentation received during the solicitation and/or appeals process; and

4) The awardee continuing the efforts required above throughout the entire term of contract and for what specific time thereafter as may be necessary, as determined by the awardee.

PERFORMANCE BASED SPECIFICATIONS

Note that the service specifications included in this solicitation are performance-based specifications. These specifications express the Government’s requirements in the form of minimum quality standards. Work schedule, frequencies, resources utilized, and methods of performance are to be determined by offerors.

CURRENT CONTRACTOR AND CURRENT CONTRACT PRICE

The current contractor is Thyssenkrupp Elevator Corporation at 114 Townpark Drive suite 300 Kennesaw, GA 30144. The current monthly price is $10,010.00. Although this solicitation is for services substantially the same as the current contract Scope of Work, it should be reviewed carefully before submitting a quote.

CONTRACT TYPE

This is a firm fixed price contract.

BOND REQUIREMENTS

Bid guarantee and bond are not required.

SITE VISIT

Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

CONTRACTOR DATA UNIVERSAL NUMBERING SYSTEM (DUNS) NUMBER.

Enter your DUNS number in Block 17A on the first page of Standard Form 1449. If you do not know or do not have a DUNS number please contact Dun and Bradstreet directly to obtain one. A DUNS number will be provided immediately by telephone at no charge to you. For information on obtaining a DUNS number, you should call Dun and Bradstreet at 1-866-705-5711. Be prepared to provide the following information:

(1) Company name, (2) Company address, (3) Company telephone number, (4) Line of business,

(5) Chief executive officer/key manager, (6) Date the company was started, (7) Number of people employed by the company, (8) Company affiliation.

FAIR LABOR STANDARDS/SERVICE CONTRACT ACT PRICE ADJUSTMENT PROVISIONS

If this is a multiyear service contract or a service contract that may exceed a year in length if options are exercised, offerors should note the price adjustment provisions in Section I of this solicitation.

Do not include any allowance for any contingency to cover increased cost for which adjustments are provided for under the Fair Labor Standards Act and Service Contract Act - Price Adjustment (Multi-year Contract) contained in the CONTRACT CLAUSES section of this contract.

ABOVE STANDARD LINE ITEM PRICING

Reimbursement for emergency call-back, unscheduled overtime, and additional services will only be computed for the man hours performed at the work site.

PRICING OF OPTIONS

Offerors shall price the initial six-month base period and the option requirements for the 4 additional one- year periods by assuming that the minimum hourly wages and fringe benefits established by the Administrator, Wage and Hour Division, U.S. Department of Labor for the initial six-month base period of performance will apply to the 4 additional one-year option periods. The minimum wage rates and fringe benefits applicable to the initial six-month period of performance are outlined on the wage rate sheet.

PROMPT PAYMENT DISCOUNT

Block 12 on the first page of the solicitation and possibly the solicitation pricing page(s), is to be used to offer prompt payment discounts. Payment terms are set forth in the Prompt Payment clause in this solicitation. Offerors are cautioned against inserting any statement that indicates that payment is due sooner than the time stipulated in the Prompt Payment clause. EXAMPLE:

Inserting "Net 20" may cause the offer to be rejected as unacceptable, because the entry would be contrary to the 30-day payment terms specified in the Prompt Payment clause.

OPTION TO EXTEND SERVICES

Offerors should note that Section I of this solicitation includes FAR 52.217-8, Option to Extend Services, which allows the Government the unilateral option to extend the term of any resultant contract up to six months, exclusive of any other option provisions which may be included as part of any resultant contract.

QUALITY CONTROL PLAN (QCP)

The contracting Officer (CO) must accept a completed Quality Control Plan (QCP) within 5 workdays prior to start of contract. The QCP will be specific to the contract specification and location(s) in accordance with the provisions and requirements of the solicitation.

NOTICE TO PROCEED (NTP)

Notice to Proceed (NTP) will NOT be issued until the COR has officially notified the CO that approved clearances for proposed employees have been received and approved.

PRE-QUOTE/PRE-PROPOSAL CONFERENCE

A pre-quote/pre-proposal meeting has been scheduled for this solicitation. Please see the Pre-proposal Conference Notice on the next page for details.

ELECTRONIC SUBMISSION OF PROPOSALS

All quotes must be submitted electronically. Hard-copies will not be accepted. Submit your package to the e-mail addresses listed on the Standard Form 1449: patricia.skinner@gsa.gov.

The entire package – including all forms and attachments – must be received in full in this inbox prior to the proposal due date and time. Due to the large file sizes involved, offerors are encouraged to allow plenty of time for email delivery and not assume that email transmission will happen instantaneously. If multiple emails are required in order to submit, quoters/offerors are encouraged to number their emails clearly in the Subject Line (e.g. “Email 1 of 2”; “Email 3 of 3”;

etc.). All submissions will be acknowledged via email reply. However, the acknowledgment will not verify the completeness or accuracy of quotes/offers.

PRE-QUOTE/PROPOSAL CONFERENCE AND SITE VISIT

(See Also Section L.3) A pre-quote conference is scheduled at the time and place set forth below. All prospective quoters are strongly encouraged to attend. Please complete and return this form via email to Patty Skinner at Patricia.Skinner@gsa.gov no later than Tuesday, November 12, 2019 at 4:30 p.m. Pacific Time. A Site Visit will be held as part of the pre-quote conference.

All four service locations will be toured. Please see the below for guidance and instructions.

TIME/DATE: Tuesday, November 19, 2019 at 9:00 a.m. Pacific Time – Meet at Location 1

We will begin the Pre-quote Conference at Location 1 (Robert Matsui Courthouse, 501 “I” Street Sacramento, CA 95814). Arrive at 9 a.m. at the Rotunda on the first floor. The Building Manger will escort the group to the conference room where we will hold the initial conference which will be followed immediately by the building tour of Location 1.

Following the tour of Location 1, we will proceed approximately 4 city blocks to Location 2 (801 I Street) for a building tour.

Following the tour of Location 2, we will proceed approximately ½ mile to Location 3 (650 Capitol Mall).

Following the tour of Location 3, we will break for lunch and proceed approximately 8 miles (25 minutes) to Location 4 (2800 Cottage Way) for a building tour.

****Conference attendees should note that they are responsible for all travel between the building locations (GSA Staff will walk). Conference attendees are also responsible for locating and paying for parking. Generally speaking, there are public lots and meter parking available near the building locations.

****Conference attendees should bring a photo ID to facilitate getting through federal security.

Working Hours vs Normal Building Operating Hours

Can you clarify the "Normal Working Hours" 7-5 versus "Normal Building Operating Hours" 6-6. Would Overtime be considered outside of the 7-5 "Normal Working Hours" ? Section C.12 references the 6-6 time period for straight time.

SOW revised to omit Normal Building Operating Hours. Normal Working Hours is the same as Straight Time which is between the hours of 6:00 AM and 6:00 PM. Overtime is considered outside 6:00 AM and 6:00 PM.

2 14-Nov-19 SOW C.2 and C.9.1 Testing Will GSA hire a third party contractor, for the 6 month, annual and 5 yr testing under a separate contract? Under the new contract (Section c.2) it looks like this will be included. Correct?

Testing is performed by the elevator contractor whom must supply necessary personnel to support this task. GSA hires 3rd inspectors to witness the elevator contractor perform testing. NCMMS?

Yes, the Contractor is responsible for completing and notating NCMMS generated monthly work orders for the VTE at each building.

The NCMMS is web based; a GSA computer is not necessary to access. The only requirement to access the NCMMS is having a GSA ENT account and proper active directory groups, which can be added through an IT service request submitted by the Contracting Officer's Representative (COR) on the Contractor's behalf. As long as the Contractor maintains their ENT account active, access to the NCMMS program will remain assuming the user logs into the system, at a minumum, every 90 days.

6 22-Nov-19 SOW C.2 Obsolescence The traction elevators at 801 I Street have Motion Control Engineering (MCE) control system with a vintage of drive that has been rendered obsolete by the manufacturer. The manufacturer has provided a formal technical bulletin regarding this product, as well as confirmed that the recommended solution of this drive is to modernize the traction control system. This is in lieu of trying to modify and re-wire this control system to adapt a new supported drive from a different manufacturer. What is GSA’s technical position on this issue as it relates to the awarded service vendor being responsible for its repair/replacement under the terms of the RFQ?

7 22-Nov-19 SOW C.2 Obsolescence If a major or expensive component becomes truly obsolete during the course of the agreement, does the GSA intend to force the awarded service vendor to repair/replace an elevator subsystem (e.g. modernize a control system or replace a traction machine) under the terms of this Agreement? Is there a dollar value associated with the material and/or labor cost required in this scenario? We cannot forecast which of the existing components (if any) will become obsolete at any time from the OEM’s for your equipment (Montgomery/Kone, MCE, etc.).

9 22-Nov-19 SOW C.4 & C.12 Service Calls From past experiences, the GSA did not have provisions in the Contract language to pay service calls for resetting elevators after seismic events (earthquakes), nor would not pay for any calls related to building power events.

Under the new contract term of this RFQ, will the GSA pay the awarded service provider for service calls related to earthquakes (seismic events that trip the equipment) or service calls caused by building power outages, surges, etc?

Sections C.4 & C.12 both: require 24/7 service calls, at no additional cost to GSA. Service Calls are considered a basic service and the cost for Service Calls/Callbacks is to be included in the Basic Services Quote.

Will 5-year, full-load testing (including traction drop testing) be required to be performed outside of business hours, as not to disrupt building operations? The elevator control systems at the 501 I Street Courthouse are supported by Kone Spares (Montgomery/Kone parts division). They are notoriously (egregiously) expensive. Please clarify the requirements in Section C.5 regarding providing one each replacement board. Is this per elevator? Can like boards by combined for the building? Does the “10% per controller” translate to the awarded service provider needing to provide spare boards for these units equaling 10% of the cost to replace one of each type of board for each elevator?

Like boards may be combined. GSA requires contractor to have adequate spare parts for common failure components. Controller manufacturers have listings of recommended 'spares' stock items, consult with manufacture. Any unused spares the contractor provided (w/ inventory) may go back to the contractor upon contract expiration. Awarded service provider, must provide 10% spare parts of each type of elevator controller. Manufacturer ‘KONE Elevator’ can provide a list of recommended spares. Yes, like boards may be combined.

These also look to be requirements more related to telecom company’s then elevator company’s, do you know if these are representations covered elsewhere in FAR by other certifications an elevator company would have?

It is recommended you update your SAM registration as soon as possible. For purposes of this RFQ, offerors must submit the full text, fill-in provision/clause at FAR 52.204-24 and GSAR 552.204-70 which can be found in Section K of the RFQ. B.2. TERM OF CONTRACT

After award, the successful offeror will be given a written Notice to Proceed, and shall provide elevator maintenance and related services for a six-month period commencing on the day specified in the Notice to Proceed. Work under this contract is expected to commence on or about April 01, 2020. It is the intent of the Government that the Notice to Proceed will provide for at least 30 working days preparation time before commencement of work.

The Government shall have the unilateral option of extending the term of this contract for four (4) consecutive additional periods of one (1) year each.

B.3. SERVICE CONTRACT ACT ASSUMPTIONS

Contractors shall price the contract by assuming the minimum hourly wages and fringe benefits established by the Administrator, Wage and Hour Division, U.S. Department of Labor or Collective Bargaining Agreement (CBA), for the initial period of performance and will apply to the entire performance period of the contract. The minimum wage rates and fringe benefits applicable to the initial period of performance are outlined in the incorporated wage determination.

Offerors shall determine any conditions which affect the work and make a thorough site investigation before submitting an offer. No allowances will be made for failure of an offeror to avail themselves of such information.

B.6. ORDERING LIMITATIONS (TASK ORDERS)

Additional services will be issued on a task order basis; all other services are standard, fixed services.

Orders for additional service(s) up to $2,500.00 may be placed, and payment processed using certified invoice procedures or a GSA credit card. Orders that exceed $2,500.00 may be placed or confirmed by issuance of a GSA Form 300, Order for Supplies or Services. The GSA Form 300 will describe the service(s) to be provided and will establish, excluding emergencies, the maximum number of hours for which the contractor will be compensated. Payments on a GSA credit card may not exceed the cardholder's single purchase limit.

C. DESCRIPTION/SPECIFICATION/STATEMENT OF WORK

Full Elevator Maintenance, Service, Repairs and Replacement

C.1. DEFINITIONS

1. Acceptance. Constitutes acknowledgment that the supplies or services conform to applicable contract quality and quantity requirements.

2. Additional Services. Additional services are defined as any work, requested and authorized by the Government that is within the scope of this contract but in addition to the basic services included in the offeror’s overall pricing. Contractor will be reimbursed for the additional services to include all labor, supervision, supplies and materials. The CO or designee will issue a separate delivery order before work may proceed. Any work of this nature detected by the Contractor shall be immediately reported to the COR, but work shall not be performed until the Contractor and the CO or their designee as appropriate have reached an agreement on the price to accomplish the project. Work shall be performed immediately, if necessary (i.e., an emergency), although typically a 48 hour notice will be given as a minimum.

3. Approval. "Approval" means the Government has reviewed submittals, deliverables, or administrative documents (e.g., insurance certificates, MSDS Sheets, etc.), and has determined the documents conform to contract requirements. Government approval shall not relieve the Contractor of responsibility for complying with Federal, State, local laws and regulations.

4. Building. A reference to “facility” and “site” is interchangeable with “building”. A man made structure used or intended for supporting or sheltering any use or continuous occupancy.

5. Contracting Officer (CO). Contracting Officer (CO) has the overall responsibility for the administration of this contract. The CO alone, without delegation, is authorized to take actions on behalf of the Government to amend, modify or deviate from the contract terms, conditions, requirements, specifications, details and/or delivery schedules. However, the CO may delegate certain other responsibilities to authorized Government representatives.

6. Contracting Officer's Representative (COR). The Contracting Officer's Representative (COR) shall be appointed by letter from the Contracting Officer (CO). COR will be the primary Government representative for the administration of the Contract, but will not have the authority to modify the contract.

7. Contractor. The term Contractor refers to the individual, firm, partnership, company, or corporation providing the services and directly contracting with the GSA as the prime contractor in the performance of the work described herein.

8. Elevator. The term elevator is used to mean all elevator, escalator, dumbwaiter, handicapped lift, courtroom lift, platform lift and wall glider equipment, if applicable, at the location(s).

9. Emergency. Emergency refers to all conditions and threats that are either man made or acts of god that require immediate action by the contractor to eliminate or mitigate actual or expected damages. Emergencies may include but not be limited to entrapments, bombings, bomb threats, civil disturbances, fires, explosions, electrical failure, entrapments, building flooding, chemical and gas leaks, medical emergencies, hurricanes, tornadoes, floods, and earthquakes.

10. Emergency Call-Back. Emergency call-back service consists of promptly responding to requests for emergency service 24 hours per day, 7 days per week. The contractor shall report to the site of the emergency within thirty (30) minutes of the time of notification and shall remain on the job until the emergency has been resolved. If the situation cannot be resolved immediately, the Contractor shall promptly notify the CO or their designee of the time and date corrective action will be taken. Requests for service may be made by the CO or their designee by telephone or other means. Emergency service consists of freeing individuals trapped in a stalled car, restoring inoperative elevators which are causing disruption to the arrival and departure of building occupants, or other situations determined by the CO or their designee to be an emergency nature.

11. Environmentally Preferable. Products or services that have a lesser or reduced effect on human health and the environment when compared with competing products or services that serve the same purpose. This comparison may consider raw materials acquisition, production, manufacturing, products and chemicals, packaging, distribution, reuse, operation, maintenance, or disposal of the product or service.

12. Installing Contractor. Construction Contractor or subcontractor who originally installed the equipment, system, part, item, unit or component.
