Questions and Answers New FDA Laboratory CMc |
Denver Federal Center, Lakewood, CO
1. Please confirm it is acceptable to utilize CPARs or previously filled out PPQs for Factor 3. We would include the full document (the full final CPAR or fully filled out PPQ) in the proposal response and not incorporate by reference
A. No, firms must submit a new PPQ either through the Google Form provided or submit the word version to the Contracting Officer or Contract Specialist by the solicitation deadline.
2. When will GSA be adding the drawings?
A. Please see newly uploaded concept design documents located in the appendix.
3. The Solicitation indicates the 90% concept design package was included as part of the issued documents. We do not believe these documents were issued either on sam.gov or through the GACA shared drive. Please issue these documents.
A. Please see newly uploaded concept design documents located in the appendix.
4. The RFP indicates that the 100% Concept Design will be issued at some point in April 2022 and that price proposals will not be accepted prior to that design package being amended into the solicitation. However, the price proposal response is currently due the same day as the technical proposal response. Please confirm this is correct
A. The due date for the technical and price proposals is May 06, 2022 by 4pm MST.
5. Due to not receiving the concept documents to this point, our subcontractors are asking for additional time to assist us in our pricing efforts. We would like to request an additional 4 weeks to properly assemble a technical proposal and a corresponding price proposal response. Please confirm the proposal due date will be extended
A. An extension will not be granted at this time.
6. When will you be issuing the 90% concept drawings noted on page 8 of 46 of the solicitation?
A. Please see newly uploaded concept design documents located in the appendix.
7. What is the anticipated period of performance for Design Phase services? Per the Agreement Section I.C. Period of Performance, we start within 10 days from NTP, and complete "upon acceptance of all deliverables required by the Design Phase Services Statement of Work" - however we need to understand the anticipated duration in order to price the design phase services work
A. The design schedule is provided in the concept narrative uploaded to the appendix.
8. Please provide the design schedule, in lieu of a stated period of performance for design phase services, we can use the design schedule as a basis for durations as we What is the anticipated period of performance for Construction Services? Per the Agreement Section I.C. Period of Performance, we start within 10 days after NTP for the GMP Option, and complete no later than July 30,2025 - however we need to understand the duration and timing in order to price the Target Estimated Cost of Work assemble our pricing
A. Please refer to the answer to question 7.
9. In the solicitation, under Factor 4 - Key Personnel Past Performance, Offerors are required to include no more than four examples of similar projects that each key personnel has performed. Please confirm these similar project examples are not required to be the same similar projects that the Offeror is including under Factor 1.
A. Per the Request for Proposal, “The Similar Projects that offeror submits in response to this factor should match the Similar Projects that offeror submits in response to Factors 1 and 3, above.”
10. Also under Factor 4, the requirements states "For each project performed by each proposed key personnel for Factor 3, the Offeror shall distribute - Key Personnel Past Performance Questionnaire(s) to each reference for completion." If the Key Personnel did not work on the projects included under Factor 3, are Offerors required to distribute PPQs to the projects included on each Key Personnel's resume?
A. Yes
11. For Key Personnel, it is customary to limit references to two (2), and include the references contact info for the government to contact. For Example: The RFP for the FDA Chemistry Center Modernization project in Cincinnati from GSA Region 5 (Solicitation Number 47PF0020R0057S) required the following for key personnel:
The Offeror shall identify the personnel they propose to fill the key team member positions listed below and state their roles and responsibility to the project. The Offeror shall provide evidence of the competency, past performance, qualifications and related experience of key team members. If the key team members did not work on the three projects submitted under Evaluation Factor Number 1, provide contact information for two references each who can provide thorough knowledge of the details of the individual’s performance (such as the Project Manager, Building Owner, or Contracting Official associated with the project) in a similar position on a similar project. The Offeror shall provide resumes for each key team member clearly indicating their currently held position/title, proposed project position/title, education, qualifications, professional licensing, personal awards received, and work experience (including roles) over the last ten (10) years. Provide a matrix chart clearly identifying the roles that key team members held on the projects submitted under the Experience and Past Performance factor. Please revise the requirement for key personnel to be more in line with industry standards and confirm that including two references and their contact info on Key Personnel's resume is acceptable, in lieu of the PPQ(s).
A. Factor 4 will remain the same and the PPQ’s will still be required as stated.
12. Reference Solicitation Page 8 - Please provide the 90% Concept Design Package noted in the solicitation.
A. Please see newly uploaded concept design documents located in the appendix.
13. Is there an updated project prospectus that you can share?
A. There is not an updated prospectus.
14. Reference the Agreement IV.A.1.f, please provide the CMc Contingency Allowance (CCA) to use for this project. Also, per IV.A.1.g - provide shared saving percentage.
A. The share ratio for the construction contractor shall range from 30 percent to 50 percent. The share ratio for the construction contractor shall not exceed 50 percent.
The complexity of the project and the amount of risk to the construction contractor should be considered when determining the ratio. A project with greater risk to the construction contractor should reflect a greater share ratio for the construction contractor.
15. Reference Solicitation IV.M ii, states Government may exercise any option within 400 calendar days and the Agreement III.P ii states 475 calendar days. Per the Order of Precedence it appears the Agreement of 475 calendar days would be required however please confirm the nearly +15 months is the intend to award the GMP Option and Facilities Engineering Option after award of Design Phase Services.
A. The solicitation has been updated to 475 days. Please refer to the project schedule provided.
16. Reference SOW Section II.G., states the Contractor is responsible for providing dedicated project offices for this project and PDT to co-locate, to include CMa, GSA, FDA and CxA. In addition to workspace, space shall be provided for conferences and meetings which includes at a minimum, conference tables, chairs, and flat screen monitors with all HDMI and USB connections and cabling. The Contractor shall also provide, cameras, microphones, and speaker phones for teleconferencing and video conferencing. The contractor shall provide high-speed internet service for all parties within the project office. Please provide specific list of requirements, number of staff, cubicles, offices, size of rooms, and specific AV, electrical etc. requirements for each space / person.
A. The scope of work will be updated to remove this item.
17. Reference SOW Section V Appendix, sections A,B,C,D and E are missing. Please provide.
A. Documents for A, B, C, D, and E have been provided in the appendix.
18. Reference SOW page 16 D. Deliverables, please provide the A/E design submissions schedule so as to coordinate with contractor design phase services in preparing this proposal.
A. See the A/E SOW provided in the appendix.
19. Reference Solicitation Page 8 - Please provide the 90% Concept Design Package noted in the solicitation.
A. Please see newly uploaded concept design documents located in the appendix.
20. The Statement of work refers on page 25 Section V to Appendix E. Operation and Maintenance Specification. Please clarify if this refers to the separately provided “National Facility Engineering Specification”.
A. Yes, it is referring to the National Facility Engineering Specification
21. Please clarify that no Building Soft Services (i.e. Cleaning, Housekeeping etc.) are included in the Operation and Maintenance.
A. Correct, only Operations and Maintenance.
22. The Solicitation documents refer to at least 1 plus an optional 4 years of Facility Engineering Services (O&M). Is the proposer to provide multiple fees, as maintenance can differ significantly between year 1 and 5 of operations? The price evaluation form currently seems to only include one single fixed price.
A. Please provide a base option price plus four 1-year options. You may edit the sheet as necessary to provide any additional information.
23. As the documents are in such an early stage, it is nearly impossible to develop and accurate, competitive Firm Fixed Price for Facility Engineering Services, especially given the work would not begin for approx. 3 years in a very volatile labor and material market. We recommend the pricing for this be listed as TBD. Or, include the pricing as a GMP, with a target ECW for this scope.
A. The O&M pricing should be provided as a GMP for the base and the four 1-year options. Final pricing will be negotiated prior to exercising the base O&M option.
24. The Solicitation asks proposers for a general Engineering Services Approach limited to 10 pages. However, the National Facility Engineering Specifications requires with the Contractor’s proposal also a Staffing plan, Subcontracting plan, Quality Control Plan and Preventative Maintenance Plan. Please clarify the requirements.
A. The ten (10) page limit approach includes ALL elements, please be concise in your response.
25. Please clarify if GSA intends to issue a separate Service Agreement for the Building Engineering Services.
A. The 220311 Facilities Engineering PWS should be bid as a GMP with a base year and four 1-year options and will be awarded as an option to the contract.
26. Please confirm that the limit to maintain, replace, modify and restore architectural and structural components is limited to only $1,000. Is this a total limit or per incident?
A. This only applies to the 220311 Facilities Engineering PWS portion of the work per incident.
27. It is highly unusual to have Facility Engineering (O&M) Services included in a construction contract, given that the majority of qualified offerors do not perform this service in-house and therefore would be subcontracted where it would be more cost efficient for the government to contract directly with the provider under a service agreement. We request this requirement be removed from the solicitation.
A. This request is denied, the facilities engineering requirement is pivotal to the overall scope of the project.
28. Reference SOW Section III.D.7 Provides "Final move, including all aspects of tenant relocation(s) (telecommunications, furniture relocations, lab equipment, etc.); " Please confirm that the relocation/move of the tenants into the new space is not included in this Contract and is not the responsibility of the CMc.
A. These items will be required in the contract. Provide this in your construction GMP.
29. Reference Solicitation page 2. Since the 90% or 100% Concept Design packages have not been issued at the time all initial questions are due (10:00 am on 4.18.22), can there be an additional question/answer period to be held after the Design packages are released to Contractors?
A. Please see newly uploaded concept design documents located in the appendix.
30. As the concept documents were just issued on April 18, offerors now only have 18 calendar days to put together and finalize pricing for the proposal. This is not in line with typical government solicitation periods that allow a minimum of 30 days to assemble pricing proposals. Please extend the proposal period an additional 12 days to allow adequate time for offerors to competitively price this project
A. The response date is hereby extended from May 6, 2022 to May 9, 2022 by
10:00AM MST.
31. To follow up on the response to Amendment 1, RFI Question 9, it is not feasible, and for most offerors, very highly unlikely to have a Project Manager and Superintendent that worked together on all projects submitted in response to Factor 1 and 3 (minimum of 2, maximum of 4). We request, again, that the projects included on key personnel meet the relevancy requirements, but are not necessarily the same projects as Factor 1 and 3.
A. See revised Factor 4 in the solicitation dated April 26, 2022.
32. To follow up on the response to Amendment 1, RFI Question 28, please provide an inventory of all items to be relocated, and the location where the items are currently stored, so this can be accurately priced.
A. Please see the Program Validation Document Volume 3 (newly uploaded in the appendix) for the existing laboratory equipment surveys and photos. Please ignore the column in the surveys that states “Furnish_Install”, per response #28 all relocation and installation will be the responsibility of the CMc. The existing laboratory is in building 20, adjacent to the project site.
33. Reference SOW III.C.6. There is an obligation for CMc to procure and construct mockups listed in the Design Phase Services. "CMc will be required to procure all necessary materials for mockups and construct all mockups." As the Trade Partners will need to be selected and perform much of this physical work on the mockups, please confirm that the costs for the physical mockups should fall into the Construction Phase Services, and only attendance at mockup design meetings and participation in mockup planning should be covered in the Design Phase Services.
A. Yes, this is correct.
34. The Division 1 Specification has many areas that appear to include internal notes for the Spec Writer, and much of the project-specific information has yet to be completed to apply to this project. Is there a version of the Division 1 specification that has been made project-specific available in order for CMC's to fully understand and price the Division 1 project-specific requirements?
A. The project is still in the concept phase and no specifications have been produced.
The Division 1 GSA specification was provided as a guide for typical GSA capital projects.
35. Reference SOW Section III.D.7 and Q/A Response #28. In order to accurately price the final move and all aspects of tenant relocation, please provide a full listing of the items to be moved and relocated. If there are any pieces of equipment that are required to be moved by the manufacturer directly in order to maintain services agreements or warranties, please provide contact information for those pieces of equipment. Has the GSA considered having all bidders carry an Allowance in the Construction GMP to account equally for the move and relocation costs?
36. Reference the Solicitation V.F. Security Requirements. On the site walk held 4.16.22 it was noted by the GSA that the HSPD-12 badging process would not apply to this project for worker access to the site. Please confirm that the HSPD-12 badging process will not apply, and please provide any additional jobsite access requirements that CMc's will need to comply with in order to grant worker access to the site.
A. Only a valid government-issued ID is necessary for site access. After hours access may require badging.
37. Reference Concept Drawings - AF2.1.1 Provides notes for the types of flooring.
Within a few of the notes, the drawings ask to “Allow $6/sf or Allow $40/sy”. Are these allowances intended to include labor and material or material only?
A. These are material allowances only.
38. Can the Revit model for the Concept Design documents be provided?
A. The concept design was developed using a number of software platforms, including Revit. As such the Revit model would be incomplete information. It is best to rely on the drawings and supporting documents provided in the RFP.
39. Reference Attachment D - CLIN Breakdown Forms - Forms provide separate line items for Fee/Profit and Contingency, however, there are separate CLIN's for these items on the summary sheet, so if all line items are filled out, there will be double-ups on the Summary sheet. The information requested on the CLIN summary sheets does not match how the pricing is to be provided on the Summary Sheet. Are these CLIN breakdowns required to be submitted and if so, can you provide direction on how you would like to see them filled out and tie to the Summary Sheet?
A. Yes, CLIN breakdowns will be required. The form may be edited as necessary to fit your pricing needs. Formulas and how they tie into the summary sheet are the responsibility of each offeror.
40. Is the CMc Contingency Allowance intended to cover escalation or is each Contractor required to include their own escalation contingencies within their ECW?
A. “CMc Contingency Allowance (CCA)” means an allowance for the exclusive use of the construction contractor to cover reimbursable costs during construction that are not the basis of a change order. These costs could include estimating, scheduling, and planning errors in the final Estimated Cost of the Work (ECW) or other contractor errors.”
41. Is the CMc Contingency Allowance for exclusive use by the GSA and the Contractor needs to carry their own internal Contractors Contingency in the ECW, or is the CMc Contingency Allowance for Contractor use and the GSA is holding their own Contingency outside of the Contract?
A. See definition to question number 40. Please clarify which part of the requirements you are referencing.
42. Reference the Solicitation VI.E. - The TEP form has a calculation that provides the Total Evaluated Price (1+8) which is the Design Phase Services and Facilities Engineering and Related Services. Attachment D does not provide this same calculation and it appears on that form that all CLINs would be added to calculate the TEP. Please clarify the differences between the breakdowns in these two forms related to proper calculation and the TEP.
A. Vendors are responsible for tailoring the form to calculate the TEP. Attachment D should also calculate the Design Phase Services and Facilities Engineering and Related Services, offerors are responsible for editing Attachment D as necessary to fit their needs.
43. Reference Solicitation, Page 45-46. Will we be required to provide 3 PPQs for the facilities maintenance relevant experience contracts or will listing past performance O&M contracts suffice?
A. Factor 6 states firms are to include an approach and provide their experience.
Please review Factor 6 in its entirety.
44. The Solicitation requires the CMc contractor to list relevant experience “for which it provided facilities engineering or operations-and-maintenance service post-award, for projects in which it served as the primary CMc or GC of the project in the last ten years.” This is a very atypical contract where the GC/CMc also is the O&M after construction. Would GSA accept past performance from a subcontractor that specializes in operations and maintenance and/or facilities engineering that the CMc intends to team with on this contract?
A. GSA will consider the past experience of subcontractors proposed as long as there is some guarantee that said subcontractor will in fact be performing the work via agreement between the GC or CMc and the facilities engineering subcontractor.
45. The minimum staffing plan shows that there should be at minimum one Onsite Project Manager, one Onsite Maintenance Supervisor, two Production Control and Administrative Support positions, and one AMS/BAS Technician. Are all of these positions full-time employees that are to be specifically dedicated to this project?
Would the Onsite Project Manager qualify as one of the two Production Control and Administrative Support positions?
A. The staff should be available to perform the work as needed, but don’t need to be staffed full-time as long as someone is available onsite during stated building hours.
